CITY OF TOLLESON CITY COUNCIL MEETING MINUTES PARK AND RECREATION CENTER 9555 WEST VAN BUREN STREET TUESDAY, MARCH 11, 2014 CALL TO ORDER 7:00 P.M. Mayor Gámez called the Regular Scheduled City Council Meeting to order at 7:00 P.M. INVOCATION/PLEDGE OF ALLEGIANCE Invocation delivered by City Attorney Ruby, and Pledge of Allegiance led by Vice Mayor Laborin. ROLL CALL Present: Mayor Gámez, Vice Mayor Laborin, Council Members Erives, Espinoza, Farr, and Rodriguez. Council Member Rodriguez attended via telephone. Absent: Council Member Mendoza. Administration: Assistant City Manager Lopez, City Engineer Gilmore, Fire Chief Good, City Clerk Hagen, Finance Director Prins, Police Chief Rodriguez, and City Attorney Ruby. FINAL CALL TO SUBMIT SPEAKER REQUEST FORMS All citizens and interested parties wishing to speak before the Council shall fully complete a Speaker Request Form and, if possible, submit the form(s) to the City Clerk, or designee prior to the meeting being convened; but in any case submissions should be made no later than the Presiding Officer announcing the Final Call to Submit Speaker Request Forms. Sufficient Speaker Request Forms are located in the lobby of the Council Chambers. All speakers will be limited to 3 minutes unless otherwise noted by the Mayor. BUSINESS FROM THE FLOOR - PUBLIC HEARINGS AND ACTION 1. Proclamation honoring World War II Veteran and Purple Heart recipient, Louis Alcocer. Mayor Gámez acknowledged Louis Alcocer and his family members that were present and gave a brief background in Mr. Alcocer's honor as a recipient of the Purple Heart Medal and his invitation to the White House by President Obama as a World War II Veteran. Mayor directed City Clerk Hagen to read the proclamation. 2. Public Hearing - Soliciting comments on a use permit as submitted by Tolleson Development Group, LLC, to allow the outdoor display of merchandise in certain areas of the proposed Tractor Supply Co. store to be located at the northeast corner (NEC) of 99th Avenue and Pierce Street, Tolleson, Arizona 85353. Public Hearing opened at 7:07 and closed at 7:11 P.M. City Engineer Gilmore reviewed the use permit application along with representative Nick Brown of Cottrell Engineering for Tractor Supply Co. The use permit is to allow outdoor displays of merchandise in designated areas on the parcel. All merchandise is paid for inside the store. This is a great use for the parcel at the northeast corner of 99th Avenue and Pierce Street. This type of store has a variety of merchandise from the sale of feed, farm supplies, and baby chicks. It will be a great addition to the community and provide many products that residents can use as they have a myriad of products for the "hobby farmer." Tractor Supply Co. has a new store in Buckeye and Wickenburg. Several additional new stores will be opening throughout the region over the next year.

Public Hearing - Soliciting comments on a site plan as submitted by Nick Brown of Cottrell Engineering for Tractor Supply Co. for a new 22,980 square foot building and forage shed and 21,253 square feet of permanent outside storage located at the northeast corner (NEC) of 99th Avenue and Pierce Street, Tolleson, Arizona 85353. (Please see recommended stipulations from City Engineer.) Public Hearing opened at 7:11 and closed at 7:16 P.M. City Engineer Gilmore and representative Nick Brown for Tractor Supply Co. acknowledged that Tractor Supply Co. is in agreement with City Engineer recommended stipulations (here within become a part of the minutes). It is estimated that approximately 35-55 employees will be hired to operate the new store. Specific hiring criteria, hours of operation, and additional details were not available at this time from Cottrell Engineering. Tractor Supply Co. will be able to answer these questions in the future. CONSENT AGENDA ACTION ITEMS a. Approve Minutes: Work Study Minutes, Special Meeting and Executive Session Minutes, and Regular Scheduled of February 25, 2014. b. Approve Claims and Bills (claims and bills submitted for approval are all claims and bills incurred no later than 24 hours prior to the Council Meeting and may be reviewed at City Hall during regular business hours). Motion made to approve Consent Agenda items a. and b. by Vice Mayor Laborin and 2nd by Council Member Farr. Motion carried 6-0. REGULAR AGENDA ACTION ITEMS PROPOSED TO BE HEARD 1. Approve/Deny a use permit as submitted by Tolleson Development Group, LLC, to allow the outdoor display of merchandise in certain areas of the proposed Tractor Supply Co. store to be located at the northeast corner (NEC) of 99th Avenue and Pierce Street, Tolleson, Arizona 85353. Motion made to approve use permit by Council Member Espinoza and 2nd by Council Member Rodriguez. Motion carried 6-0. 2. Motion carried 6-0. 3. Approve/Deny Resolution No. 2167 of the Mayor and Council of the City of Tolleson, Arizona, declaring as a public record that certain document filed with the City Clerk and entitled the "City of Tolleson City Officers Ordinance amended and restated." Motion made to approve by Vice Mayor Laborin and 2nd by Mayor Gámez. Motion carried 5-1. Council Member Rodriguez voted nay. 4. Approve/Deny Ordinance No. 521 N.S. of the Council of the City of Tolleson, Arizona, amending the Tolleson City Code, Chapter 2, Administration, relating to vacancies in Council and the appointment and duties of city officers. This ordinance changes the finance director title to chief financial officer and allows for the city manager to appoint the assistant city manager and/or any other director as the acting city manager when he is out of town. Motion made to approve by Vice Mayor Laborin and 2nd by Council Member Erives. Motion carried 6-0. 5. Approve/Deny Ordinance No. 537 N.S. of the Council of the City of Tolleson, Arizona, authorizing the exchange of certain real property with Rados Properties- Arizona Land LLC, a Delaware limited liability company; and declaring an emergency. Motion made to approve Ordinance No. 537 N.S. by Vice Mayor Laborin and 2nd by Council Member Erives (authorizing an exchange of property between the City of Tolleson and Rados Properties to properly align their parcel lines by Tolleson realigning our well site). Motion carried 6-0. CITY MANAGER S REPORT OF CURRENT EVENTS 1. Victoria Prins, Finance Director - Arizona Municipal Risk Retention Pool 'Award of Excellence' certificate. Finance Director Prins presented the gold 'Award of Excellence' to Mayor and Council which is top recognition and one that we do not receive every year. Assistant Manager Lopez gave an update on the Friday, March 14th Tolleson Boys and Girls Club 27th Annual Golf Tournament; the first Movies in the Park
Page 5 of 5 on Friday, March 14 th ; the City Employee Picnic at Veterans Park on Saturday, March 15 th ; as well as the upcoming annual Whoopee Daze celebration and the VFW Easter Egg Hunt.
