ORDINANCE NO. 1309 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF DRAPER CITY FOR APPROXIMATELY 5.8 ACRES OF PROPERTY FROM CC (COMMUNITY COMMERCIAL) TO RM2 (RESIDENTIAL HIGH DENSITY), AND APPROVING THE MASTER DEVELOPMENT AGREEMENT FOR ROCKWELL PARK DEVELOPMENT LOCATED AT APPROXIMATELY 258 EAST 13800 SOUTH WITHIN DRAPER CITY WHEREAS, pursuant to State law, Draper City has adopted a Zoning Ordinance and Zoning Map to guide the orderly development and use of property within the City; and WHEREAS, from time to time it is necessary to review and amend the Zoning Map to keep pace with development within the City and to ensure the provision of a variety of economic uses; and WHEREAS, the proposed zone change set forth herein has been reviewed by the Planning Commission and the City Council, and all appropriate public hearings have been held in accordance with Utah law to obtain public input regarding the proposed revisions to the Zoning Map; and WHEREAS, the Planning Commission has reviewed and made a recommendation to the City Council concerning the proposed amendment to the official Zoning Map of Draper City, and the City Council has found the proposed zone change to be consistent with the City's General Plan. WHEREAS, the City Council hereby determines that it will be in the best interest of the City to allow development of the subject property in accordance with the Development Agreement; and WHEREAS, the Development Agreement will allow for a defined number of units, density of the property, site design criteria and a development standard. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF DRAPER CITY, STATE OF UTAH: Section 1. Zoning Map Amendment. The following described real property located at approximately 258 E. 13800 South within Draper City, Salt Lake County, State of Utah, previously zoned CC as shown on the Draper City Zoning Map, as depicted in Exhibit "A" hereto, are hereby changed and rezoned to RM2: Beginning at a point on the West bounds of Wheadon Preserve Subdivision Book 2011, Page 2; which point lies 243.86 feet West and 353.91 feet South 00 02' 15" East from a Brass cap Road Monument located at 13800 South, and 300 East as utilized on this survey, Said monument has been accepted as the Center of Section 6, Township 4 South,
Range 1 East, Salt Lake Base and Meridian, in some surveys and records as recorded. Thence along said Wheadon Preserve Sub the following 3 courses: South 00 02' 15" East, a distance of 3.90 feet; & South 00 26' 07" West, a distance of 438.59 feet; & South 89 24' 34" East, a distance of 246.98 feet; thence South, a distance of 260.05 feet; then West, a distance of 502.00 feet; thence North, a distance of 261.00 feet; thence West, a distance of 8.50 feet; thence North, a distance of 246.41 feet to a point of curve of a non tangent curve to the right, of which the radius point lies North 21 57'08" East, a radial distance of 49.50 feet; thence northwesterly along the arc, through a central angle of 36 29'05", a distance of 31.52 feet to a point of reverse curve to the left having a radius of 9.00 feet and a central angle of 58 25' 51 "; thence northwesterly along the arc, a distance of 9.18 feet; thence North, a distance of 38.58 feet to the point of curve of a non tangent to the left, of which the radius point lies North 00 00' 23" West, a radial distance of 9.00 feet; thence northeasterly along the arc, through a central angle of 58 25' 51 ", a distance of 9.18 feet to a point of reverse curve to the right having a radius of 49.50 feet and a central angle of 40 03 '57"; then northeasterly along the arc, a distance of 34.61 feet; thence North 00 57'29" West, a distance of 146.19 feet; thence North 89 54' 32" East, a distance of 50.68 feet; thence South, a distance of 36.81 feet; thence East, a distance 215. 72 feet to the point of beginning. Containing 252,516 square feet or 5.80 acres more or less. Section 2. Development Ae:reement. The City of Draper approves the Development Agreement provided in Exhibit B, otherwise known as the Master Development Agreement for Rockwell Park. Section 3. Severability Clause. If any part or provision of this Ordinance is held invalid or unenforceable, such invalidity or unenforceability shall not affect any other portion of this Ordinance and all provisions, clauses and words of this Ordinance shall be severable. Section 4. Effective Date. This Ordinance shall become effective immediately upon publication or posting, and the recording of the Development Agreement, which recording shall take place within 30 days of final passage.
