CEDAR BLUFF TOWN COUNCIL MEETING MONDAY, MARCH 14, 2016 AT 5:30 PM The Town Council of the Town of Cedar Bluff, County of Cherokee, State of Alabama, met in Regular Session in the Council Room at Town Hall, 3420 Martha Vera Lane, Cedar Bluff, Alabama on Monday, March 14, 2016 at 5:30 p.m. pursuant to notice duly posted as prescribed by law. Mayor Tammy Crane presided and called the meeting to order. Members in attendance were as follows: Mayor District 1 Tammy Crane Billie Burkhalter District 2 District 3 Dewayne Agan Jerry Sprayberry District 4 District 5 Norman Burton Leatha Harp The invocation was given by Councilmember Dewayne Agan. Mayor Crane led the Pledge of Allegiance. 1. Approval of Council Minutes from February 2016 meeting The motion to approve the minutes from the February meetings was made by Councilmember Norman Burton and seconded by Councilmember Jerry Sprayberry. Motion Carried: 6-0 Aye: Agan, Burton, Burkhalter, Harp, Sprayberry, Crane 2. Financial Reports for February 2016 The financial reports were distributed to the council for their review. 3. Police Department Report for February 2016 The report was read by Chief Steve Walden as follows: Reports: Theft: 1 Domestic Violence: 2 Criminal Mis. 1 Harassment: 2 Page 1 of 5

Utility Board Lawsuit Settlement Offer Mayor Crane stated the Cedar Bluff Utility Board at the last meeting agreed to drop the lawsuit against the Town and had agreed to give the Town a quick claim deed for the water tower. In addition the Utility Board will be handling all aspects of the garbage billing. She stated the fee for them doing that would increase from 7% to 11% for the next five years. Councilmember Dewayne Agan made the motion to accept the proposal and Councilmember Leatha Harp seconded the motion. 5. New Business a. Resolution 2016-3 Surplus Property Mayor Crane stated at this time the Fire Department has a list of surplus items to be sold on govdeals. Fire Chief, Shawn Rogers read the list to the council. The resolution follows: Page 2 of 5

RESOLUTION 2016-03 WHEREAS, the Town of Cedar Bluff, Alabama, has certain items of personal property which are no longer needed for public or municipal purposes; and WHEREAS, Section 11-43-56 of the Code of Alabama of 1975 authorizes the municipal governing body to dispose of unneeded personal property; NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF CEDAR BLUFF, ALABAMA AS FOLLOWS: (SEE ATTACHED LIST OF ITEMS) SECTION 1. That the Mayor and Town Clerk be, and they hereby are, authorized and directed to dispose of the personal property owned by the Town of Cedar Bluff, Alabama, described in Section 1. ADOPTED AND APPROVED THIS 14 th DAY OF MARCH, 2016. MAYOR S.E.A.L. ATTEST: TOWN CLERK Page 3 of 5

Councilmember Norman Burton made the motion to approve Resolution 2016-03 to surplus and sale the items and Councilmember Dewayne Agan seconded the motion. 6. Old Business a. Approval of Annual Subscription Fee for Fire Department Radio System Mayor Crane asked Fire Chief, Shawn Rogers to speak to the council regarding the agreement. He stated the radio system was nearing completion. He explained the connection fee for the Town for 9 months would be $2,118.75 and that the system is scheduled to go online April 1 st. He explained as others join the system the cost will decrease. He also stated this fee was included in his budget for the year. Councilmember Dewayne Agan made the motion to approve the agreement and payment of the fee and Councilmember Norman Burton seconded the motion. 7. Citizen Comments a. Jerry Culberson Weiss Lake At this time Mayor Crane asked Jerry Culberson to take the floor. Mr. Culberson addressed the council with concerns about year round access for Weiss Lake. He also addressed the need for better facilities around the lake including the need for restrooms. b. Rickey Steel Sewell Ferry Road Potholes Mr. Steel was not present c. Gloria Thacker The Town of Cedar Bluff Mrs. Thacker addressed the Council regarding a recent article in the Post Paper that stated the funds from AT&T would be used in the park. She stated she had been unable to find where it had been done in the previous minutes. Mrs. Thacker also expressed concern regarding the grant for the recently purchased playground equipment. After the discussion became heated, at 5:59 pm Councilmember Dewayne Agan handed in his resignation letter to Mayor Crane and Councilmember Norman Burton made the motion to adjourn and Councilmember Leatha Harp seconded the motion.
