PH-2017-537 Conduct a public hearing and consider a resolution authorizing multiple project amendments to the 2013-2014, 2014-2015, 2015-2016 and 2016-17 Consolidated Annual Action Plans in an amount not to exceed $260,000.00 and authorizing the City Manager to execute all necessary documents. 2. PH-2017-538 Conduct a public hearing and consider an ordinance amending the Project and Financing Plan for Reinvestment Zone Number One for Tax Increment Financing (TIF Zone One) to amend the contract for the Franklin Place, Phase II, project by extending the completion date to March 31, 2019, and increasing the anticipated appraised value to $13,500,000.00; and, to provide up to $956,200.00 to the City of Waco for streetscape and safety improvements on Elm Avenue from University Parks Dr., to Garrison St., all in TIF Zone One in Waco, McLennan County, Texas; and authorizing the City Manager to execute any documents necessary in connection therewith. RES-2017-541 Consider a resolution approving a revised City of Waco Bridge Lighting Policy which includes a section providing for Citizen Suggestions for Bridge Lighting. 2. RES-2017-542 Consider a resolution approving a refinancing by the Crawford Cultural Facilities Corporation (the Crawford Corporation ) of a tax exempt note issued for the benefit of the YMCA of Central Texas, and approving new tax exempt borrowing through the Crawford Corporation for renovation of the locker rooms and the pool deck at the Waco Family YMCA and making certain findings related thereto. 3. RES-2017-543 Consider a resolution approving a one year renewal of the contract with Jaynes, Reitmeier, Boyd & Therrell, P.C., Waco, Texas, to perform the annual audit for Fiscal Year 2016-17, for a fee not to exceed $68,345.00 and authorizing the Mayor and/or City Manager to execute all documents needed to complete this transaction. 4. RES-2017-544 Consider a resolution to revise the servicing of existing Down Payment Assistance Loans by forgiving those loans that have reached the Department of Housing and Urban Development (HUD) minimum affordability period and authorizing the City Manager to execute all documents necessary to complete these transactions. 5. RES-2017-545 Consider a resolution approving an Amended Interlocal Cooperation Agreement and a Memorandum of Understanding between the City of Waco and the City of Beverly Hills for the purpose of allowing the City of Beverly Hills to continue to use the City of Waco radio system and authorizing the City Manager to execute any necessary documents connected therewith. 6. RES-2017-546 Consider a resolution ratifying payment in the amount of $59,215.00 to Pierce Manufacturing, Inc., for repairs to Fire Engine 1 which was damaged in a wreck on May 6, 2016, and authorizing the City Manager to execute all documents necessary to complete this transaction. RES-2017-547 Consider a resolution awarding a City-wide contract to Texas Document Solutions, Inc., for the lease of digital copiers, through an existing cooperative purchasing agreement with BuyBoard for a period of 36 months with two 12-month renewal options and authorizing the City Manager to execute all documents necessary to complete this transaction. 8. RES-2017-548 Consider a resolution authorizing the purchase of furniture for the Information Technology and Emergency Management Departments under an existing cooperative purchasing agreement with The Cooperative Purchasing Network in an amount not to exceed $156,782.95 and authorizing the City Manager to execute all documents necessary to complete the transaction. 9. RES-2017-549 Consider a resolution authorizing a contract for engineering services with Raymond L. Goodson, Jr., Inc., d/b/a RLG for the Wastewater System Improvements - FY16/17, Phase 9 Project, in an amount not to exceed $102,690.00, and authorizing the City Manager to execute all documents necessary to complete this transaction. 10. RES-2017-550 Consider a resolution authorizing the acquisition, including the use of the power of eminent domain, if such becomes necessary, to (1)(a) acquire a perpetual water and/or sewer pipeline easement in, on, over, under, along, through, and across a 0.078 acre tract of land and (b) acquire a temporary construction and access easement in, on, over, under, along, through, and across a 0.053 acre tract of land, said tracts being located in the Jacob Walker Survey, Abstract 885, McLennan County, Texas, and being a portion of the remainder of a called 0.44 acre tract described in a deed to Jarvis-Paris-Murphy Company, Inc., recorded in Volume 1535, Page 624, of the Deed Records of McLennan County, Texas, and (2)(a) acquire a perpetual water and/or sewer pipeline easement in, on, over, under, along, through, and across a 0.408 acre tract of land and (b) acquire a temporary construction and access easement in, on, over, under, along, through, and across a 0.317 acre tract of land, said tracts being located in the Jacob Walker Survey, Abstract 885, McLennan County, Texas, being a portion of a called 2.714 acre tract described in Tract No. 1, in a deed to Murphy-Jarvis, Inc., recorded in Volume 875, Page 589 of the Deed Records of McLennan County, Texas, both acquisitions being for wastewater and/or water system pipeline(s) and related appurtenances and facilities needed for the extension of the municipal wastewater and water systems, including the system improvement of a water transmission line from the Riverside Water Treatment Plant to the Gholson Road Ground Storage Tank, and (3) authorizing the City Manager to execute all documents necessary to complete these transactions. 11. RES-2017-551 Consider a resolution authorizing Amendment No. 2 to the contract with Walker Partners, LLC, for surveying and engineering services associated with the Chimney Hill Drainage Improvements project, to provide easement and right-ofway acquisition support services and to increase the contract amount by $117,565.00, so that the total contract amount does not exceed $402,565.00, and authorizing the City Manager to execute all documents necessary to complete this transaction. RES-2017-552 Consider a resolution amending four resolutions as follows: 1) Resolution No. 2017-336 - to amend the legal description to Lot 1, Block 43, Provident Addition for the property located at 2600 Parrott Ave.; 2) Resolution No. 2017-406 - to rescind the sale of the property located at 1524 N. 7th St. (further described as Lot 2, Block A, Waco Co. Subdivision) to Rodolfo Medrano and to amend the resolution so that 1524 N. 7th St. is sold to Nicole Monet Ivory; 3) Resolution No. 2017-406 - to amend the resolution for the property located at 2705 Bosque Blvd. so that the grantee includes Joanne Ramirez; and 4) Resolution No. 2017-406 - to rescind the sale of the property located at 2125 Trice Ave., to Ashley Gonzalez and Jesus Avilia. 13. RES-2017-553 Consider a resolution approving appointments to various boards and commissions, subject to each appointee meeting qualifications. XII. ORDINANCES 1. ORD-2017-554 Consider an ordinance deleting Section 2-87 requiring a bond by the City Secretary and Article II Human Relations Commission and Article III Office of Community Development in Chapter 12 Human Relations of the Code of Ordinances of the City of Waco. FIRST READING 2. ORD-2017-555 Consider an ordinance approving a negotiated resolution between the Atmos Cities Steering Committee ("ACSC") and Atmos Energy Corp., Mid-Tex Division ("Company") regarding the Company s 2017 rate review mechanism filings; declaring existing rates to be unreasonable; adopting tariffs that reflect rate adjustments consistent with the negotiated settlement; finding the rates to be set by the settlement tariffs to be just and reasonable and in the public interest; requiring reconciliation and rate adjustments if federal income tax rates change; terminating the RRM process for 2018 pending negotiation of RRM terms and conditions; and requiring the Company to reimburse ACSC's reasonable ratemaking expenses. SECOND READING 3. ORD-2017-556 Consider an ordinance amending Article IX, Municipal Settings Designation, in Chapter 26, Utilities, to designate the existing provisions as Division 1 and adding a new Division 2 to prohibit the use of groundwater in a designated area generally described as the Riverfront Property.
