SAN GABRIEL CITY COUNCIL MINUTES OF A REGULAR CITY COUNCIL MEETING TUESDAY, JULY 7, 2015 1. CALL TO ORDER Mayor Pu called the regular meeting of the San Gabriel City Council to order at 7:30 p.m. on Tuesday, July 7, 2015, in the Council Chambers at City Hall, 425 South Mission Drive, San Gabriel, California, 91776. 2. PLEDGE OF ALLEGIANCE Councilmember Sawkins led the Pledge of Allegiance. 3. ATTENDANCE: COSTANZO, HARRINGTON, LIAO, PU, SAWKINS Present: Mayor Pu, Vice Mayor Liao, Councilmembers Costanzo, Harrington, and Sawkins; Acting City Manager Marlowe, City Attorney Kress, and Assistant City Clerk Bravo-Valdez. 4. PRESENTATION: A. Proclamation of Parks Make Life Better Month July 2015 Mayor Pu and the City Council presented a proclamation to Community Services Director Rebecca Perez for Parks Make Life Better month. 5. PUBLIC COMMENT: This is the time set aside for members of the public to address the City Council on items of interest that are not on the agenda, but are within the subject matter jurisdiction of the San Gabriel City Council or items appearing on the consent calendar. The City Council values your comments; however, pursuant to the Brown Act, the City Council cannot answer any questions or take any action until such time as the matter may appear as an item on a future agenda. The Council will refer matters as appropriate to the responsible department for research, response or to provide further information. MINUTES OF REGULAR COUNCIL MEETING OF JUNE 16, 2015 The minutes are a record of the official actions taken at the last Council meeting. C. MATERIAL DEMANDS This is the presentation of the Register of Demands and Warrants for the payment of City expenditures. D. FIRST AMENDMENT TO LEASE AGREEMENT WITH VERIZON WIRELESS DEL MAR PARK AND RIDE LOT CELL ANTENNA The City Council will consider approving the First Amendment to Lease Agreement with Verizon Wireless for a leased space at the Del Mar Park and Ride Lot for a cellular antenna. Staff recommends that the City Council approve the First Amendment to Ground Lease Agreement and authorize the Mayor to sign the documents on behalf of the City. 7. PUBLIC HEARING: A. ACQUISITION OF RIGHT OF WAY REQUIRED FOR THE SAN GABRIEL BOULEVARD AT MISSION ROAD INTERSECTION IMPROVEMENT PROJECT; RESOLUTION OF NECESSITY (RESOLUTION NO. 15-06) PUBLIC HEARING CONTINUED FROM JUNE 2, 2015 MEETING Staff recommends that the City Council conduct the hearing on the necessity of acquiring right of way and a temporary construction easement for the Mission Road Intersection Improvement Project from Chinese Christian Herald Crusaders, Inc. (Crusaders); adopt Resolution No.15-06; and authorize staff to acquire other rights of way needed to construct the project. On June 2, 2015, City Council voted to open and continue the public hearing to July 7, 2015, pursuant to a request from the Crusaders for more time to work with staff on the issue. Staff recommends that the City Council: 1. Conduct a hearing on the Resolution of Necessity (Resolution No.15-06); 2. Adopt the Resolution of Necessity, Resolution No. 15-06, (super majority vote required); 3. Approve the updated appraisal and offer made to the Chinese Christian Herald Crusaders, Inc. and authorize acquisition of the property for that amount; 4. Approve using the same updated land value for acquisition of the three other required properties and authorize staff to make offers for and to acquire those properties for those amounts; 5. Authorize the City Engineer to sign the Appraisal Summary Statements on behalf of the City; and 6. Approve the expenditure of funds in the amount of $156,949 for the acquisition of the properties (account numbers 122-800-41-97-707, 122-800-50-97-707, 122-800-58-97-707, and 122-800-40-97-707). Senior Civil Engineer Algis Marciuska and Deputy City Attorney Peter Wallin presented the staff report. Mayor Pu opened the public hearing; there being no public comments the public hearing was closed immediately thereafter. 8. NEW BUSINESS: A. APPROVAL OF AGREEMENTS AND GRANTING/ACCEPTANCE OF EASEMENTS FOR MISSION WALK TRACT NO. 72626 TRAIL (RESOLUTION NOS. 15-15, 15-16, AND 15-17) The City Council will consider approving Agreements and Granting/Acceptance of Easements for Mission Walk Tract No. 72626 Trail including Resolution Nos. 15-15, 15-16, and 15-17. Numerous negotiations were held between the City, the Olson Company and the San Gabriel Valley Humane Society to finalize agreements, easements, and legal documents to make the open space and trail a reality for the Mission Walk project and surrounding neighborhood. Staff recommends that the City Council adopt Resolution Nos. 15-15, 15-16, & 15-17 and authorize the City Manager to execute the agreements and submit the required documents to the County for recording. Senior Civil Engineer Algis Marciuska and Deputy City Attorney Peter Wallin presented the staff report. Councilmember Costanzo moved, seconded by Councilmember Sawkins, to approve the recommended action. Motion passed by a vote of 5 ayes, 0 B. DECLARATION OF RESTRICTIONS ARCHEOLOGICAL SITE EASEMENTS SAN GABRIEL TRENCH PROJECT, MISSION ROAD AT RAMONA STREET The City Council will consider approving a Declaration of Restrictions along with Archeological Site Easements to protect cultural resources and prohibit excavation or other underground disturbances within two areas of Mission Road without written authorization from the City Manager. Staff recommends that the City Council approve the Declaration of Restrictions and authorize the Mayor to sign the Declaration of Restrictions and authorize submittal of the Declaration and Easement documents to the County for recording. Public Works Director/City Engineer Daren Grilley presented the staff report. Vice Mayor Liao moved, seconded by Councilmember Costanzo, to approve the recommended action.
