BEFORE THE POLICE BOARD OF THE CITY OF CHICAGO IN THE MATTER OF CHARGES FILED AGAINST POLICE OFFICER WILLIAM ROBERISON, STAR # ) NO. 02-2486 17949,DEPARTMENT OF POLICE, CITY OF CHICAGO) CR#263984 FINDINGS & DECISION On January 8, 2002, the Superintendent of Police filed charges with the Police Board of the City of Chicago against Police Officer William Roberison, Star #17949, (hereinafter sometimes referred to as "Respondent") seeking the discharge of the Respondent for violating the following Rules: Rule 2: Any action or conduct which impedes the Department's efforts to achieve its Policy and goals or brings discredit upon the Department. Rule 6: Disobedience of an order or directive, whether written or oral. Rule 8: Disrespect to or maltreatment of any person, while on or off duty. Rule 9: Engaging in any unjustified verbal or physical altercation with any person, while on or off duty. Rule 14: Making a false report, whether written or oral. Rule 37: Failure of a member, whether on or off duty, to correctly identify himself by giving his name, rank, and star number when so requested by other members of the Department or by a private citizen. The Police Board of the City of Chicago caused a hearing on these charges against Police Officer William Roberison to be had before Michael G. Berland, Hearing Officer of the Police Board of the City of Chicago, on April 17, 2002. Following the hearing, the members of the Police Board read and reviewed the certified transcription of the proceedings of 1

the hearing. Michael G. Berland, Hearing Officer, made an oral report and conferred with the Police Board before it rendered a decision. The Police Board of the City of Chicago, as a result of its investigation of the charges, finds and determines that: 1. The Respondent was at all times a police officer employed by the Department of Police of the City of Chicago. 2. The charges were filed in writing and a Notice, stating the time, date and place, when and where a hearing of the charges was to be held, together with a copy of the original charges, was served upon the Respondent more than thirty (30) days prior to the hearing on the charges. 3. The hearing was conducted before Michael G. Berland, Hearing Officer of the Police Board of the City of Chicago, on April 17, 2002. 4. Throughout the hearing the Respondent did appear in person and represented himself. 5. The Respondent Police Officer William Roberison, Star 17949, charged herein, contrary to the Rules and Regulations, is not Rule 2:Any action or conduct which impedes the Department's efforts to achieve its policy and goals or brings discredit upon the Department. A. On or about July 15, 2001, at or near 2111 S. Clark, Police Officer William Roberison, while off duty, did not bring discredit upon the Department by failing to fully cooperate with Police Officers Thomas Bailey and Phyllis Little by pulling away from investigating officers.

The Respondent Police Officer William Roberison, Star 17949, charged herein, contrary to the Rules and Regulations, is Rule 2: Any action or conduct which impedes the Department's efforts to achieve its policy and goals or brings discredit upon the Department. A. On or about July 15, 2000, at or near 2111 S. Clark, Police Officer William Roberison, while off duty, brought discredit upon the Department and impeded the Department's efforts to achieve its policy and goals, when he failed to immediately and properly identify himself as a police officer and/or failed to answer questions regarding his identity as a police officer. B. On or about July 15, 2000, at or near 2111 S. Clark, while off duty, Police Officer William Roberison brought discredit upon the Department and impeded the Department's efforts to achieve its policy and goals in that he failed to carry his weapon in a Department prescribed holster. C. On or about July 15, 2000, at or near 2111 S. Clark, Police Officer William Roberison, while off duty, brought discredit upon the Department and impeded the Department's effort to achieve its policy and goals in that he verbally abused Police Officers Thomas Bailey and Phyllis Little. 7. The Respondent Police Officer William Roberison, Star 17949, charged herein, contrary to the Rules and Regulations, is Rule 6: Disobedience of an order or directive, whether written or oral. 3

A. On or about July 15, 2000, at or near 2111 S. Clark, Police Officer William Roberison, while off duty, disobeyed an order or directive, whether written or oral, in that he failed to carry his weapon in a Department prescribed holster, in violation of General Order 92-03, Section 1V, Paragraph C. 8. The Respondent Police Officer William Roberison, Star 17949, charged herein, contrary to the Rules and Regulations, is Rule 8: Disrespect to or maltreatment of any person, while on or off duty. A. On or about July 15, 2000, at or near 2111 S. Clark, Police Officer William Roberison, while off duty, mistreated and/or disrespected Police Officers Thomas Bailey and Phyllis Little, in that he verbally abused them by directing profanities at them. 9. The Respondent Police Officer William Roberison, Star #17949, charged herein, contrary to the Rules and Regulations, is Rule 9: Engaging in any unjustified verbal or physical altercation with any person, while on or off duty. A. On or about July 15, 2000, at or near 2111 S. Clark, Police Officer William Roberison, while off duty, engaged in an unjustified verbal and/or physical altercation when he directed profanities at Police Officers Thomas Bailey and Phyllis Little. 10. The Respondent Police Officer William Roberison, Star #17949, charged herein, contrary to the Rules and Regulations, is 4

Rule 14: Making a false report, whether written or oral. A. On or about May 15, 2001, or on some other date, Police Officer William Roberison made a false report to the Office of Professional Standards when he made false allegations against Police Officers Thomas Bailey and Phyllis Little. 11. The Respondent Police Officer William Roberison, Star #17949, charged herein, contrary to the Rules and Regulations, is Rule 37: Failure of a member, whether on or off duty, to correctly identify himself by giving his name, rank, and star number when so requested by other members of the Department or by a private citizen. A. On or about July 15, 2000, at or near 2111 S. Clark, Police Officer William Roberison, while off duty failed to properly identify himself to Police Officers Thomas Bailey and Phyllis Little. 12. The Police Board recommends that Police Officer William Roberison immediately be given a physical and psychological examination and that he not be returned to active duty until such time as he can successfully can pass both examinations. The Police Board further recommends that Officer Roberison's right to carry a weapon be suspended until such time (if ever) that he be restored to active duty. By reason of the fact that Police Officer William Roberison is guilty of violating Rules 2, 6, 8, 9, 14 and 37 cause exists for the suspension of Respondent Police Officer William Roberison from his position as a Police Officer from the Department of Police and from the services of the City of Chicago from January 5

DECISION The members of the Police Board, having read and reviewed the certified copy of the transcription of the hearing, having received the oral report of the Hearing Officer, Michael G. Berland, and having conferred with the Hearing Officer regarding the evidence and the credibility of the witnesses, and in reaching its decision as to the penally imposed, the Board took into consideration both the facts of the case and also Respondent's complimentary and disciplinary record, (a copy of which is attached as Exhibit A) IT IS HEREBY ORDERED that by reason of the fact that Police Officer William Roberison is guilty of violating Rules 2, 6, 8, 9, 14 and 37 cause exists for the suspension of Respondent Police Officer William Roberison from his position as a Police Officer from the Department of Police and from the services of the City of Chicago from January 9, 2002 to and including February 7, 2002 with restoration of all rights and benefits thereafter.the Police Board recommends that Police Officer William Roberison immediately be given a physical and psychological examination and that he not be returned to active duty until such time as he can successfully can pass both examinations. The Police Board further recommends that Officer Roberison's right to carry a weapon be suspended until such time (if ever) that he be restored to active duty.
