CALL TO ORDER CITY COUNCIL REGULAR MEETING MINUTES Mayor Gámez called the meeting to order at 7:00 PM. INVOCATION/PLEDGE OF ALLEGIANCE Invocation was led by City Attorney Scott W. Ruby and the Pledge of Allegiance was led by Council Member Juan F. Rodriguez. ROLL CALL Mayor Gámez, Vice Mayor Tovar and Council Members Farr, Mendoza and Rodriguez were present. Council Members Espinoza and Laborin were absent. Also Present: City Manager Reyes Medrano Jr., City Attorney Scott W. Ruby, Police Chief Larry Rodriguez, Mario Rochin Building Director, and Chris Hagen City Clerk Department Heads: Controller Steven Baumgardt, Mark Berrelez Utilities Director, Jason Earp, Public Works Director, George Good Fire Chief, Stephen Holliday, Information Technology Director, Wendy Jackson Human Resources Director, Joy McClain Community Services Director, and Diana Quezada Magistrate Absent: Assistant City Manager John Paul Lopez, FINAL CALL TO SUBMIT SPEAKER REQUEST FORMS All citizens and interested parties wishing to speak before the Council shall fully complete a Speaker Request Form and, if possible, submit the form(s) to the City Clerk, or designee prior to the meeting being convened; but in any case submissions should be made no later than the Presiding Officer announcing the Final Call to Submit Speaker Request Forms. Sufficient Speaker Request Forms are located in the lobby of the Council Chambers. All speakers will be limited to 3 minutes unless otherwise noted by the Mayor. PAGE 2 SCHEDULED PUBLIC APPEARANCES BUSINESS FROM THE FLOOR 1. Public Hearing of a Use Permit as submitted by Martha & Adolfo Gomez d.b.a. A & R Auto Repair, 116 South 91 st Avenue, Tolleson, Arizona 85353 to open an automotive repair business including: mechanic work, tune ups, and brake changes. Public Hearing opened at 7:01 PM and closed at 7:07 PM. Martha Gomez explained that they are waiting to obtain their business license to open up an automotive repair business within Bothof s. They will be doing mechanic work, tune ups, and brake changes. The Gomez s have been making improvements to the parcel and are planning on paving the parking lot and adding a fence. Enos Auto Service is moving out the parked vehicles have been removed. Gomez s will add landscaping. Council Member Farr complimented them on the improvement in appearance of this parcel. Council Member Mendoza inquired about the vehicles from Bothof s Gomez also has a towing company and out of the 10 on this parcel he has towed away 6 vehicles. There is a classic car left. Gomez s car storage is on Jackrabbit Road as part of his towing business. The towing business is separate from the automotive business. 2. Public Hearing on Fiscal Year 2007-2008 Annual Budget and Fiscal Year 2007-2008 Tax Levy. Public Hearing opened at 7:07 PM and closed at 7:09 PM. Steven Baumgardt gave an overview of the Fiscal Year 2007-2008 budget. Mayor Gámez and Council Member Rodriguez thanked and congratulated Reyes, John Paul and Steven on a successful budget planning review process. 3. Convene into Special Meeting.

Approve/Deny Resolution No. 1013 of the Mayor and Council of the City of Tolleson, Maricopa County, Arizona adopting the final budget for Fiscal Year 2007-2008 (Vote via Roll Call). Motion made to approve Resolution No. 1013 adopting the Fiscal Year 2007-2008 budget by Council Member Rodriguez and 2 nd by Vice Mayor Tovar. Motion carried 5-0. Roll Call Vote as follows: Council Member Farr Vice Mayor Tovar Council Member Mendoza Council Member Rodriguez Mayor Gámez 5. Reconvene into Regular Scheduled City Council Meeting. Motion made to reconvene into Regular Scheduled City Council Meeting by Council Member Rodriguez and 2 nd by Vice Mayor Tovar. CONSENT AGENDA ACTION ITEMS *a. Approve Minutes: Work Study Minutes of June 25, 2007,Regular Meeting Minutes of June 26, 2007 and Public Hearing Minutes of June 28, 2007. *b. Approve Claims and Bills (claims and bills submitted for approval are all claims and bills incurred no later than 24 hours prior to the council meeting) and may be reviewed at City Hall during regular business hours. *c. Approve Ordinance No. 457, N.S. Amending Section 11.5 of the City of Tolleson Employee Handbook Adopted by Ordinance No. 298, N.S. Relating to Employee Drug and Alcohol Policy. *d. Approve Professional Services Agreement between the City of Tolleson and Smithgroup Arizona Architects, Inc. for architectural services for the concept development for renovation of existing building.

