ALBERTO, SK Chairman ORDINANCE NO. 02, s-2011 AN ORDINANCE PRESCRIBING THE RATES OF TAXES, FEES AND CHARGES IMPOSED BY BARANGAY STA. CRUZ, QUEZON CITY. WHEREAS, Section 152 in relation to Section 186 of Republic Act 7160, otherwise known as Local Government Code of 1991, vested to every local government including Barangays, the power to create its own sources of revenue and to levy taxes, fees and other charges which shall accrue to the local government unit concerned; WHEREAS, the Sangguniang Barangay, as the legislative body of the Barangay, shall have the power to enact measures as may be necessary to discharge the responsibilities conferred upon it by law or ordinance and to promote the general welfare of the inhabitants therein; WHEREAS, taxes, fees and other charges imposed by the barangay served as the lifeblood of the barangay in delivering the basic services to its constituents; WHEREAS, there are official activities of the barangay which are urgently required to meet the exigencies of delivering basic services to the community and such activities require funds in order for its objectives to be attained; WHEREAS, to augment the limited fund allocation in the barangay budget, as well as to finance various activities of the barangay, which are vital and considered part and parcel of good community service, there is an imperative need to collect taxes, fees and charges; WHEREAS, there is a need to enact revenue ordinance in order to apprise its constituents of the proper rates of taxes, fees and charges imposed by barangay Sta. Cruz; NOW, THEREFORE, BE IT ORDAINED, as it is hereby ordained by the Barangay Council in session assembled, to prescribe, as it does prescribe the rates, fees and charges imposed by Barangay Sta. Cruz; Section 1. This ordinance shall govern the exercise of taxing and other revenue raising power of this Barangay; 1 P a g e o f 5 _ r e v e n u e o r d i n a n c e

Section 2. The fees to be collected by this Barangay shall be in accordance with the duly approved Quezon City Ordinance No. SP-1923, Series of 2009, otherwise known as An Ordinance Amending Sections 1, 2 and 3 of Ordinance No. SP 1234-S2003 which imposes a ceiling fee for the issuance of Barangay Clearance within Quezon City; Section 3. The Barangay Treasurer shall issue the corresponding receipt to the payor and shall be responsible for the recording and accounting of all collections which in turn will be deposited in the bank account of the barangay. The same shall be considered as part of the barangay income for a given fiscal year. Section 4. COVERAGE: As used in this ordinance, the following terms shall be understood, applied and construed to read as follows; A. Barangay Clearance Fee the following annual fee shall be collected by the Barangay for the issuance of barangay Clearance pursuant to Sec. 152 of the of Republic Act 7160 for the following activities; I. TIME OF PAYMENT: Unless otherwise, provided, all taxes, charges and other impositions shall be paid on or before January 25, for every year. Section 6. SEPARABILITY CLAUSE: If any clause, sentence, paragraph or part of this Ordinance shall be adjudged by the Sangguniang Panglungsod to be invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance, but shall be confined in its operations to the clause, sentence, paragraph, or part thereof directly involved in the controversy. Section 7. REPEALING CLAUSE: All barangay ordinances, rules, regulations in conflicts or inconsistent with any provision of this ordinance are hereby deemed repealed or modified accordingly. Section 8. EFFECTIVITY: This Barangay Revenue Ordinance shall take effect immediately after its review by the Sangguniang Panglungsod.
