At the federal district court, the judge told Dr. Yue to "cease and desist" from filing papers. The following was the exchange afterwards (transcript): DR. After Dr. Yue sued Sun Microsystems and StorageTek for stealing his software, the judge quickly dismissed his case without leave to amend and before defendants filed any responsive pleading. Dr. Yue now appeals to the Ninth Circuit (Case Number 08-15927). Dr. Yue believes that oral argument should be held because he was denied in his day in the federal district court and he should be given the opportunity to argue his cause before the judges of the court of appeal.
