In the past the Town of Manchester has grouped the mowing and landscaping contracts together. However, the Select Board chose to separate them going forward. If you are interested in bidding you must submit three separate bids but you do not have to bid on all of the projects. You may bid on one, two or all three. Please be aware that the Town is treating these as three separate contracts and may award bids to multiple contractors. INSURANCE All bidders must submit, with their bid, certificates of insurance showing Umbrella Coverage for all exposures in the amount of one million dollars ($1,000,000.00), with basic coverage for Contractor s general liability, personal injury, property damage, worker s compensation, products/completed operations and automobile hazards. AMENDMENT, SEVERABILITY, and JURISDICTION This agreement can be amended at any time only by a writing duly executed by both parties. This agreement is governed by the laws of the State of Maine. If any provision or portion thereof, contained in this agreement is held to be unconstitutional, invalid, or unenforceable, the remainder of this Agreement will not be affected and will remain in full force and effect. TERMINATION Either party may terminate this Agreement for cause after giving the other party written notice and an opportunity to cure. The Town may terminate without cause by giving the Contractor 14 days notice, and compensating the Contractor equitably to the termination date. ENTIRE AGREEMENT This Agreement represents and contains the entire agreement between the parties. Prior discussions or verbal representations by the parties that are not contained in this Agreement are not a part of this Agreement.
COMPLETION All work must be completed by July 31, 2019. TERMS Work shall commence July 1, 2019 or after. The Contractor shall bill the Town of Manchester in one installment and payment will be made within fourteen (14) days of receipt of invoice. HOLD HARMLESS CLAUSE The Contractor shall hold the Town harmless from any claim of damages of every kind and nature whatsoever, including court costs and attorneys fees, arising from, out of, or incidental to, any claim under this contract, or connected herewith, which shall be made against the Town of Manchester. QUALITY OF WORK All work performed under this contract shall be performed in a workmanlike manner to the highest standards of the trade. The Contractor agrees to provide all necessary materials and labor to complete the work described herein. The Contractor further agrees to abide by all applicable laws, ordinances and codes. CONTRACT SPECIFICATIONS Work areas shall include: 1) Remove the large shrubs from all corners of the Town Office building plus the two on either side of the employee entrance total of 6 shrubs in all. The Town is open to either digging them up and removing them or cutting them down to the ground so they don t grow back, which ever option is most affordable. No replanting at this time. Mulch if necessary. 2) Cut down and remove the mess of intermingled shrubs and trees beside the Conex storage box on the back side of the building between the Town Office and Rite Aid. Once the debris is removed the area must be leveled and seeded over for grass. 3) Dig up the 4 crab apple trees in the circle area. Wrap them so that they can be given away to residents rather than discarding them. The area must be leveled and seeded over for grass. Area must be left presentable and to the satisfaction of the Town Manager. 4) Plant one large fir tree (8-10 feet) in the area where the other fir trees are planted. Exact location to be determined. Area must be left presentable and to the satisfaction of the Town Manager. 5) Remove the current shrubs and weeds by the two Welcome to Manchester signs (one by the Cat Hospital and one by the Country Club). Clean up and replant with low maintenance, drought tolerant material. Mulch if necessary.

The parties may mutually agree to extend this Contract for up to one (1) additional year under all the terms and conditions of this contract.
