That in addition to the funds heretofore created for the purpose of administering and accounting for the finances of the City, a new fund be and the same hereby is created as follows: a. Fund #243 Sugartree Corridor Grant Fund Section 2. That this ordinance is hereby declared to be an emergency measure necessary to the immediate preservation of the public health, safety and welfare, and accordingly, shall be in full force and effect immediately upon its passage. RESOLUTION NO. AUTHORIZING PAYMENT OF EXPENSES INCURRED IN PRIOR FISCAL YEAR WHEREAS, expenses in excess of Three Thousand Dollars ($3,000.00) for certain services and/or contracts were incurred in FY 2010( 10 Expenses ) and appropriations were made for said 10 Expenses in FY 2010 and WHEREAS, billing statements and/or requests for payment said 10 Expenses have been received after the close of FY 2010 and WHEREAS, payment of said 10 Expenses must now be made from current fiscal year appropriations; and WHEREAS, both at the time the contract for the 10 Expenses was made or the purchase order issued, the amount of the order or contract was lawfully appropriated for the purpose of the order or contract and that the appropriation remains unencumbered and that the resources to pay the obligation when it came due were on hand or in the process of collection to the credit of an appropriate fund; and WHEREAS, pursuant to R.C. 5705.41 (D)(1), Council must specifically authorize payment of the 10 Expenses. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WILMINGTON, STATE OF OHIO: Section 1. authorized. That payment of the 10 Expenses set forth below is hereby 635.360.5546 2010 CORF Remediation $13,599.95 Section 2. That this resolution is hereby declared to be an emergency measure necessary to the preservation of the community s health, safety, and welfare, such emergency arising out of the necessity to pay such expenses in a timely manner shall be in full force and effect immediately upon its passage. ORDINANCE NO. AUTHORIZING THE ADVERTISING FOR BIDS FOR THE CONSTRUCTION OF THE VERTICAL EXPANSION (PHASE II) OF THE CITY LANDFILL AND FOR CONTRACTING FOR SAME, AND DECLARING AN EMERGENCY WHEREAS, the City of Wilmington has received from the Ohio EPA a Permit to Install a vertical expansion of the City Landfill; and WHEREAS, the project is ready for the advertising for bids for the construction of Phase II of the vertical expansion and for beginning construction of the same. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WILMINGTON, STATE OF OHIO: Section 1. That the Director of Public Service be, and he hereby is, authorized to advertise for bids for the construction of Phase II of the vertical expansion of the City landfill in accordance with specifications to be promulgated therefore and within the appropriations therefore, the total cost estimated to exceed the sum of $25,000. Section 2. That the Director of Pubic Service is hereby authorized to contract for the construction of Phase II of the vertical expansion of the City landfill with the lowest and best bidder thereof after advertisement for such bids for not less than two consecutive weeks in the Wilmington News Journal, a newspaper of general circulation within the City. Section 3. That this Ordinance shall be effective immediately as an emergency measure to protect the health of the community due the impending completion of fill operations at the City s landfill based on current operating permits with the Ohio Environmental Protection Agency. RESOLUTION NO. DECLARING A PUBLIC NUSIANCE AND SPOT SLUM AND BLIGHT AND DECLARING AN EMERGENCY WHEREAS, the City of Wilmington has several substandard housing units that have been determined to be unsafe under the Wilmington City Code on a citywide basis; and, WHEREAS, the State of Ohio, through the Ohio Department of Development, has CDBG funds available to assist with the elimination of spot slum and blight; and, WHEREAS, the City of Wilmington is eligible to apply for CDBG funds to help assist in the elimination of slum and blight; and, WHEREAS, as a requirement of Small Cities CDBG Program, the City of Wilmington must delineate Spot Slum and Blight by resolution. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Wilmington, State of Ohio: SECTION 1. That deteriorated structures identified through the City of Wilmington s Code Enforcement Program on a citywide basis are nuisances and hereby declared Spot Slum and Blight. SECTION 2. To acknowledge and pledge to comply with all conditions and assurances of the CDBG program such as fair housing, historic preservation review coordination, equal opportunity and other state and federal regulations as applicable. SECTION 3. To hereby authorize the to enter into contracts with the State of Ohio and contractors, and other parties as needed, to implement the activities funded by the grant in accordance with all pertinent laws and regulations. SECTION 4. That this Resolution shall be effective immediately as an emergency measure due to the fact that the deadline for applying for FY 2011 CDBG Formula Program funding for demolition activities is July 29, 2011. AUTHORIZING THE SUBMITTAL OF AN APPLICATION FOR THE FY 2011 SMALL CITIES COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FORMULA PROGRAM AND DECLARING AN EMERGENCY WHEREAS, the City of Wilmington has portions of the City that are substandard and meet the requirements of the CDBG Formula Program, and; WHEREAS, the City of Wilmington desires to participate in the Ohio Small Cities CDBG Formula Program to address these needs, and; WHEREAS, the State of Ohio, through the Ohio Department of Development, has Fiscal Year 2011(FY 2011) funds available as part of the Community Development Block Grant Program; and; WHEREAS, the City of Wilmington intends to apply for $54,000 in CDBG Formula funds. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Wilmington, State of Ohio: SECTION 1. To hereby authorize the submission of an application for a FY 2011 CDBG Formula Program. SECTION 2. To acknowledge and pledge to comply with all conditions and assurances of the CDBG program such as fair housing, equal opportunity and other state and federal regulations as applicable. SECTION 3: To hereby authorize the to enter into contracts with the State of Ohio and contractors, and other parties as needed, to implement the activities funded by the grant in accordance with all pertinent laws and regulations. SECTION 4: That this resolution is hereby deemed to be an emergency measure necessary to preserve the health, safety and welfare if the citizens of Wilmington in that the deadline for said grant application is July 29, 2011. AUTHORIZING THE MAYOR TO SUBMIT AN APPLICATION FOR AN EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT OF $77,100 FOR PATROL CARS FROM THE OFFICE OF CRIMINAL JUSTICE SERVICES, A DIVISION OF THE OHIO DEPARTMENT OF PUBLIC SAFETY WHEREAS, the City of Wilmington is eligible for approximately $77,100 of grant money from the Edward Byrne Memorial Justice Assistance Grant to purchase two patrol cars and all the necessary emergency equipment to operate them; and WHEREAS, the deadline for application is September 10, 2011. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WILMINGTON, STATE OF OHIO: Section 1. That the be, and hereby is, authorized to file an application through the Office of Criminal Justice Services, an Edward Byrne Memorial Justice Assistance Grant for any and all amounts for which the City of Wilmington eligible to apply Section 2. That the be designated the official representative of the City of Wilmington, Ohio, for said grant purposes, authorizing and directing the to execute said application, including all assurances and understandings contained therein, for the said Edward Byrne Memorial Justice Assistance Grant as designated in the application, on behalf of the City and to provide such additional information as may be required.
