AMENDMENT No. 36 TO THE EAST WANNEROO CELL 4 (HOCKING AND PEARSALL) AGREED STRUCTURE PLAN No. 6 The City of Wanneroo, pursuant to its District Planning Scheme No. 2, hereby amends the above Agreed Structure Plan by: 1. Outlining land coded R30 and R40 contained within Lot 22 East Road, Hocking, as depicted on the East Wanneroo Structure Plan - Cell 4 map, and annotate the outline in the legend as: "Area subject to R- MD development standards" 2. Inserting the following provision into Part 1, under a new 'Clause 7.0 Development requirements: The City of Wanneroo Local Planning Policy 4.19 Medium Density Housing Standards (R-MD) (LPP 4.19) sets out acceptable variations to the deemed-to-comply provisions of the Residential Design Codes (R-Codes) for Lots coded R25-R60. The variations set out in LPP 4.19 apply for the development of lots within areas designated as 'subject to R-MD development standards' on the structure plan map and thereby constitute acceptable development within the structure plan area." 3. Delete the following text from Part 1: "As provided for under the relevant 'Structure Plan' provisions of the Scheme, this part of the Structure Plan has the same force and effect as if it was a provision, standard or requirement of the Scheme." 4. Rename 'Part 1 - Statutory Planning Section' to 'Part 1 - Implementation'
PART 2 EXPLANATORY REPORT AMENDMENT No. 36 TO THE EAST WANNEROO CELL 4 (HOCKING AND PEARSALL) AGREED STRUCTURE PLAN No. 6 1. INTRODUCTION This amendment seeks to insert an additional provision into Agreed Structure Plan No 6 (ASP6) to apply the R-MD codes for all R30 and R40 coded land within Lot 22 East Road, Hocking. 2. PLANNING BULLETIN 112/2016 WAPC Planning Bulletin 112/2016 was released in 2016 and sets out acceptable residential development standards for medium-density single houses. It proposes various changes to the development standards for the respective residential codes contained within the WAPC s Residential Design Codes (R-Codes). 3. LOCAL PLANNING POLICY 4.19: MEDIUM-DENSITY HOUSING STANDARDS (R-MD) At its Ordinary Council Meeting of 7 November 2016, the City of Wanneroo resolved to adopt Local Planning Policy 4.19: Medium-Density Housing Standards (R-MD). This policy applies where an approved structure plan identifies that the R-MD standards are to be implemented. 4. PROPOSED AMENDMENT This amendment to ASP 6 seeks to apply the Residential Medium Density (R-MD) Codes to all Residential R30 and R40 land within Lot 22 East Road, Hocking as shown on Plan 1 R-MD Codes Amendment Plan. The amendment proposes to incorporate the following provisions into Part 1 to apply the R-MD Codes in accordance with LPP 4.19. 7.0 Development Requirements The City of Wanneroo Local Planning Policy 4.19 Medium Density Housing Standards (R-MD) (LPP 4.19) sets out acceptable variations to the deemed-to-comply provisions of the Residential Design Codes (R-Codes) for Lots coded R25-R60. 5. JUSTIFICATION The proposed amendment seeks to implement the R-MD Codes as per the City s LPP 4.19 to achieve consistency for R-Code variations across the subject site. The approval of the R-MD provisions will ensure that development reflects contemporary standards for smaller lots and achieves the desired development outcome envisioned for the site as part of Amendment No. 31 to ASP 6. The proposed amendment is considered minor and will not have a major impact on the amenity of the ASP 6 area. Additionally, the application of the R-MD codes will provide greater flexibility for single dwelling development, without the need to apply for an R-Code variation through the Planning Application process. 6. Conclusion The proposed amendment is consistent with the adopted Local Planning Policy 4.19 and will ensure a consistent approach to R-Code variations and development. This amendment is considered to be minor in nature and does not require advertising by the City.
