The proposed amendments set forth in the proposed ordinance (attached) are necessary to eliminate perceived ambiguities in language that could lead to discretionary interpretation as to the right of entry for inspectors to conduct Systematic Code Enforcement Program inspections. Section 161.601 is amended to add a provision regarding the right of entry when exigent circumstances exist and the amendments to Sections 161.602.2 and 161.603 clarify the right of entry for periodic inspections and complaint inspections respectively. RECOMMENDATIONS The General Manager of HCIDLA respectfully requests that: I. II. III. ORDINANCE NO. Ordinance amending Sections 161.601, 161.602.2 and 161.603 of Article 1 Chapter XVI of the Los Angeles Municipal Code to clarify housing inspection procedures. THE PEOPLE OF THE CITY OF LOS ANGELES DO ORDAIN AS FOLLOWS: Section 1. Paragraph 4 of Section 161.601 of Division 3.5, Article 1, Chapter XVI of the Los Angeles Municipal Code is amended to read as follows: Exigent Circumstances: Notwithstanding the foregoing, if the General Manager has reasonable cause to believe that the building, dwelling unit, or common area is so hazardous, unsafe or dangerous as to require immediate inspection to safeguard the public health or safety, the General Manager shall have the right to immediately enter and inspect the premises by use of any reasonable means to effect entry.sec. 2. Section 161.602.2 of Division 6, Article 1, Chapter XVI of the Los Angeles Municipal Code is amended to read as follows: SEC. 161.602.2. The General Manager shall give written notice to the owner and tenants of the date and time of the periodic inspection. The General Manager may provide written notice to the tenants by mail or by the posting of the official notice in the public area of the premises. The General Manager shall adopt regulations to implement this section. Sec. 3. Section 161.603 of Division 6, Article 1, Chapter XVI of the Los Angeles Municipal Code is amended to read as follows: Subject to the limitations of Section 161.601, the General Manager may inspect those portions of buildings, dwelling units and common areas within the scope of this Article about which a complaint has been lodged. Sec. 4. The City Clerk shall certify to the passage of this ordinance and have it published in accordance with Council policy, either in a daily newspaper circulated in the City of Los Angeles or by posting for ten days in three public places in the City of Los Angeles: one copy on the bulletin board located at the Main Street entrance to the Los Angeles City Hall; one copy on the bulletin board located at the Main Street entrance to the Los Angeles City Hall East; and one copy on the bulletin board located at the Temple Street entrance to the Los Angeles County Hall of Records.
