Dear Member, As per the Article 27.8(a) of the Articles of Association of the Council, the Elections to the Committee of Administration for the term 2017-19 shall be held for the below mentioned Panel / Group of Panels as well as for all Regional Chairmen and for the Vice Chairman. As per the Election Rule 4.2(n) and Article 27.7 (a3) of the Articles of Association, where an elected member of the Committee has served continuously for 6 [six] years, such elected member shall be deemed to be retired and shall not be eligible for re-election or re-appointment to the Committee whether as Panel Member or Regional Chairman or Vice Chairman or Chairman for a period of two years immediately after completion of such six years. As per Election rule 4.2(m) and Article 21.1(c) of the Articles of Association, Ordinary Member who has served as a Regional Chairman for 3 (three) continuous terms of 2(two) years each, shall not be eligible for re-election or re-appointment as a Regional Chairman or as a member of a Panel of the Committee or Vice Chairman or Chairman at the next election for the subsequent term of two years. 1 P a g e

Please be informed that for the purpose of Elections, the Panels & Regions have been grouped based on the provisions of the Elections Rules and the Articles of Association (AoA), and the said groups of Panels & Regions are as follows: GROUP OF PANELS: Sr. Groups No 1 Diamond Panel 2 3 4 Gold Jewellery Panel & Other Precious Metal Jewellery Panel Coloured Gem Stones Panel and Pearls Panel Synthetic Stones / Costume Fashion Jewellery & Sales to Foreign Tourist Panel No of Seats 8 seats (including 4 seats from the category of EH/TH/STH/SSTH) 4 seats (including 2 seats from the category of EH/TH/STH/SSTH & 1 seat from SEZ) 2 seats 1 seat 5 Silver Jewellery Panel 1 seat In addition to the above group of panels, the following shall be the elected office bearers in the Committee; A. Regional Chairman: 6 seats (one office bearer for each region) 2 P a g e B. Chairman : 1 seat C. Vice Chairman : 1 seat In addition, one Seat shall be reserved for a representative of MSME, as required under Article 27.4 (a) of the Articles of Association, on rotation basis to be decided by way of draw of lots in each of the above group of panels. 2. VACANCIES OF PANELS AND REGIONS FOR THE PERIOD 2017-19: Pursuant to the results of Drawing of Lot conducted on 28 th July 2017 and based on the election rules & AoA, the Elections to the Committee of Administration of GJEPC for the term 2017-19 shall be held for the below mentioned Panel / Group of Panels: 2.1 : PANELS SR. NO. 1:- DIAMOND PANEL: The Group A (Diamond Panel) consists of total 8 (eight) seats (including 4 seats from the Reserved category of EH/SEH/TH/STH/PTH. In pursuance to the provisions of AoA & Election Rule para 4.2(n), the following Diamond panel members shall retire, being served as the longest in office and will not be eligible to file nomination for the year 2017-19; < Shri Ajesh Mehta - Diamond Panel General Category Shri Nirav Bhansali - Diamond Panel General Category Shri Saunak Parikh - Diamond Panel - EH/TH/STH Category

In view of the above, 2 seats in General Category and 1 seat in Export House category stands vacant in the Diamond Panel in the elections for COA for 2017-19. SR. NO. 2:- GOLD JEWELLERY PANEL AND OTHER PRECIOUS METAL JEWELLERY PANEL: The Group B (Gold Jewellery Panel and Other Precious Metal Jewellery Panel) consists of 4 seats (including 2 seats from category of EH/SEH/TH/STH/PTH and 1 seat from Special Economic Zone). Pursuant to the results of Drawing of Lot conducted on 28 th July 2017 the below member from Gold Jewellery panel is declared retired and but will be re-eligible for fling the nomination for the term 2017-19 based on the Election rules & AoA, Shri Mansukh Kothari (GJ & OPMJ Panel) - General Category In view of the above, 1 seat in General Category stands vacant in the GJ & OPMJ Panel Group in the elections for COA for 2017-19. SR. NO. 4 :- SYNTHETIC STONES/ COSTUME FASHION JEWELLERY AND SALES TO FOREIGN TOURIST PANEL: The Group D (Synthetic Stones/ Costume Fashion Jewellery and Sales to Foreign Tourist Panel) consists of 1 seat in General Category. Pursuant to the results of Drawing of Lot conducted on 28 th July 2017 the below member from SFT/ CFJ/ SYS Panel is declared retired and will be re-eligible for fling the nomination for 2017-19 based on the election rules & AoA. Shri Jitendra Rakyan - CFJ, SFT & SYS Panel General Category In view of the above, 1 seat in General Category stands vacant in the CFJ/SFT/SYS Panel Group in the elections for COA for 2017-19. SR. NO. 5 :- SILVER JEWELLERY PANEL: The Group D (Silver Jewellery Panel) consists of 1 seat in General Category. Pursuant to the results of Drawing of Lot conducted on 28th July 2017 the below member from Silver Jewellery Panel is declared retired: Shri Ram Babu Gupta- Silver Jewellery Panel Based on para 2(c)(a) of the election rules and results of draw of lots held on 28 th July 2017 the reservation of MSME seat for 2017-19 will be in the Silver Jewellery Panel. 3 P a g e

