Intrductin 1.1 The aim f this plicy is t imprve the quality and effectiveness f the use f the enfrcement pwers under the Anti-Scial Behaviur, Crime and Plicing Act 2014. Namely Cmmunity Prtectin Ntices (CPNs) and Public Space Prtectin Orders (PSPOs) ensuring that the use f the pwers is apprpriate, justifiable and necessary. 1.2 Sectins 43-58 (CPNs) and 59-75 (PSPOs) f the Anti-Scial Behaviur, Crime and Plicing Act 2014 were enacted n the 20 th Octber 2014 and have enabled fficers (Cnstables in unifrm and Plice Cmmunity Supprt Officers (PCSOs) t enfrce breaches f these ntices and rders. 1.3 Nrflk Cnstabulary supprts the apprpriate enfrcement f these pwers in rder t target anti-scial behaviur; hwever the quality f such use will influence public cnfidence and shuld be fully cnsidered against the rights f freedm f expressin and freedm f assembly and assciatin. 1.4 The purpse f a CPN is t deal with particular, nging prblems r nuisances which negatively affect the cmmunity s quality f life by targeting thse respnsible and can be issued t a persn aged 16 r ver, business r rganisatin Page 3 f 22

cmmitting anti-scial behaviur. Examples f issues these can be used t address are graffiti, rubbish and nise. 1.5 The purpse f PSPOs is t deal with a particular nuisance r prblem in a particular area that is detrimental t the lcal cmmunity s quality f life, by impsing cnditins n the use f that area which apply t everyne. They are designed t ensure the law-abiding majrity can use and enjy public spaces, safe frm anti-scial behaviur. The types f behaviur they are intended t tackle are the cnsumptin f alchl that results in anti-scial behaviur, dg fuling and nise related issues. 2. Issuing f a Cmmunity Prtectin Ntice 2.1 Befre issuing a CPN, a Cmmunity Prtectin Warning needs t be issued (CPW). The decisin t issue a CPW (Appendix A) will nrmally be undertaken within the Operatinal Partnership Team (OPT) and will be cnsidered against a range f ther interventins. A CPW letter can be issued when the individual, business r rganisatin: Is having a detrimental effect n the quality f life f thse in the lcality; Is persistent r cntinuing in nature; and Is unreasnable. 2.2 If the behaviur is nt rectified thrugh the CPW, the decisin t issue a CPN (Appendix B) will be agreed within the OPT structure and the mst apprpriate agency will issue the CPN and becme the lead agency fr any prsecutin regarding any breaches. 2.3 The OPT will recrd any CPW and CPN and any cnditins n Athena and, where apprpriate, place relevant CAD markers n Webstrm and make infrmatin available fr any briefings. They will als ntify any relevant agency i.e. the Husing Prvider and Envirnmental Health. 2.4 The CPW and CPN must clearly state what the behaviur r actin is that is having a detrimental effect n the quality f life f thse in the lcal cmmunity. It culd als include what actin is required frm the individual and must utline the cnsequences f nt cmplying. The requirement(s) set ut in the ntice culd include a requirement t desist frm a specific actin r behaviur, a requirement t make reasnable effrts t make gd any utstanding issues within a specified perid f time and/r a requirement t take reasnable steps t prevent future ccurrence f the behaviur r prblem. 3. Breach f a Cmmunity Prtectin Ntice 3.1 A Breach f any requirement in the ntice, withut reasnable excuse, is a criminal ffence, subject t a Fixed Penalty Ntice (FPN) r prsecutin. On summary cnvictin, an individual wuld be liable t a fine nt exceeding level fur n the standard scale (currently set at 2,500). An rganisatin is liable t a fine f up t 20,000. On cnvictin, the magistrates curt wuld als have the pwer t rder frfeiture and destructin f any item used in the cmmissin f the ffence. An Page 4 f 22

