MINUTES DES PERES BOARD OF ALDERMEN APRIL 27, 2009 7:00 PM DES PERES GOVERNMENT CENTER The regular Meeting of the Board of Aldermen of the City of Des Peres, Missouri was held at the Des Peres Government Center, 12325 Manchester Road commencing at 7:00 PM Monday, April 27, 2009. ROLL CALL The City Clerk took roll with the following members present: Mayor Lahr, Alderman Gmelich, Alderman Doering, Alderman Kleinschmidt, Alderman Raczkiewicz, and Alderman Pound. Alderman Fingerhut was absent with excuse. Staff members present include: City Administrator, City Clerk, City Attorney, Director of Public Works, Director of Public Safety, Director of Parks & Recreation and Finance Director. Mayor Lahr opened the meeting with the Pledge of Allegiance to the Flag. PUBLIC HEARINGS - None AMENDMENT OF AGENDA None CITIZEN COMMENTS AND PETITIONS Anna Ahrens, 923 Ridgetree Requested that she be considered to fill a vacancy on the Planning & Zoning Commission which she understands will become available June 30, 2009. Mayor Lahr advised Ms. Ahrens to submit her resume for Board consideration should an opening occur. Mayor Lahr asked if anyone in the audience had business before the Board; and hearing none closed the Public Comment session.

REPORTS OF OFFICERS AND COMMITTEES Board of Adjustment meeting of April 22, 2009 Unanimously approved a garage addition at 936 Dontaos. Board of Adjustment Resignation - Letter of resignation received from Ward 1 Alternate Member with an effective date of May 31, 2009. Certified Election Results April 7, 2009 Municipal Election - The City Clerk presented the Certificate of Election from St. Louis County Board of Election Commissioners certifying the following vote totals from the April 7, 2009 Municipal Election; Des Peres Registered Voters 6,866 Ballots Cast 750 Municipal Judge Charles Billings 636 99.97% Write In 6 0.93% Alderman, Ward 1 Kathleen M. Gmelich 231 51.45% Anna G. Ahrens 218 48.55% Write In 0 0.00% Alderman, Ward 2 Clifford Adkins 18 8.78% Jim Kleinschmidt 187 91.22% Write In 0 0.00% Alderman, Ward 3 James E. Doering 77 93.90% Write In 5 6.10% The City Clerk declared that Municipal Judge, Charles Billings, Alderman Kathleen M. Gmelich, Alderman Jim Kleinschmidt and Alderman James E. Doering have been reelected to a two-year term of office pursuant to the certified election results of the St. Louis County Board of Election Commissioners. CONSENT AGENDA Mayor Lahr advised that the consent agenda consisting of three (3) items, including an amended warrant list, can be approved by a single vote of the Board to include: 1. Approval of Minutes of the Board of Aldermen of April 13, 2009. 2. Approval of an Amended Warrant List dated April 27, 2009. 2

3. R09-1903 Approved a contract with Leritz Contracting, St. Louis, Missouri for Asphalt Street Resurfacing. Following discussion Alderman Gmelich moved, second by Alderman Raczkiewicz to approve all items on the Consent Agenda. A roll call vote was taken with the following results: Alderman Doering, Aye; Alderman Pound, Aye; Alderman Gmelich, Aye; Alderman Raczkiewicz, Aye; Alderman Kleinschmidt, Aye. Vote in favor being unanimous, motion carried 5-0. LEGISLATION Unfinished Business. Bill 09-2514 An Ordinance which Authorizes the City of Des Peres, Missouri to enter into a Lease Purchase Transaction, the proceeds of which will be used to pay the cost of refunding the Outstanding Certificates of Participation (City of Des Peres, Missouri Lessee), Series 2002; and to approve the Execution of Certain Documents and Actions in Connection Therewith First introduced April 13, 2009. Gives authority for refinancing 2002 COPS Bonds Mayor Lahr announced that Bill 2514 having received a favorable vote from a majority of the Board of Alderman stands approved and upon his signature will become Ordinance 2506 of the City of Des Peres. ADJOURMENT SINE DIE Alderman Raczkiewicz moved that the Board of Aldermen stand adjourned sine die at 7:10 PM, second by Alderman Kleinschmidt. A roll call vote was taken with the following results: Alderman Raczkiewicz, Aye; Alderman Gmelich, Aye; Alderman Kleinschmidt, Aye; Alderman Doering, Aye; Alderman Pound, Aye. MINUTES DES PERES BOARD OF ALDERMEN APRIL 27, 2009 7:00 PM DES PERES GOVERNMENT CENTER The meeting of the newly elected Board of Aldermen of the City of Des Peres, Missouri held at the Des Peres Government Center, 12325 Manchester Road Was reconvened at 7:11 PM Monday, April 27, 2009. OATH OF OFFICE The City Clerk administered the Oath of Office to the following newly elected officials: Alderman Gmelich Ward 1 Alderman Kleinschmidt Ward 2 Alderman Doering Ward 3 Mayor Lahr advised that the Board pursuant to Rule has sixty (60) days from the date of the election to meet as a committee of the whole for the purpose of electing a President of the Board of Alderman and to make Board assignments. ROLL CALL The City Clerk took roll with the following members present: Mayor Lahr, Alderman Gmelich, Alderman Doering, Alderman Kleinschmidt, Alderman Raczkiewicz, and Alderman Pound. Alderman Fingerhut was absent with excuse. Staff members present include: City Administrator, City Clerk, City Attorney, Director of Public Works, Director of Public Safety, Director of Parks & Recreation and Finance Director. Mayor Lahr recognized two boy scouts, Alex Bernard and Thomas Weissert both of Troop 685 St. Gerard Magellan who monitored the meeting as they work toward their Eagle Scout badges. LEGISLATION New Business Bill 09-2516 An Ordinance Approving Enhancements to Des Peres Corners and Approving Final Amendments to the Master Development Plan for Des Peres to Incorporate Those Enhancements into the Final Plan. 4

