6/21/2016 City of San Juan Capistrano Agenda Report F7 TO: FROM: SUBMITTED BY: Honorable Mayor and Members of the City Council Ben Siegel, City Manager ~t"'qft, Maria Morris, City Clerk j.mv\1\ DATE: June 21, 2016 SUBJECT: Consideration of Calling a By-District General Municipal Election for November 8, 2016, for the Purpose of Electing Two City Council Members RECOMMENDATION: By motion, adopt the following Resolutions related to calling a By-District General Municipal Election to be held November 8, 2016: (1) Calling and giving notice of the election; and, (2) Requesting consolidation with Statewide Elections; and, (3) Authorize the City Clerk to insert the two Districts up for election to the Resolutions, subject to the City Council selection at the June 21, 2016, public hearing. EXECUTIVE SUMMARY: The City of San Juan Capistrano has transitioned from at-large elections to by-district elections starting with the November 8, 2016, General Municipal Election. The City's elections are consolidated with statewide elections, the first Tuesday in November of the election year. This process allows the City to contract for election services with the Orange County Registrar of Voters, realizing significant savings over the City conducting the election separately. A By-District General Municipal Election is scheduled for Tuesday, November 8, 2016, for the election of two (2) City Council Members for the seats currently held by Council Member Allevato and Council Member Perry. The City Council will be holding a public hearing on June 21, 2016, to select the two Districts for the November 8, 2016, General Municipal Election. Staff recommends that the City Council adopt the necessary resolutions to call the election, request the County to conduct the election consolidated with the Statewide Election that will take place on November 8, 2016; and direct the City Clerk to insert the two Districts up for election to the Resolutions, subject to the City Council selection at the June 21, 2016, public hearing.

FISCAL IMPACT: The cost to conduct a by-district election is based on the number of registered voters per district; therefore, the estimated cost will be determined once the Registrar of Voters has the final district map. ENVIRONMENTAL REVIEW: Not applicable. PRIOR CITY COUNCIL REVIEW: Not applicable. COMMISSION/COMMITTEE/BOARD REVIEW AND RECOMMENDATIONS: This item does not go through the Commission review process. NOTIFICATION: Information about the November 8, 2016, By-District General Municipal Election will be provided on the City's website. The City Clerk will also publish all election notices, both in English and Spanish, timed to meet the requirements of the State's Elections Code. In addition, the City Clerk's Office works closely with the Registrar of Voters to provide voter outreach and minority language instructions for those voters that speak designated minority languages pursuant to the requirements of the Federal Voting Rights Act. RESOLUTION NO. 16-06-21-x A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION ON TUESDAY, NOVEMBER 8, 2016, FOR THE ELECTION OF CERTAIN OFFICERS AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO RESOLVES, DECLARES, DETERMINES, AND ORDERS AS FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to General Law Cities, there is called and ordered to be held in the City of San Juan Capistrano, California, on Tuesday, November 8, 2016, a General Municipal Election for the purpose of electing two (2) Members of the City Council for the full term of four years, for Districts 1 and. SECTION 2. That the ballots to be used at the election shall be in form and content as required by law. SECTION 3. That the City Clerk is authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. SECTION 4. That the polls for the election shall be open at seven o'clock a.m. of the day of the election and shall remain open continuously from that time until eight o'clock p.m. of the same day when the polls shall be closed, except as provided in Section 14401 of the Elections Code of the State of California. SECTION 5. That in all particulars not recited in this Resolution, the election shall be held and conducted as provided by law for holding municipal elections. SECTION 6. That notice of the time and place of holding the election is given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in time, form and manner as required by law. SECTION 7. That in the event of a tie vote (if any two or more persons receive an equal and the highest number of votes for an office) as certified by the County of Orange Registrar of Voter, the City Council, in accordance with Elections Code 15651 (a), shall set a date and time and place and summons the candidates who have received the tie votes to appear and will determine the tie by lot. SECTION 8. That the City Council authorizes the City Clerk to administer said election and all reasonable and actual election expenses shall be paid by the City upon presentation of a properly submitted bill. SECTION 9. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions. RESOLUTION NO. 16-06-21- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF ORANGE TO CONSOLIDATE A GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 8, 2016, WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON THAT DATE PURSUANT TO SECTION 10403 OF THE ELECTIONS CODE WHEREAS, the City Council of the City of San Juan Capistrano called a General Municipal Election to be held on November 8, 2016, for the purpose of the election of two (2) Members of the City Council, for Districts 1 and for the full term offour (4) years; and WHEREAS, it is desirable that the General Municipal Election be consolidated with the Statewide General Election to be held on the same date, and that within the City the precincts, polling places and election officers of the two (2) elections to be the same, and that the Orange County Registrar of Voters canvass the returns of the General Municipal Election and that the election be held in all respects as if there were only one (1) election. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That Pursuant to the requirements of Section 10403 of the Elections Code, the Board of Supervisors of the County of Orange is hereby requested to consent and agree to the consolidation of a General Municipal Election with the Statewide General Election on Tuesday, November 8, 2016, for the purpose of electing two (2) Council Members of the City Council for Districts 1 and _ for the full term of four (4) years SECTION 2. That the Orange County Registrar of Voters is authorized to canvass the returns of the General Municipal Elections and the elections shall be held in all respects as if there were only one election, and only one form of ballot shall be used. The Election will be held and conducted in accordance with the provisions of law regulating the statewide election. SECTION 3. That the Board of Supervisors is requested to issue instructions to the Orange County Registrar of Voters to take any and all steps necessary for the holding of the consolidated election. SECTION 4. That the City of San Juan Capistrano recognizes that additional costs will be incurred by the County by reason of this consolidation and agrees to reimburse the County for costs related to the General Municipal Election. SECTION 5. That the City Clerk is hereby directed to file a certified copy of this Resolution with the Board of Supervisors and the Orange County Registrar of Voters of the County of Orange.
