Jefferson County Commissioner Meeting Minutes February 13, 2012 Meeting called to order at 9:00 am. Those present are Chairman Karren, Commissioner Hegsted, Commissioner Raymond, and Bruce Anderson. Emily Kramer is clerk of the board. Bruce Anderson gave the Pledge of Allegiance and Commissioner Raymond gave the prayer. Carlos Apointe Document Signature Commissioner Hegsted signs the Blue Cross Plan Documents. Public Works Jim Boulter Great Feeder In the traffic study conducted in the month of January, Jim found that 1,216 vehicles (1,214 cars and 2 trucks) crossed the great feeder. Jim discusses the specifications needed for public access on the existing structure. The great feeder is eleven feet wide right now and Jim thinks you would only widen it 30 inches with pouring concrete for a retaining wall on the backside. Jim suggests putting up some no truck signage on either side of the great feeder. Brent Thomas asks if core samples would be needed if we openly agree that it will be used as a public crossing. The Commissioners asks if the county participates will we be liable and without stopping traffic are will liable. The Commissioners ask Chris to check with ICRMP on liability and for Brent to discuss this with the Great Feeder. Willard Price Extension of Courthouse Way Willard is present to request an extension on the courthouse way extension. Chairman Karren asks if the extension was supposed to be done years ago. Commissioner Hegsted asks where Willard stands with the City of Rigby. Willard explains that the City of Rigby has allocated until 2015 to complete the extension of courthouse way and asks for the county to concur. Willard explains that he has filled his obligation to the City of Rigby in full. Willard discusses the historical background of the development and he mentions that he promised to finish the road to prevent the County from relocating the courthouse. Willard s intent is to finish the road, but is requesting an extension to complete the road. Chairman Karren suggests that they look over the agreement and discuss it with legal counsel. The Commissioners will discuss the court date with their attorney and will let Willard know. Treasurer Kristine Lund & Assessor Cody Taylor Tax Cancellation Don Harris called Kristine in reference to his 2011 transient property bill because the amount was higher than last year. Kristine explains that she checked with Cody and they found out that he filled out his declaration backwards so a higher number was entered for our county. Motion by Commissioner Raymond to cancel $208.67 of the taxes for 2011 on parcel no. TP000000000106 in the name of Don Harris. Second by Commissioner Hegsted. Roll call taken. Probation Tammy Adkins Wrap Around Agreement Tammy distributes the wrap around agreement for signature. Tammy explains that wrap around is a program that wraps services around juveniles. Health and Welfare is the clinical oversight for the program which is who the agreement is with. JJSUDS MOU Tammy explains that we have started to use the JJSUDs dollars and a memorandum of understanding will allow the assessment person to enter the data into the WITs database. Tammy has been asked to sign the MOU and wanted to let the Commissioners know. Tammy mentions that two people from our county are graduating from mental health court on March 7 th and Eric was wondering a one of the commissioners would speak. Chairman Karren and Commissioner Raymond both are available to attend. YAC Court Tammy distributes a packet of information on the YAC Court. Tammy explains that in 2009, as a district they started talking about the 18 24 year old population. All drug courts were asked to put together a report. Bonneville County was the only drug court that reported. Tammy explains that there are a number of 18 24 year olds who are running from drug court. The report shows statistics. The report started the discussion on the problem with the difficult population. During that time, Tammy started developing a program to target the population separately, but it got tabled in an implementation meeting. In October of 2011, the Juvenile Probation Director in Bonneville County approached Tammy and told her that they were interested in moving forward in the program. They started holding meetings. Tammy explains that they were looking at starting the program in Jefferson County and then during a wash later. It was determined that JJSUDS money could not be used for the court so they started to discuss moving it under the drug court governing board. Tammy approached Madison and Fremont County and Ryan Brown agreed to be a part of it. However, at the governing board meeting the upper valley counties felt that they did not have enough information to make a decision. Tammy explains that if Jefferson County has a drug court, Bonneville County has offered to let us fall under their umbrella if we want. February 17 th is the next meeting to see if upper valley counties are interested or not. Bonneville County started their court on February 6 th. Chris mentions that Fremont County is concerned with the rush. Commissioner Raymond says that the commissioners did not see this program coming because they had no governing board meeting since August. Tammy explains that at the implementation meetings this was all discussed. Tammy mentions that she discussed it with the Sheriff and he s on board with transportation. Judge Crowley was disappointed that we may not get the court, but he will not be involved if Upper Valley does not come on board. Paul Ziel supports the court. If we go to Bonneville County, we will be able to keep our fees here. In four years, we have made seven referrals to drug court which will have a small impact on drug court. Tammy feels we have a need and we need a yes or a no from Upper Valley on Friday. Tammy mentions she has five people ready to start the program. Tammy asks if the Commissioners are okay with Jefferson County participating with Bonneville County if Upper Valley does not participate or puts the program on hold. Chris mentions finances are okay. County for the betterment of our people and when or if the upper valley counties decide to participate we will reevaluate. Social Services Edidt Ramirez Executive Session 67-2345(D) Motion by Commissioner Hegsted to go into executive session at 11:09 am pursuant to Idaho Code 67-2345(D). Second by Commissioner Raymond. Roll call taken. Commissioner Hegsted Moved back into open session at 11:33 am. Motion by Commissioner Raymond to deny #2012-30 for