Allocation of Enhancement Funds established in Ordinance 2503, Sec 5 (March 9, 2009) is set forth in this ordinance and Board approval is given by enactment of same. i.e. $92,000. for Construction of a retaining wall along a portion of Ballas Pond Drive with related landscaping; Construction of a retaining wall along the retail building along Ballas Road with related landscaping; Sidewalk and curb replacement along Manchester Road fronting 12304 Manchester Road ; Additional landscaping adjoining the Public Safety Building and within areas of the new retaining walls; $58,000. to be used by the city to fund a portion of the costs for safety improvements to the Public Safety Building including construction of an enclosed sally port. Alderman Pound introduced Bill 2516 and gave first reading. Members of the audience asked if they could speak regarding Bill 2516. Mayor Lahr agreed to allow public comment. Kareen White, 958 Blasé Ave Question: Who is paying for the enhancements? Answer: The $150,000. Enhancement fund was established by Summit Development and came as a result of a revised Master Development Plan which called for elimination of the bridge walkway between two buildings on Lot A of the Des Peres Corners Development. Jamie Spencer, 923 Ridgetree Question: Do the enhancements include landscaping along Manchester Road? Answer: Landscaping enhancements are focued along the residential side of the project (southern border of project). Significant landscaping was already factored into the original landscaping plan along Manchester Road. Robert Ashcraft, 1543 Fawnvalley Drive - Alderman Pound presented Mr. Ashcraft s question inasmuch as he was not available to attend this evenings meeting. Question: Buildings located along Ballas. Are the doors going to be painted to compliment the brick façade. Answer: Yes Alderman Pound - asked the Summit Representative, Bill Pieck if the new landscaping along Ballas Road and Ballas Pond Drive would have an irrigation system installed. Answer: Yes Alderman Gmelich - asked about water runoff from the site. Bill Pieck, Summit Development advised that Summits Civil Engineers have prepared calculations which show a 77% post-development reduction in runoff over pre-development. Calculations were submitted for the record. After discussion Alderman Pound moved to waive the rules to allow for second reading on the night of introduction. Second by Alderman Gmelich. A roll call vote was taken with the following results: Alderman Doering, Aye; Alderman Kleinschmidt, Aye; 5

Alderman Raczkiewicz, Aye; Alderman Pound, Aye; Alderman Gmelich, Aye. Vote in favor being unanimous, motion carried 5-0. Alderman Pound gave Bill 2516 second reading and moved for approval. Second by Alderman Gmelich. A roll call vote was taken with the following results: Alderman Doering, Aye; Alderman Kleinschmidt, Aye; Alderman Raczkiewicz, Aye; Alderman Pound, Aye; Alderman Gmelich, Aye. Vote in favor being unanimous, motion carried 5-0. Mayor Lahr announced that Bill 2516 having received a favorable vote from a majority of the Board of Alderman stands approved and upon his signature will become Ordinance 2507 of the City of Des Peres. REPORTS OF STAFF The City Administrator reported that the Department of Public Safety would be submitting a grant application to the Missouri Department of Highway Safety for 100% funding for the reimbursement of special patrols on Manchester Road for hazardous transportation and DWI violations. Each grant is worth $1,000. ADJOURMENT There being no further business to come before the newly seated Board of Aldermen, Alderman Raczkiewicz moved to adjourn. Second by Alderman Gmelich.
