APPROVAL OF MINUTES Council Meeting on September 08, 2015 as ed? Approved as ed. VIII. APPROVAL OF PAYMENTS Motion made for approval for payment of bills for September, 2015. Motion by: Council Member, Roger Cassell 2nd by: Vice Mayor, Allan Roberts IX. PUBLIC COMMENT Attorney for Estil Cemetery discussed the process that has been done to be able to sign a deed which they may now legally do. Also has been working with Town Attorney, Michele Brooks to come up with a mutually beneficial agreement concerning the property. Debbie Kindle spoke about property maintenance and a property on Highland St. that is unable to be passed due to the amount of vehicles and equipment parked on the street. Mayor Perry closed the public comment session at 6:50 P.M. and opened the consent agenda session. X. COMMUNICATIONS XI. REPORTS A. Engineer s Status Report Cody McElroy read his report. B. Treasurer s Report Council Member, Wallace W. Ross,. Jr. had a few questions about the Treasurer s Report. C. Codification Committee/Property Maintenance- Council Member, Walter Salyers questioned the amount of cases being reported and wanted to ensure that we did not just let those go. D. Police Department Report E. Council Reports Vice Mayor, Allan Roberts asked if there was any way that we could look into repairing the wall on the Old Town Hall building as he believes there are birds and things getting into the building. Town Manager, Greg Jones stated that he would look into it. Vice Mayor, Allan Roberts further stated that he would like to know that there will be more speed patrol on Jackson St. He and Council Member, Wallace W. Ross, Jr. discussed their trip to the VML Conference. Council Member, Wallace W. Ross, Jr discussed that Nashville will be hosting an event with a member from each major city throughout the US and that it would be a good opportunity to meet people. Council Member, Robin Richards stated that she only had one 2

complaint about someone breaking the Noise Ordinance. Council Member, Roger Cassell wanted to thank the town for allowing him to go to the conference and letting him hear the Governor speak. He was impressed that the Governor had been all over the world making contacts and his speech was really impressive. F. Economic Development Committee Vice Mayor, Allan Roberts stated that he was working on Main St. program and went to tourism meeting in Tazewell. He was also able to give breakfast items to over 49 people on the tour bus that came through. G. Historical Committee H. Manager- Read report. I. Park Committee J. Planning Commission K. Public Works L. Sanitation Authority M. Street Commission N. Safety Committee O. Water Plant P. Events Committee XII. UNFINISHED BUSINESS Park Committee By-laws Discussion about ensuring that Article 1 will cover distribution and that Article 2 will be with Council approval. Motion made to approve the by-laws. Town to write letter to the High School stating that any type of work is done at the Park would need to be approved by the Town. Discussion to change this from High School to be School Board. Motion made to table until the next meeting. XIII. NEW BUSINESS 3

Discuss Crosswalks on Jackson St. Discussion about writing letters to VDOT asking that something be done about the crosswalks before any further accidents. Tabled to adjourned meeting after Public Hearing on October 29, 2015 at 6:30 P.M. Authorizing Bond Resolution - New Peoples Bank Refunding Motion made to accept the resolution. Motion by: Vice Mayor, Allan Roberts 2 nd by: Council Member, Walter Salyers Roll Call Estil Cemetery Motion made to table until after closed session. Town Hall Garage Rental Town Manager, Greg Jones stated that there was an offer on the downstairs rental for Crossfit training. They are offering $850.00 a month. Council Member, Roger Cassell asked if the music would be bothersome to those working in Town Hall. Town Manager, Greg Jones stated that he thought it would be fine. Motion made to accept the Crossfit training renters at $850.00 per month. Motion by: Vice Mayor, Allan Roberts 2 nd by: Council Member, Walter Salyers Public Hearing for Sidewalk project on Solon St. Motion made to have a Public Hearing on October 29, 2015 at 6:30 P.M. to allow proper publication time. Motion by: Vice Mayor, Allan Roberts 2 nd by: Council Member, Roger Cassell Transfer from Capital Outlay to General Fund $19,029 (FY 2015 Funds) for Town Hall Roof Motion made to approve the transfer. Police Department Policy and Procedure Manual 4

Town Manager, Greg Jones stated that we would need a couple of council members to review the policy as there had been some changes. Council Member, Robin Richards and Council Member, Walter Salyers will be reviewing and no decisions should be made until after the review. Motion made to table until December council meeting. IV. PUBLIC COMMENT NEW BUSINESS XV. CLOSED SESSION Motion made for Council to enter into closed session to discuss legal and personnel issues. Motion by: Vice Mayor, Allan Roberts 2 nd by: Council Member, Walter Salyers Mayor Perry opened the closed session at 8:15 P.M. XVI. RETURN FROM CLOSED SESSION Council returned from closed session at 9:17 P.M. Motion made for Council to return from closed session. CERTIFICATION OF CLOSED MEETING Read by: Michele Brooks WHEREAS, the Gate City Town Council has convened a Closed Meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of the Virginia Freedom of Information Act; and WHEREAS, Section 2.2-7312 of the Code of Virginia requires a certification by the Town Council that such closed meeting was conducted in conformity with Virginia law; NOW, THEREFORE, BE IT RESOLVED, that the Gate City Town Council hereby certifies that to the best of each member s knowledge, (1) only public business matters lawfully exempted from open meeting requirement by Virginia law were discussed in closed meeting to which this certification applies and (2) only such business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Gate City Town Council.