alternative t prsecutin wuld be fr the relevant agency t make gd any damage itself, and recver the csts f ding s frm the persn cncerned. 3.2 Where a breach f a CPW r a CPN is witnessed by an Officer, an ASB Breach Reprt frm (Appendix C) will be issued t the perpetratr and the fficer s cpy frwarded t the OPT. The OPT will ascertain wh the prsecuting agent is and determine the best way t prceed. This allws the evidence t be cllated and the decisin making t cnsider antecedents, ther behaviurs and nging case management. 3.3 OPT will recrd any breaches f CPW and CPNs n Athena after receiving the apprpriate breach frm, befre frwarding the apprpriate paperwrk t the prsecuting agent. 3.4 Any fficer identifying a breach will serve the perpetratr with the cmpleted Breach Reprt frm r, if n frm is available, reprt fr summns and prvide a signed MG11 t the relevant OPT. 3.5 A cpy f the Breach Reprt frm will be submitted t the relevant OPT t check the histry and liaise with partners. The OPT will determine the lead agency, best curse f actin and, if cnsidered apprpriate, arrange fr the FPN t be issued r file fr prsecutin accrdingly. Where this remains a Plice lead, the OPT will crdinate this activity and identify an Officer in the Case. 3.6 The issuing agency f the CPW and CPN will remain the prsecuting agency thrughut this prcess and be respnsible fr assessing the quality f evidence available, what is the mst prprtinate enfrcement ptin and ensuring that mechanisms are in place fr any enfrcement actin taken against the individual r business are fit fr purpse. 3.7 The agency that issued the CPN will be respnsible fr prsecutin. Fr CPNs issued by the Plice, the Crwn Prsecutin Service will be the prsecuting authrity. In the case f CPNs issued by a persn designated by the lcal authrity, the lcal authrity will be the prsecuting agency. The nly exceptin t this is when arrested with assciated ffences, if charged with the assciated ffence ther than the breach f the CPN; CPS will prsecute in the nrmal fashin and the standard methd f decisin and charging shuld be fllwed. 3.8 All FPN receipts are payable t the Lcal Authrity (LA), irrespective f which agency issues the FPN. Where a FPN is cnsidered apprpriate it will be issued by the LA, unless this has been specifically delegated t anther agency. Within Nrflk, the Plice will nt be respnsible fr issuing FPNs. 3.9 Where a FPN is nt paid within the required perid, the LA will refer the case back t the agency which issued the riginal CPN ( lead agency ); in the case f the Plice via the OPT fr cnsideratin f further actin and prsecutin f the riginal ffence the FPN was issued fr. 3.10 Where a FPN is nt paid within the required perid, the agency that issued the CPN will be respnsible fr prsecutin. Fr CPNs issued by the plice, the Crwn Prsecutin Service will be the prsecuting authrity. Page 5 f 22

3.11 A prcess flw map detailing the prcess f issuing and enfrcing CPNs is shwn in Appendix D. 4. Public Space Prtectin Orders 4.1 Public Spaces Prtectin Orders (PSPO) specify an area where activities are taking place that are, r may likely be, detrimental t the lcal cmmunity's quality f life. 4.2 The test is designed t be brad and t fcus n the impact that the anti-scial behaviur is having n the victims and cmmunities. A PSPO can be made by the cuncil if they are satisfied n reasnable grunds that the activities carried ut, r are likely t be carried ut in a public space: Have had, r are likely t have, a detrimental effect n the quality f life f thse in the lcality; Is, r is likely t be, persistent r cntinuing in nature; Is, r is likely t be, unreasnable; and Justifies the restrictins impsed 4.3 It is the LAs respnsibility t make sure that any PSPO is lawful and the crrect prcedure has taken place in applying fr, and implementing any Order, including any necessary signage is displayed and the crrect cnsultatin has taken place. 4.4 PSPOs impse cnditins r restrictins n peple using that area. Cuncils will be respnsible fr making any new PSPO. Enfrcement itself is far brader and the Plice may enfrce any f the cnditins r restrictins. 4.5 District Cuncils (DCs) / Lcal Authrities (LAs) assume sle respnsibility fr prsecutin f any ffences arising frm any breaches f the act. This applies n matter which agency identifies a breach. Within Nrflk, they will als be respnsible fr issuing any FPNs. 4.6 It is an ffence fr a persn, withut reasnable excuse, t; D anything that the persn is prhibited frm ding by a PSPO (Other than cnsume alchl-see belw); r Fail t cmply with a requirement t which the persn is subject under a PSPO 4.7 It is nt an ffence t drink alchl in a cntrlled drinking zne. Hwever, it is an ffence t fail t cmply with a request t cease drinking. Any persn wh cnsumes alchl in an area where this has been prhibited culd be required t hand ver any cntainers believed t cntain alchl. If alchl is cnfiscated, it can als be dispsed f by the persn wh cnfiscates it. 4.8 If a persn is in breach f a PSPO, they cmmit an ffence (s48) and the dispsal is a summary fine and refers t a reprting fr summns. Hwever, sectin 52 allws the Plice r lcal Authrity t issue a FPN where apprpriate. Within Nrflk the lcal authrity will be the nly agency issuing FPNs. Page 6 f 22