In view of the above, 1 seat in General Category stands vacant in the Silver Jewellery Panel and will be reserved for MSME Category in the elections for COA for 2017-19. Pursuant to the Article 27.7 of the Articles of Association according to which where any seat reserved for EH/TH/STH/SSTH and MSME can not be filled up by a candidate of that reserved category that seat shall be deemed to be unreserved, fresh opportunity for filing of Nomination form will not be given to the candidates of the non-reserved category. 2.2 :- REGIONAL CHAIRMAN - 6 (six) - one from each of the following Regions) As per Rule No. 7.3(b) of the Election rules, Regional Chairman shall be elected for a term of 2 [two] years. The elections for the office of the Regional Chairman shall be held along with the elections to the Panels of the Committee and shall be regulated by election rules as well as the provisions of the Articles of Association. The Regional Chairman will be elected by the Ordinary members of their respective regions as mentioned here under and as per Rule 8 of the Election Rules. Accordingly, Elections will be held for the following posts of Regional Chairman in the regions covering States and Union Territories as under: (a) Northern Region Chandigarh, Haryana, Himachal Pradesh, Jammu & Kashmir, Punjab, NCT of Delhi, Uttar Pradesh and Uttarakhand (b) Rajasthan Region Rajasthan (c) Eastern Region Arunachal Pradesh, Assam, Bihar, Chhattisgarh, Jharkhand, Manipur, Meghalaya, Mizoram, Nagaland, Odisha, Sikkim, Tripura and West Bengal (d) Southern Region Andaman and Nicobar Islands, Andhra Pradesh, Karnataka, Kerala, Lakshadweep, Puducherry, Tamil Nadu and Telangana (e) Gujarat Region Gujarat (f) Western Region Maharashtra, Goa, Dadra and Nagar Haveli, Daman and Diu, and Madhya Pradesh Regional Chairman : Northern Region As per Election rule 4.2(m) and Article 21.1(c) of the Articles of Association, an Ordinary Member who has served as a Regional Chairman for 3 (three) continuous terms of 2(two) years each, shall not be eligible for re-election or re-appointment as a Regional Chairman or as a member of a Panel of the Committee or Vice Chairman or Chairman at the next election for the subsequent term of two years. In pursuance to the Election rule 4.2(m) and Article 21.1(c) of the Articles of Association Shri. Anil Sankhwal, Regional Chairman, Northern Region shall retire as the said member has served as a Regional Chairman for 3 (three) continuous terms of 2(two) years each, and will not be eligible to file nomination for elections for 2017-19. Further, based on Election rules, Regional Chairmen from other regions excluding Northern Region will retire and will be re-eligible to file nomination for the elections for 2017-19. 4 P a g e

In view of the above, 1 seat of Regional Chairman Northern Region stands vacant in the elections for COA for 2017-19. In view of the above, 1 seat of Regional Chairman Rajasthan Region stands vacant in the elections for COA for 2017-19. In view of the above, 1 seat of Regional Chairman Eastern Region stands vacant in the elections for COA for 2017-19. In view of the above, 1 seat of Regional Chairman Southern Region stands vacant in the elections for COA for 2017-19. In view of the above, 1 seat of Regional Chairman Gujarat Region stands vacant in the elections for COA for 2017-19. In view of the above, 1 seat of Regional Chairman Western Region stands vacant in the elections for COA for 2017-19. 2.3 (A):- CHAIRMAN a) The term of Chairman shall be of Two years. The Chairman shall hold office for a period of 2 [two] years and shall retire from the post of Chairman accordingly. The Chairman shall be eligible to file nomination as vice chairman only after a gap of not less than four years, immediately upon completion of his term of two years. However, such person may file nomination for Panel Member or Regional Chairman after a gap of two years upon completion of his term of Chairman. In pursuance to the provision of Election Rules and AoA, Shri. Praveen Shankar Pandya Chairman, shall retire due to completion of tenure and will not be eligible to file nomination for elections for period 2017-19. b) The election of Chairman shall be via Vice Chairman route. On completion of his term of two years, the Vice Chairman shall succeed to be the Chairman of the Council unless he is unwilling to accept Chairmanship or has incurred any of the disqualifications enumerated in Article 8.1 of the Articles of Association of the Council or in any other circumstances, he is not able to succeed as Chairman. In such case, the election of Chairman shall be made separately by the Ordinary Members of the Council along with the election of other CoA members. 5 P a g e

