RESOLUTION NO. 062693 BEFORE THE BOARD OF WHITMAN COUNTY COMMISSIONERS In the matter of initiating a county road bridge project designated as C.R.B.P. No. 0115-00.01(2), Project No. XFB40. IT IS HEREBY RESOLVED that the Flaig Bridge, County Bridge No. 0115-00.01 be improved as follows: This project provides for the replacement of the Flaig Bridge with one 60 foot long, 96 inch culvert pipe and one 60 foot long, 60 inch culvert pipe. This project is hereby declared to be a public necessity and the County Engineer is hereby ordered and authorized to report and proceed thereon as by law provided (RCW 36.75.050, 36.80.030, 36.80.070) IT IS FURTHER RESOLVED that an appropriation from the official adopted county road fund budget and based on the County Engineer's estimate is hereby made in the amounts and for the purposes shown: PURPOSE AMOUNT OF APPROPRIATION Engineering (PE & CE) $ 4,000.00 Construction $41,000.00 TOTAL $45,000.00 This project was included in the official adopted annual road program as Item No. 1. IT IS FURTHER RESOLVED that the construction is to be accomplished by county forces in accordance with RCW 36.77.065 and WAC 136-18. Engineering Division: D062693B 3. Approval has been received from the state for the Looney Bridge project. Therefore the department will proceed with the call for bids. D062693C 4. Construction signs are up for the Palouse Cove Road; the contractor will begin the clearing and grub work soon. Maintenance Division: D062693D 5. The crews are preparing for seal coating, which begins next Monday. D062693E 6. The crews have completed most, if not all, requests for asphalt and street work from the small cities/towns, i.e. Colton and Rosalia. 06269 4 7. Mark Bordsen presented a proposed zone change for cluster residential development. Motion by Commissioner Finch seconded by Commissioner Partch and carried to accept the Planning Commission s recommendation to approve a zone change for Duane and Gayle Mickelsen at 1101 Kitzmiller Road, Pullman changing the zone from agricultural district to cluster residential district. The commissioners expressed their support for the district and thanked all parties involved. ORDINANCE NO. 062694 AN ORDINANCE AMENDING THE WHITMAN COUNTY ZONING MAP TO CHANGE THE ZONING FROM AGRICULTURAL TO CLUSTER RESIDENTIAL DISTRICT. BE IT ORDAINED and enacted by the Board of County Commissioners of Whitman County, State of Washington, it having been determined by the Board after hearing the Recommendations and Findings of Fact of the Whitman County Planning Commission that these should be accepted and this action is consistent with the Whitman County Comprehensive Plan. Change the zoning for an approximate 20 acre parcel located north of Pullman at 1101 Kitzmiller Road, about ½ mile east of the intersection of Kitzmiller Road (county Road 5520) and SR 27, in the NW ¼ of the SW ¼ of Section 28, Township 15N, Range 45E W.M., Whitman County, Washington. 4

Be it known also that this zone change shall be made effective on the date that an official zone change map has been signed by the Board. Passed and approved by the Board of Whitman County Commissioners of Whitman County, Washington, on the 6 th day of July 2004. Mr. Bordsen explained the second zone change request stating this property is the old mobile home park at Wawawai built at the time the dams were being built to replace a community that was going to be inundated. The property has water/water right and zoned rural community. This property was later turned into an RV Park that did not prove to be very profitable. The owner, Mr. Van Houten would like to change the zone back to an RCC-1 District and replat it for housing. Motion by Commissioner Partch seconded by Commissioner Finch and carried to accept the Planning Commission s recommendation and approve the zone change for George Van Houten at the Wawawai RV Park site from agricultural district to RCC-1 District. The commissioners thanked staff and wished Mr. Van Houten well in his endeavor. ORDINANCE NO. 062695 AN ORDINANCE AMENDING THE WHITMAN COUNTY ZONING MAP TO CHANGE THE ZONING FROM AGRICULTURAL DISTRICT TO RCC-1 DISTRICT BE IT ORDAINED and enacted by the Board of County Commissioners of Whitman County, State of Washington, it having been determined by the Board after hearing the Recommendations and Findings of Fact of the Whitman County Planning Commission that these should be accepted and this action is consistent with the Whitman County Comprehensive Plan. Change the zoning of the Wawawai RV Park from Agricultural District to RCC-1 District as may be allowed by the Whitman County Zoning Ordinance, Chapter 19.04. The site of this proposed rezone is on the east side of Wawawai Road (County Road #9000) along the Snake River, approximately 15 miles southwest of Pullman, WA, within the SW ¼ of Section 2 and NW ¼ of Section 11, Township 13N, Range 43E W.M. 5

