EAST WINDSOR TOWNSHIP COUNCIL Tuesday, The meeting of the East Windsor Township Council was called to order by Mayor Janice S. Mironov at 8:00 p.m. on. Municipal Clerk Cindy Dye certified that the meeting was noticed in the Annual Meeting Notice. Notice was sent to the Trenton Times, filed with the Municipal Clerk and posted in the East Windsor Township Municipal Building, all on January 4, 2012. All requirements of the Open Public Meetings Act were satisfied. Boy Scout Kenny Gerhardt of Boy Scout Troop 59 led the flag salute. Present were: Mayor Janice S. Mironov, Deputy Mayor Perry Shapiro and Council Members Marc Lippman, Alan Rosenberg and John Zoller. Also present were Township Manager Alan M. Fisher, Township Attorney David E. Orron and Municipal Clerk Cindy A. Dye. Council Member Yeager was absent. Council Member Hector Duke arrived at 8:15 p.m. PRESENTATIONS & PROCLAMATIONS: Eagle Scout: Anthony Sosa of Boy Scout Troop 59 (January 15, 2012). RESOLUTIONS: Resolution R2012-7 Approval of Amendment to Green Acres Project Agreement with New Jersey Department of Environmental Protection for East Windsor Township Open Space Acquisition The Township Clerk read by title Resolution R2012-7. Mayor Mironov stated that this is an agreement for the additional $250,000 grant received by East Windsor Township from the State Green Acres program. We also received an additional $100,000 for East Windsor Green Space. There is a typographical error in the resolution which should reflect the amount to be $250,000.

Page 3 It was MOVED by SHAPIRO and seconded by ROSENBERG that Resolution R2012-7 be adopted as corrected. There being six (6) ayes and no nays, Resolution R2012-7 was adopted as corrected. Resolution R2012-8 Approval of Professional Services Agreement for Township Attorney The Township Clerk read by title Resolution R2012-8. Mayor Mironov stated that the appointment was done at the reorganization meeting. She indicated that the term of the agreement should be listed in the resolution. It was MOVED by ROSENBERG and seconded by SHAPIRO that Resolution R2012-8 be adopted as corrected. There being six (6) ayes and no nays, Resolution R2012-8 was adopted as corrected. Resolution R2012-9 Approval of Professional Services Agreement for Township Planner The Township Clerk read by title Resolution R2012-9. Mayor Mironov indicated that the term of the agreement should be listed in the resolution. A memo was distributed by Mayor Mironov, Deputy Mayor Shapiro and Planning Board Chairperson Edward Kelley recommending approval. The Township publicly solicited for all the contracts through the fair and open process. It was MOVED by SHAPIRO and seconded by DUKE that Resolution R2012-9 be adopted as corrected. There being six (6) ayes and no nays, Resolution R2012-9 was adopted as corrected. Resolution R2012-10 Approval of Professional Services Agreement for Landscape Architect

Resolution R2012-14 2012 Temporary Budget Appropriations The Township Clerk read by title Resolution R2012-14. It was MOVED by LIPPMAN and seconded by DUKE that Resolution R2012-14 be adopted. Mayor Mironov stated that the temporary budget is below than what is permitted under the State statute. She directed the staff that until such time the Township has a spending plan and a budget every caution should be taken to limit spending and to maintain limited spending as best they can to function adequately. There being six (6) ayes and no nays, Resolution R2012-14 was adopted. APPLICATIONS: New Jersey Fireman s Association Membership Application for William R. Ortiz It was MOVED by ROSENBERG and seconded by SHAPIRO that New Jersey Fireman s Association Membership Application for William R. Ortiz be approved. Ms. Dye confirmed that the application was in order.

REPORTS BY COUNCIL AND STAFF: Deputy Mayor Perry Shapiro stated that the planning board met last night for their reorganization meeting. The Board heard a waiver of site plan for First Choice Bank to upgrade the façade of their building. Council Member Duke stated that the Welfare Committee met. Mayor Mironov stated the Economic Development Committee met on January 5 and re-elected Michael Henderson as the Chairperson and Denise Daniels as Vice-Chairperson. They are currently working on the business card exchange for the kick-off for the release of the new Township street map. They are also working on updating the business brochure. Mayor Mironov stated that the Clean Communities met on December 29 and they are having their wrap-up meeting on January 26. They also reviewed some Sustainable Jersey initiatives. Page 7 APPROVAL OF BILLS: Listed for approval were current 2011 bill list dated January 5, 2012, current 2010 bill list dated January 5, 2012 and a capital bill list dated January 5, 2012, as well as other miscellaneous and trust account bill lists. Mr. Zoller had various questions on the bill list. Mayor Mironov suggested that Mr. Zoller meet with Mr. Fisher to address his questions. It was MOVED by ZOLLER and seconded by ROSENBERG that the bills be approved as indicated above. There being six (6) ayes and no nays, the bills were approved as indicated above. MATTERS BY COUNCIL: Mayor Mironov stated that she received a letter dated December 27, 2011 from New Jersey Department of Environmental Protection Commission Martin transmitting our $3,000 grant check for the Green Communities Grant. She reminded everyone that the 2012 Food Drive is still continuing through the month. There will be Martin Luther King service sponsored by the Windsor-Hightstown Ministerium on Sunday, January 15 at Mt. Olivet Baptist Church. She indicated that the pass legislature went out of session this morning. There were no solar bills scheduled for this session. Governor Christie conditionally vetoed Assembly Bill A-3992 exempting wind turbines from regulatory review. He also conditionally vetoed the bill regarding EMS services. The State of the State address was canceled due to the sudden death of Assemblyman Alex DeCroce. MATTERS BY PUBLIC: None DISCUSSION ITEMS AND COUNCIL ACTION WHERE APPROPRIATE: 1. Police/Court Solar Project Resolution R2012-16 Action on Solar Project at the East Windsor Police/Court Building Mayor Mironov requested that this matter be held to the January 24, 2012 Council meeting. There are additional details that need to be worked out. 2. Township Summer Concerts/Movie in the Park Program Mayor Mironov stated that initial information has been received from the Recreation Department on this subject. Mayor Mironov and Council Members discuss the various options proposed by the Recreation Director. It was the consensus that additional information be provided for the

Page 8 Rag Doll, Beetlemania bands, Neil Diamond bands or any other bands with that type of music. Mayor Mironov requested the information and dates as soon as possible.