nonresidency, to approve #2012-31, to deny #2012-33 for lack of information, to approve #2012-34, to deny #2012-35 for nonresidency, and to deny #2012-05 for ability to pay. Second by Commissioner Hegsted. Roll call taken. Commissioner Hegsted aye. Commissioner Raymond aye. Chairman Karren aye. Motion passed unanimously. Commissioners sign a notice of lien and application for medically indigent benefits for applicant numbers 2012-41, 2012-42, 2012-40, 2012-39, 2012-38, 2012-37, and 2012-36. Lunch Planning & Zoning Naysha Foster Discussion of Building Permits Naysha explains that an issue came up on how long they need to keep building permits and other documents that they have been retaining. Discussion on a retention schedule is held. Commissioners ask Naysha to have Robin review the draft record retention resolution and to discuss it at the next department head meeting. Discussion of New Rigby Impact Area The City of Rigby is ready to move forward with the map and the agreement. Naysha distributes the current map and the proposed impact map for the Commissioners review. If the Commissioners have no questions or concerns the City Planning and Zoning would recommend adoption to the City. Commissioner Hegsted asks what happens by placing a parcel in the City of Rigby s impact area. Naysha says she cannot answer that until the City comes in and works out an agreement expressing the way they want to grow. Retention Schedule Discussed under the discussion of building permits. HVAC Inspections Building Department Jim Lynch, Jeff Geisler Jim thinks the building department is a service and with that service a goal is a campaign of education. Jim introduces Ron Larsen who was the State HVAC Inspector. Jim mentions that the state is still doing it with a plumbing inspector who is certified for HVAC. breaks down you are taking it to a lawn mower repair guy. Ron mentions that they have hired a code specialist who was a roofing contractor who likes to read the code book. Ron does not want codes which he started to enforce left go. Ron mentions that fire dampers needs to be inspected. Jim mentions that they are hear today to get guidance from the board. Chairman Karren asks Chris what she found out on liability. Chris mentions if you add HVAC to Jim s job description then it is covered by ICRMP, but if done by a contractor the contractor needs to have liability insurance. Ron mentions that personal liability is enough because you can t assume liability for a jurisdiction. Ron mentions that jurisdictions are going to start doing inspections themselves. Jim mentions the three options are to leave the state doing it, contract with a contractor, or get certified to do it ourselves. Robin mentions that by training building inspectors in HVAC and getting them licensed that is a great option or just continuing with the state. Robin says the independent contractor would be more costly. Commissioner Hegsted asks if Ron Larsen has checked into the insurance. Ron says yes it looks like it would be around 1,000 a month. Chairman Karren asks would training our guys be the same as using an experienced inspector. Commissioner Raymond asks if Ron has a current license. Commissioner Hegsted would be in favor of going with an independent inspector at this time rather than educating our people with the amount of construction going on and then developing into educating our people to do HVAC inspections down the road. Commissioner Raymond agrees with that and has a question if it would be possible for people to mentor with Ron Larsen. Ron says yes. The Commissioners ask Jim to proceed in that direction. Clerk Christine Boulter Certificates of Residency Commissioners sign the certificates of residency. Signature Weed Department Forest Service MOU Commissioners sign a memorandum of understanding with the forest service and the weed department. The Commissioners ask Chris to draft a letter to the Veterans Memorial Hospital to obtain a financial accounting for fiscal year 2011. Sheriff Blair Olsen Safe Haven and BHC4 The Sheriff mentions that they have had some issues dealing with BHC because of transporting. Deputies have to take people first to EIRMC for an evaluation before admittance. The process normally takes them about three hours. The Sheriff mentions that Safe Haven is in Pocatello which would be farther. He explains that he cannot house people with mental health issues or protective custody issues. The Sheriff feels with the upfront costs we would be better staying where we are at. In the last year and a half, they have only had two protective custody incidents. Commissioner Raymond mentions that they were considering Safe Haven as an alternative if BHC is full. The Sheriff agrees that alternate would be beneficial. Commissioner Hegsted Moved back into open session at 2:32 pm Discussion held on discrimination. BLM Jeremy Casterson, Dan Kotansky Lorenzo Boat Access Jeremy mentions that they have to relocate the old Lorenzo boat access site because of the Highway 20 corridor plan. He explains that the BLM purchased land to move the access to a more suitable location. Proposed plans are displayed and he mentions that the public is invited to comment at this time. Jeremy explains that neighboring landowners have been contacted and that they hope to start on the project this fall. The new site will hopefully be open for public use in 2013. Dan mentions the problems with getting off the highway, the safety issue, and the poor hydrology at the old site. In the new plan, the road crosses the levy and there will be a gate on both sides so no one sits on the levy with their vehicle. A parking lot will be available for north access. Claims Motion by Commissioner Hegsted to approve the claims dated January 20 through February 10, 2012 to total $1,059,166.67. Second by Commissioner Raymond. Roll call taken. The claims included the yearly courthouse payment, sheriff s emergency communications, and diesel fuel. Community Review Idaho Rural Partnership Cancelled. Tailgating Meeting Commissioners have an ICRMP tailgating meeting on driving. Airport Landfill Use Fee Commissioners, Kristine Lund, Cody Taylor Kristine explains that John Anderson came in about the landfill use fee and mentioned that the city does not pay a fee. Kristine mentions the purpose of the meeting is to get on the same page. Discussion held on the process. The Commissioners discuss that the landfill use fee is an access fee and the airport has access to the landfill. The Commissioners plan on revisiting the fee structure.