2.3 (B) VICE CHAIRMAN (a) The election of Vice Chairman shall be made separately by the Ordinary Members of the Council along with the election of other Committee members. (b) The term of Vice Chairman shall be of Two years. On completion of the said term, the Vice Chairman shall be endorsed to succeed the Chairman unless he is unwilling to accept Chairmanship or he has incurred any of the disqualifications enumerated in article 8.1 regard to membership of the Council. (c) A person having held the post of vice chairman shall be eligible to file nomination as vice chairman only after a gap of not less than four years, immediately upon completion of his term of two years. (d) In case, the Chairman incurs any disqualification or happening of an event which prevent him to continue as Chairman, during his tenure, the respective Vice Chairman of that term shall act as stand-in Chairman for the balance term. The criteria of one-man-one post shall not apply in such case. Further, on completion of balance term, the said Vice Chairman shall succeed as Chairman of the Council. In pursuance to the provision of Election Rules and AoA, 1 seat of Vice Chairman stands vacant in the elections for COA for 2017-19. 3. ELIGIBILITY TO CONTEST &/OR VOTE 3.1 Right to vote and contest confined to Ordinary Members a) Only an Ordinary Member shall have the right to vote at, or to offer self as a candidate at elections to various positions in the Council. (as per para 4.1 of Articles of Association). The FINAL updated voter list with authorized representatives, prepared in accordance with the notice of No.: Addl. DGFT/GJEPC/Elec 2017-19/2017-18/ dated 27 th June, 2017, is enclosed herewith for reference & record. The same is also displayed on Council s website http://www.gjepc.org/ election_coa.php 3.2 Eligibility for Election The Ordinary Members of the Council who have opted for inclusion in any one of the aforesaid Nine panels as defined under Election rule 2(a) and respective region shall be eligible to vote only through their nominated authorized representatives as per membership records of the council in respect of the candidates from that particular Panel / Region / Vice-Chairman / Chairman. 3.3 Eligibility to Vote As per Rule 4.1 of the Election Rules (a) The Ordinary Members shall have the right to vote at the Election of the Council s Committee of Administration. (as per Article 4.1 of Articles of Association) (b) Only the authorized representative whose name is mentioned as such in the membership application, while applying for membership with the Council, shall have right to vote at the Election. (c) Each Ordinary Member of the Council shall have one vote for every single representation/seat for the respective Groups of Panels as per the Panel opted/ registered with the Council from time to time. (For example, if a Group of Panels has three vacancies, each member of the Council who is registered in any Panel which is a part of that Group of Panels shall have one vote for each representation/seat in that particular Group of Panels but not exceeding three votes in all). 6 P a g e

(d) (e) (f) Each Ordinary Member from a particular region of the Council shall also have one vote for electing a Regional Chairman from that particular region where he is registered for the purpose of membership with the Council. Each Ordinary Member of the Council shall have one vote for election of Vice Chairman. Whenever there is a separate election for the post of Chairman, each Ordinary Member of the Council shall also have one vote for electing a Chairman. 3.4 Eligibility for Candidacy As per Rule 4.2 of the Election Rules A candidate standing for election to any position in the Council must satisfy the following conditions namely: (i) A candidate must be the Ordinary Member of the Council; (ii) Only the authorized representative, whose name is mentioned as such in the membership application, or any of the duly authorised person as stated under Rule 5(d) of Election Rules, while applying for membership with the Council shall be eligible to contest, propose or second at the Election. However, in the absence / non-availability / unwillingness of such authorised representative, any of the persons as mentioned under Rule 5(d) of this Rules and who is duly authorised by all the remaining partners / directors / managing committee member /trustee etc., as the case may be, shall be eligible to contest for the Election. Provided that the name of such person as partner / director / managing committee member / trustee etc. is registered with Director General of Foreign Trade & reflects in IEC. (iii) In order to stand for elections, the candidate or the entity represented by him must have to her/ his/ its credit, exports of not less than the following amounts:- 7 P a g e