Motion made to approve by Council Member Rodriguez and 2 nd by Council Member Mendoza. Motion carried 5-0. REGULAR AGENDA ACTION ITEMS PROPOSED TO BE HEARD 1. Approve/Deny a Use Permit as submitted by Martha & Adolfo Gomez d.b.a. A & R Auto Repair, 116 South 91 st Avenue, Tolleson, Arizona 85353 to open an automotive repair business including: mechanic work, tune ups, and brake changes. Motion made to approve by Council Member Rodriguez and 2 nd by Council Member Mendoza with the stipulation that the parking area on this parcel not be used as a vehicle storage facility. Vehicles must be removed within a 72 hour timeframe. Motion carried 5-0. 2. Approve/Deny Purchase Order No. 54008 payable to Teledyne Isco for the purchase of an acoustic Doppler flow meter. After discussion and legal counsel motion made to table to a future meeting by Council Member Rodriguez and 2 nd by Vice Mayor Tovar. Motion carried 5-0. 3. Approve/Deny Purchase Order No. 54742 for the purchase of chlorine for Fiscal Year 2007-2008. (Note: Third year of a three year contract.) Motion made to approve by Council Member Rodriguez and 2 nd by Council Member Farr. Motion carried 5-0. 4. Approve/Deny Purchase Order No. 54744 payable to Polydyne, Inc. for the purchase of polymer for Fiscal Year 2007-2008. (Note: Third year of a three year contract.) Motion made to approve by Council Member Farr and 2 nd by Council Member Mendoza. Motion carried 5-0.

PAGE 5 5. Approve/Deny Purchase Order No. 54745 payable to Basic Chemical Solutions for the purchase of sodium bisulfite for Fiscal Year 2007-2008. (Note: Third year of a three year contract.) Motion made to approve by Vice Mayor Tovar and 2 nd by Council Member Mendoza. Motion carried 5-0. 6. Approve/Deny Ordinance No. 458, N.S. of the City Council of the City of Tolleson, Maricopa County, Arizona Amending the Tax Code of the City of Tolleson, Chapter 8-A, Privilege and Excise Taxes, Article IV, Privilege Taxes, Section 8A-460 Retail Sales: Measure of Tax; Burden of Proof; Exclusions, by Increasing the Tax Rate therein to two and one half percent (2.5%); providing Penalties for Violations; Providing for Severability; and Establishing an Effective Date. Mayor Gámez addressed the state of emergency in reference to the Fire Station, how important it is to support all Public Safety personnel. He also addressed neighboring communities that have already implemented this.5 cent sales tax that Tolleson residents pay when shopping outside of Tolleson. All Council Members and Vice Mayor were in agreement they thank Tolleson Public Safety personnel for all they do to support and provide a safe environment for the residents. Vice Mayor Tovar thanked Chief Good and Chief Rodriguez for their attention to detail involved in this tedious task. Council Member Rodriguez acknowledged that this is not a popular decision to make but it is their obligation to ensure the safety of all citizens as well as to support Public Safety personnel with the required facilities and equipment needed to protect the City. 7. Approve/Deny Service Performance contract for janitorial services for Fiscal Year 2007-2008. Jason Earp reviewed the results of the bids only two were received. Service Performance is the selected vendor. Motion made to approve by Council Member Rodriguez and 2 nd by Vice Mayor Tovar. Motion carried 5-0.

PAGE 6 CITY MANAGER S REPORT OF CURRENT EVENTS 1. July 4 th Update Chief Good recapped the event it was 117 --a tree did catch on fire during the fireworks display as well as Fire being called out for a near drowning. Public Works started the set up at 8:00 AM and worked until the end of the event. Mayor Gámez and City Manager Medrano thanked all of staff who helped make this a great day for the community. Mayor acknowledged Council Members Mendoza and Rodriguez for their participation. Council Member Rodriguez praised Maribel Grayson and the Teen Council for their outstanding participation as well as Obed Gaytan and the Explorers. Mayor acknowledged that Tolleson has the best West Valley July 4 th celebrations. ADJOURNMENT Motion made to adjourn by Council Member Rodriguez at 7:31 PM and 2 nd by Vice Mayor Tovar.