4.9 Where a breach f a PSPO is witnessed an ASB Breach Reprt Frm (Appendix C) will be issued t the perpetratr and the fficer s cpy frwarded t the OPT wh will assess the evidence, and supprting evidence, and frward this securely t the relevant LA fr cnsideratin f prsecutin r issuing a FPN. 4.10 Any fficer identifying a breach will serve the perpetratr with the cmpleted Breach Reprt Frm r, if n frm is available, reprt fr summns and prvide all relevant MG frms and supprting evidence t the OPT. 4.11 Breach f the rder withut reasnable excuse is a criminal ffence, subject t a FPN r prsecutin. On summary cnvictin, an individual wuld be liable t a fine nt exceeding level three n the standard scale. 4.12 A prcess flw map detailing the prcess f enfrcing a PSPO is shwn in Appendix E. 5. Pwer f Arrest Relating t PSPO 5.1 In cases which merit immediate arrest, this shuld cmply fully with Cde G f the Plice and Criminal Evidence Act 1984, e.g. in mst likelihd invlving cases fr enfrcing the failure t cmply with the request t cease drinking within the PSPO. 5.2 When arrested fr failing t cmply with the request t cease drinking, befre charging t curt cnsideratin needs t be given regarding the apprpriate LA needing t attend curt t prsecute the case. T facilitate this, the detained persn, when fit, will be released withut bail, (presumptin t release withut bail i.e. Release Under Investigatin (RUI) unless the justificatin exists fr bail, then the necessary authrity will be srt frm an Inspectr). 5.3 The OPT are t be infrmed f the arrest (and bail as apprpriate) t allw them t liaise with the relevant LA. 5.4 The lcal authrity must be ntified f arrest and detentin at the earliest pprtunity. The Lcal Authrity is the nly prsecuting authrity and will be respnsible fr the prvisin f a prsecuting lawyer n the persn s appearance at magistrates curt r Yuth Curt. This will include cases in which a persn has been remanded in custdy t the next available curt hearing. 5.5 Any arrest must be fully cmpliant with the Plice and Criminal Evidence Act 1984 and relevant Human Rights Act. All arrests must be necessary and prprtinate in accrdance with the Plice and Criminal Evidence Act 1984 and t the situatin that is presented t the Officer. 5.6 CPS will nt prsecute any PSPO breaches in any circumstances and the Lcal Authrity will always be the prsecuting agency as per the legislatin. The Lcal Authrity will be respnsible fr pstal requisitin, fllwing a release under investigatin (RUI), where the case is t be heard at curt. Page 7 f 22

6. Sharing f infrmatin 6.1 All infrmatin regarding CPNs and PSPOs will be managed by the relevant OPT, t cmply with the infrmatin sharing agreement and t ensure that data quality standards are adhered t. 6.2 All partners must have signed the mst recent and updated Nrflk Operatinal Partnership Teams Infrmatin Sharing Prtcl and Prcedure Guidance fr Anti- Scial Behaviur Case Management. All infrmatin shared will fllw the prcedure detailed within this dcument. Page 8 f 22

Step 1 An event is recrded with an apprpriate classificatin: The circumstances leading t a decisin fr a CPW r CPN may be crime r nn-crime derived. Investigate as nrmal. Nte - We NEED NOT create an event t purely recrd the CPW r CPN. Hwever this will depend n what standards yur Frce has applied t recrding. See steps that fllw; This event may be allcated t a user t investigate as nrmal. This user may be respnsible fr the CPW r CPN. The investigatin may be allcated t an OIC and anther specialist user maintains respnsibility fr the CPW r CPN. In which case yu may wish t register an interest in the investigatin. This will place a task n yur wrklad. The investigatin may be allcated t an OIC; hwever a supervisr may set anther user with a task t explre use f a CPW r CPN. This will cme frm using ACTIONS and a TASK will appear in a user s wrklad, frm which they can navigate int the investigatin. If n event exists in Athena t warrant yu recrding use f a CPW r CPN, then yu will need t create ne fr this purpse, selecting frm the ASB classificatins as apprpriate. This is retrievable frm the POLE view. All natinally recgnised Frce ASB infrmal, vluntary and diversinary interventins and frmal rders are catered fr here. A Frce capturing this level f detail will enhance the visibility f these and reduce duplicity where mre than ne business area is engaged in the management f a persn. Guidance In essence, recrding rders and interventins n Athena, against the persn, will result in a better view leading t better peratinal and risk management. These interventins are ften time specific and have a start and expiry date, alng with data that is required t infrm users (such as prhibitins), which the persn recrd caters fr and which is nt prvided fr t this level f detail within investigatin. Step 4 A user having issued a CPW r CPN can navigate t the ORDERS/INTERVENTIONS tab frm an event by highlighting the individual t which this applies frm the LINKS and selecting EDIT. A user will be presented with a screen called CREATE/UPDATE persn and will be able t navigate t the tab frm here. Having selected the ORDERS/INTERVENTIONS tab, a user will select ADD and frm the Order/Interventin type menu select frm: Cmmunity Prtectin Warning Cmmunity Prtectin Ntice They must cmplete the valid frm/t date/time. They may indicate if they are attaching any dcumentatin and d s using dcument manager. They must cmplete the free text bx DETAILS with any relevant infrmatin they wuld like presented t any ther user during a search against the persn bject in Athena. E.g. cnditins by which an ffender must cmply etc. These can be pasted frm any dcument. Fr a mre sphisticated return, lking fr mre than ne persn t whm the CPW r CPN will apply, then use the advanced search tls by searching fr: PEOPLE, where managed by FORCE ID = e.g. ESSEX And TYPE ORDERS AND INTERVENTIONS = Cmmunity prtectin ntice/cmmunity prtectin warning. AND Valid between select date and date And Expiry between select date and date Or by cmpleting a search against Investigatins with an investigatin finalisatin type f CPW r CPN. Recrding a breach f a CPW/CPN r PSPO Step 6 A user recrding an ffence within Athena invlving a breach f the CPW/CPN r PSPO will d s by creating an event within Investigatin.
