CITY OF SHAMOKIN BILL 08-11 IT IS HEREBY ENACTED AND ORDAINED BY THE CITY COUNCIL OF THE CITY OF SHAMOKIN AS FOLLOWS: Article 1. This Ordinance shall be known as The 2008 Parking Violation Fee Schedule Ordinance. Article 2. Section 103-12 of Ordinance 287 [Parking Meters], as previously amended by Article 3. Section 103-12 - Overtime Parking Charge Any person who causes, allows or permits any vehicle to be parked overtime or beyond the period of legal parking time established for any parking meter zone, shall pay to the City an overtime parking charge in the amount of Five ($5.00) Dollars. There shall be a separate overtime parking charge of Five ($5.00) Dollars for each consecutive period of three (3) hours following the period for which the original overtime parking charge is made for the same parking meter zone when the same vehicle is caused, allowed or permitted to be parked in such parking meter zone after the original charge is made. Section 103-13 of Ordinance 287 [Parking Meters], as previously amended by Section 103-13 - Notice of Overtime Parking Charges; Failure to Pay A. Whenever any vehicle is caused, allowed or permitted by any person to be parked in any parking meter zone for a time longer than is permitted by this Article, any duly authorized employee of the City, under the direction of the Mayor and the Director of Public Safety, shall notify such person of the applicable overtime parking charge by placing a written notice of ticket under the windshield wiper or in some other conspicuous place on such vehicle indicating the time of violation. Unless the overtime parking charge is paid within forty-eight (48) hours, an additional late charge of Two ($2.00) Dollars shall be added. B. All overtime parking charges, including any additional late charges, shall be paid to the City not later than ten (10) days after the date of the violation; and the notice or ticket placed on the vehicle at the time of

Article 4. the violation shall advise the owner or operator of such vehicle that, unless the overtime parking charges, including additional late charges, are paid within the time limits herein specified, the fine payable upon conviction of overtime parking and failure to pay such charges within the time set forth above shall not be less than Ten ($10.00) Dollars nor more than Twenty- Five ($25.00) Dollars and costs of prosecution for each offense and, in default of the payment of said fine and costs of prosecution, imprisonment in the county jail for a period of not more than five (5) days. Section 103-15 of Ordinance 287 [Parking Meters], as previously amended by Article 5. Section 103-15 - Violations and Penalties Whoever violates sections 103-2, 103-4 103-6(B), 103-6(C), 103-6(E), 103-6(F) or 103-6(G) as set forth in this Article shall be fined Fifteen ($15.00) Dollars. If said fine is not paid within ten (10) days after the date of violation, the fine upon conviction will be a minimum of Twenty-Five ($25.00) Dollars plus the costs of prosecution for each offense and, in default of the payment of said fine and costs of prosecution, imprisonment in the county jail for a period of not more than five (5) days. Each and every day upon which any person violates or continues to violate the provisions of this chapter shall constitute a separate offense. Section 103-33 of the Ordinance of May 6, 1968 [Traffic and Parking] which is codified as Section 103-33 of the Shamokin City Code is hereby amended to read as follows: Section 103-33 - No Parking; Specific Areas A. It shall be unlawful to stop or park any attended or unattended vehicle: 1. In front of the entrance to any church, school, hotel, theater or public building. 2. Within fifteen (15) feet of any fire hydrant. 3. Within twenty-five (25) feet of intersecting curb lines and, where there are no curb lines, within fifteen (15) feet of intersecting property lines, at all street intersections. 4. On any bridge or approach thereto. 5. Within an intersection. 6. On a crosswalk or sidewalk 7. In front of any private driveway or garage. 8. On the roadway side of any vehicle legally parked at the curb.