In order to stand for reserved seat for MSME category, the candidate or the entity represented by him must have to her/ his/ its credit, the export of not less than Rs. 25 lakhs, of respective product, during the financial year immediately preceding the elections, from the panel in which the candidate is enrolled. The Member filing his nomination under Gold Jewellery Panel, for the Special Economic Zone (SEZ) seat, shall have a valid Letter of Permission (LOP) for gold jewellery. The members filling his nomination for the Reserved Seat of EH/TH/STH/PTH in the concerned panel need to submit the Export House / Status Holder certificate along with the Nomination Form and his name should appear in such list which is maintained by DGFT. (iv) Nomination indicating the name of the authorised representative of the Member eligible for election to any Panel of the Committee of Administration shall be proposed and seconded by members of the same Panel and in the event of nomination for Regional Chairman, the same shall be proposed and seconded by members of the same Region. In case of nomination of Chairman / Vice Chairman, the same can be proposed and seconded by any ordinary member. (v) The nominee, proposer and seconder should be otherwise eligible to vote. The nominations shall conform to the proforma prescribed by the Election Authority. (vi) Any voter / member de-registered or black listed under the Foreign Trade Policy with regard to exports / imports will not be eligible to file nominations for election to the Committee of Administration. declaration in writing signed by the Chairman / Managing Director /Director/ Partner/ Proprietor as the case may be that it is not debarred/black listed under the aforesaid Policy. (vii) A member can file nomination and contest election for only one post, as a member of respective Panel or as Regional Chairman or Vice Chairman or Chairman (whenever there is separate election for the post of Chairman). (viii) No Ordinary Member who has served as a Regional Chairman for 3 (three) continuous terms of 2(two) years each, shall be eligible for re-election or reappointment as a Regional Chairman or as a member from a Panel of the Committee or Vice Chairman or Chairman at the next election for the subsequent term of two years. Therefore, on the original Nomination Form itself the authorised signatory would be required to submit a declaration in writing that he does not suffer from any disqualifications which have been stated in the Election Rules. (ix) Where an elected member of the Committee has served continuously for 6 [six] years, such elected member shall be deemed to be retired and shall not be eligible for re-election or reappointment to the Committee, whether as Panel member or regional chairman or vice chairman or chairman, for a period of two years immediately after completion of such six years. Therefore, on the original Nomination Form itself the authorised signatory would be required to submit a declaration in writing that he does not suffer from any disqualifications which have been stated in the Election Rules. (x) In order to stand for the elections to the post of Regional Chairman from a particular region the address of the candidate registered with the Council for the purpose of membership must be with that regional office and in case of Western Region the address of the candidate should be registered with the Registered office of Council. 4. PROCEDURE FOR FILING & DEADLINE FOR SUBMISSION & WITHDRAWAL OF NOMINATION ETC. A Nomination Form to be valid, must be (a) the original Nomination Form enclosed with this Notice (Annexure A & B). (b) duly filled up in all respects, along with the necessary declarations, duly signed, stamped and complying with the provisions of Election Rules hereinbefore and as mentioned in this notice. The form and notice will also be available on the Council s website http://www.gjepc.org/election_coa.php. (c) filled in prescribed forms for the respective panels of the Committee of Administration, Regional Chairmen, Vice-Chairman and Chairman, as the case may be, duly proposed, seconded and signed by the nominee and duly certified by chartered accountant and accompanied by valid copy of EH/SEH/TH/STH/PTH and MSME certificate and for SEZ seat valid Letter of Permission (LoP) for Gold Jewellery (wherever applicable), should reach the office of the undersigned or the respective Regional Election Authority as mentioned in Annexure C on or before 15 th September 2017, by 5.30 p.m. To avoid delay due to late receipt Members are requested to send by speed post/courier/hand delivery one copy of the duly filled in nomination form to the office of the undersigned at Mumbai also, simultaneously when the same is submitted to Regional election authority in the concerned region. 9 P a g e

(d) A Nomination sent by telex/fax/telegram/e-mail to the Election Authority will be treated as invalid. (e) Any Nomination forms submitted to any of the offices of GJEPC will not be considered for scrutiny and will be treated as invalid. (f) In the event of the Election Authority/Regional Election Authority having reasons to doubt the veracity of any of the particulars/information contained in any Nomination Form received by it, the Election Authority / Regional Election Authority may call for particulars/information from the Executive Director of the Council. He/She will also be at liberty to call for export performance of the member concerned as per the record of the Council from the Executive Director. (g) The names of the nominees panel-wise and region-wise including Vice-Chairman and Chairman shall be entered in a register and after due scrutiny a list of valid nominations received will be prepared. Copies of such lists duly signed by the undersigned shall be sent to Head Office and all the Regional Offices of the Council as well as the same will be available on the website of the Council (http://www.gjepc.org/election_coa.php) within 7 days from the expiry of the period. In case of the invalid nominations the undersigned shall cite the reason for rejecting the same. (h) Nomination can be withdrawn by the candidate by a letter signed by him/her within 5 days from the date of aforesaid display of the list of valid nominations by the Election Authority/Regional Election Authority. Original letter of withdrawal of nominations need to be submitted to the Regional Election Authority or to the undersigned at Mumbai. (i) Such a withdrawal shall be final and no subsequent request, for rescinding such withdrawal shall be entertained by the undersigned or the respective Regional Election Authority. (j) As per Article 9 of the Articles of Association and Rule 10 of the Election Rules and the directives received from Ministry of Commerce & Industry, Government of India, from 2012 election onwards, the Committee of Administration of the Council has decided to conduct online electronic voting process; the user manual for the same is available on the Council's website http://www.gjepc.org/election_coa.php.