Passed and approved by the Board of Whitman County Commissioners of Whitman County, Washington, on the 6 th day of July 2004. The third zone change request was submitted by Bill Christian. According to the Planner, Mr. Christian is requesting a zone change from agricultural district to light industrial for a welding shop followed by the retail sale of metal. Motion by Commissioner Finch seconded by Commissioner Partch and carried to accept the Planning Commission s recommendation to approve the zone change for Bill Christian at 1902 Airport Road from agricultural district to light industrial district. Commissioner Partch said this project is good for the county and good timing for Mr. Christian, especially with the reconstruction of SR 270. The commissioners wished Mr. Christian well. ORDINANCE NO. 062696 AN ORDINANCE AMENDING THE WHITMAN COUNTY ZONING MAP TO CHANGE THE ZONING FROM AGRICULTURAL TO LIGHT INDUSTRIAL DISTRICT. BE IT ORDAINED and enacted by the Board of County Commissioners of Whitman County, State of Washington, it having been determined by the Board after hearing the Recommendations and Findings of Fact of the Whitman County Planning Commission that these should be accepted and this action is consistent with the Whitman County Comprehensive Plan. Change the zoning from an approximate 1.8 acre portion of a parcel located at 1902 Airport Road, about 1 and ¼ mile west of the intersection of Orville Boyd Road (County Road 5525) and Pullman Airport Road (County Road 5600), in the NW ¼ of Section 34, Township 15N, Range 45E W.M. Whitman County, Washington. Be it known also that this zone change shall be made effective on the date that an official zone change map has been signed by the Board. Passed and approved by the Board of Whitman County Commissioners of Whitman County, Washington, on the 6 th day of July 2004. 6

Finch, Commissioner 11:30 a.m. Mike Werner, Developmental Services Director. 062697 1. Mr. Werner presented contract amendment 0363-36228(01) for an additional $5,980. This money is to be used for transitioning of developmentally disabled high school graduates. The statewide average service cost for individuals involved in DS employment services is $500/person. Therefore, this amendment will fund one person in Whitman County. This year 8 individuals graduated. Mr. Werner worried if this trend continues, as far as the number of graduates per year it will be the first time in Whitman County DS history that there will be a waiting list for services. Mr. Werner said he would probably need to amend the DS county budget this fall to incorporate this increase. Motion by Commissioner Finch seconded by Commissioner Partch and carried to authorize signing the amendment increasing the contract amount by $5,980 from $751,730 for a total of $757,710. D062697A 2. According to the Director, the state is auditing portions of the 2001-2003 and 2003-2005 biennium. 062698 3. Mr. Werner distributed copies of an email about the State Supplemental Payment System (SSPS). The current program is being extended until October 1, 2004. On October 1 st, the state will continue to authorize SSPS but will not likely be utilizing the current payee system. Instead, the payments will be forwarded to the counties/vendors/providers as was the process previously. D062698A 4. The Director has set up a tour of the Hillside Court properties and Paul s Place for next Tuesday following the DSAB meeting. Mr. Werner extended an invitation to the commissioners. D062698B 4. Mr. Werner is working with Tim Myers and Tom Miller on the roof and gutter bids for the Hughes House. D062698C 5. The Director explained the Y-Kids First program is a program partially funded by DS and coordinated with the YMCA at WSU for children ages 6-12. This is a summer program serving 8-10 youths with special needs. 7

Support is primarily by parent pay, but some funding is available for those that qualify. D062698D 6. The annual adaptive bicycling event is scheduled for July 28 th at 5 p.m. at the Pullman City Playfield. 7. Executed copies of the following documents received: 062699 CARES Business Associate agreement, and 062700 Palouse Industries Business Associate agreement. 11:55 a.m. Recess. 1:30 p.m. Dan Brown, Information Services. 062701 Mr. Brown said he has been working with the Administrative Offices for the Courts (AOC) who provide computers and programs for the Clerk, District Court, Superior and the City of Colfax. They are looking at cost saving measures while enhancing services. The AOC has one PC at the City of Colfax court as well as a dedicated circuit from Qwest and a router they pay for each month. The AOC is proposing to pay the cost of running a connection through the county s District Court lines to the City thereby eliminating the cost of the extra line and router saving the state money in the long run. As an added benefit, the Colfax City Police would then have the capability of connecting to the Spillman program. Mr. Brown stated the AOC has agreed to pay up to a maximum of $4,000 plus tax for this project. The Board had no objections in allowing the City access through the county lines provided there is absolutely no cost to the county. The commissioners pointed out since the City of Colfax is not a participating member of WHITCOM the City is not eligible for access to Spillman. If Colfax does become a participating member, they would have access to Spillman. There being no further discussion, Mr. Brown signed the agreement between the State AOC and Whitman County. 2:00 p.m. Tim Myers and Tom Miller. Present: Bob Reynolds. D062701A Tim Myers reviewed the previous change orders for the heating/airconditioning/jail boiler project and additional work performed by Galen Merching, all of which was not included in the original bid. Mr. Myers said as he understands the contract, the contractor must honor the warrantee from the date of the last payment thereby providing the county with an extra year of warrantee. Motion by Commissioner Finch seconded by Commissioner Partch and carried to approve the final change order of $12,761. Mr. Myers will obtain the necessary documentation for signature by the Board. In response to Commissioner Finch, Mr. Myers said the county is eligible for a rebate from Avista as a result of this project in the amount of $53,606 scheduled for the fall of 2005. 2:15 p.m. Board Business Continued/BOCC Workshop.