9. Within any bus stop or taxi stand. 10. Alongside any street obstruction or opposite the same, unless twenty-five (25) feet of street shall be free for passage of other vehicles. 11. On private property, except upon permission of the property owner. 12. Where signs prohibit parking. 13. In a space or area designated as restricted parking for the use of any business or organization, except upon permission of the said business or organization. 14. In a handicapped parking zone. B. Violations and Penalties 1. Whoever violates sections103-33(a)(1), 103-33(A)(3), 103-33(A)(4), 103-33(A)(5), 103-33(A)(6), 103-33(A)(7), 103-33(A)(8), 103-33(A)(9), 103-33(A)(10), 103-33(A)(11), 103-33(A)(12), and 103-33(A)(13) as set forth in this Article shall be fined Fifteen ($15.00) Dollars. If said fine is not paid within ten (10) days after the date of violation, the fine upon conviction will be a minimum of Twenty-Five ($25.00) Dollars plus the costs of prosecution for each offense and, in default of the payment of said fine and costs of prosecution, imprisonment in the county jail for a period of not more than five (5) days. 2. Whoever violates section103-33(a)(2) as set forth in this Article shall be fined Twenty-Five ($25.00) Dollars. If said fine is not paid within ten (10) days after the date of violation, the fine upon conviction will be a minimum of Fifty ($50.00) Dollars plus the costs of prosecution for each offense and, in default of the payment of said fine and costs of prosecution, imprisonment in the county jail for a period of not more than five (5) days. 3. Whoever violates section103-33(a)(14) as set forth in this Article shall be fined Fifty ($50.00) Dollars. If said fine is not paid within ten (10) days after the date of violation, the fine upon conviction before the District Judge will be a minimum of Fifty ($50.00) Dollars and a maximum of Three Hundred ($300.00) Dollars, plus the costs of prosecution for each offense and/or imprisonment in the county jail for a period not exceeding ninety (90) days. 4. Each and every day upon which any person violates or continues to violate the provisions of this chapter shall constitute a separate offense. Article 6.

Section 4 of Ordinance 282 [The Street Sweeping Parking Ordinance], as amended by the Ordinance of February 11, 1992, and codified as Section 103-62 of the Shamokin City Code, is hereby amended to read as follows: Article 7. Section 103-62 - Violations and Penalties. The City of Shamokin, through its Police Department or other duly authorized agent, shall place upon the vehicle in violation of this ordinance a notice to the owner or operator thereof that such vehicle had been parked in violation of the provisions of this ordinance. Each owner or operator may, within forty-eight (48) hours of the time of any such notice is attached to such vehicle, pay as a penalty for and in full satisfaction of such violation the sum of Fifteen ($15.00) Dollars; thereafter, a notice of nonpayment shall be issued to such owner or operator imposing a penalty of Twenty ($20.00) Dollars, payable within seven (7) days of the mailing of such notice of nonpayment. The failure of such owner or operator to make such payment as specified above shall result in the imposition, upon conviction before the District Judge, of a fine not less than Twenty-Five ($25.00) Dollars and the costs of prosecution and, in default of the payment of the fine and costs of prosecution, undergoing imprisonment for not more than three (3) days. Each and every day upon which any person violates or continues to violate the provisions of this chapter shall constitute a separate offense. Section 5 of Ordinance 384 [Handicap Parking] is hereby amended to read as follows: Section 5: Violations and Penalties A. Any person who parks in a reserved parking space who is not authorized to do so shall be subject to immediate citation and the vehicle will be subject to immediate removal. B. No person shall erect a reserved or handicapped parking sign upon the streets of the City of Shamokin without authority under this chapter from the City of Shamokin Handicapped Parking Committee. C. Any person violating any of the provisions of this chapter, shall be fined Fifty ($50.00) Dollars. I f said fine is not paid within ten (10) days after the date of violation, the fine upon conviction before a District Judge will be a minimum of Fifty ($50.00) Dollars and a maximum of Three Hundred ($300.00) Dollars, plus the costs of prosecution for each offense and, and/or imprisonment in the county jail for a period not exceeding ninety (90) days. Each and every day upon which any person violates or continues to violate the provisions of this chapter shall constitute a separate offense.
