CITY OF IOWA FALLS REGULAR MEETING JUNE 18, 2012 The Mayor and City Council of the City of Iowa Falls met in regular session on Monday, June 18, 2012 with Mayor Jerrold Welden presiding over the meeting. Council Members David Hampe, Kurt Knudson, Mark Messa, Roger Nissly and Bruce Thies were present. Also present was City Manager Jody Anderson. ACCEPTANCE OF THE AGENDA Knudson moved and Hampe seconded to accept the agenda written with the removal of the Cigarette Permits from the Consent Agenda. Vote: Knudson, Hampe, Thies and Messa voting aye, Nissly voting no. APPROVAL OF MINUTES Thies moved and Knudson seconded to approve the minutes of the regular meeting of May 21, 2012 and special meeting of June 4, 2012. Vote: Thies, Knudson, Nissly, Messa and Hampe voting aye. APPROVAL OF MONTHLY CLAIMS Hampe moved and Messa seconded to approve the monthly claims. Roll Vote: Hampe, Messa, Nissly, Knudson and Thies voting aye. CONSENT AGENDA Thies moved and Nissly seconded to approve the Consent Agenda as follows: 1. Liquor Licenses a. Class B Beer Permit for Iowa Falls Chamber of Commerce Main Street. b. Special Class C Liquor License (Beer/Wine) for Q2. 2. Ellis Avenue Project Pay Request No. 4 to Geislinger & Sons in the amount of $534,657.36. 4. Tax Abatement Application Tax Abatement Application from Lyle and Tina Schlemme.

5. Panther Pride Triathlon a. Resolution No. 2012-26 closing Pine Street from River Road to River Street and Cedar Street from Pine Street to Elm Street on August 11, 2012 for the entire day. b. Request from Ellsworth Community College for the route for the Panther Price Triathlon on August 11, 2012. 6. Riverbend Rally Run/Walk and Bill Riley Memorial Bike Ride a. Route for the 5K and 8K Run/Walk at 8:00 a.m. on Wednesday, July 4th. b. Route for the Bill Riley Memorial Bike Ride at 2:00 p.m. on Saturday, June 30th. Roll Vote: Thies, Nissly, Messa, Hampe and Knudson voting aye. 3. Cigarette Permits Hampe moved and Knudson seconded to approve the cigarette permits for the following: Buy Local Buy Cheap Railroad Street Tobacco & Spirits, Casey s General Stores at 1225 N Oak, 1801 Washington Avenue and 904 Washington Avenue, Fareway, Handi-Stop Food Mart, Hy- Vee Food Store, Rock C Store, and Wal-Mart Store. Roll Vote: Hampe, Knudson, and Messa voting aye, Thies and Nissly voting no. OLD BUSINESS 7. Project AWARE Lynnette Seigley with the Iowa Department of Natural Resources gave the Council an update on the Iowa River cleanup. 8. Georgetown Road Trail Project a. One bid was received; it was from Heartland Asphalt in the amount of $263,398.73. b. Knudson moved and Hampe seconded to award the contract to Heartland Asphalt in the amount of $263,398.73. Roll Vote: Knudson, Hampe, Thies, Nissly and Messa voting aye. 9. Codes a. Hampe moved and Thies seconded to approve on second reading an Ordinance amending the Code of Ordinances of the City of Iowa Falls, Iowa, by amending the International Building Code.

b. Hampe moved and Knudson seconded to approve suspension of the rules and placing on third and final reading. Roll Vote: Hampe, Knudson, Thies, Messa and Nissly voting aye. c. Messa moved and Knudson seconded to approve on third and final reading Ordinance No. 1016 amending the Code of Ordinances of the City of Iowa Falls, Iowa, by amending the International Building Code. Roll Vote: Messa, Knudson, Thies, Hampe and Nissly voting aye. d. Nissly moved and Messa seconded to approve on second reading an Ordinance amending the Code of Ordinances of the City of Iowa Falls, Iowa, by amending the International Fire Code. Roll Vote: Nissly, Messa, Hampe, Thies and Knudson voting aye. e. Messa moved and Hampe seconded to approve suspension of the rules and placing on third and final reading. Roll Vote: Messa, Hampe, Thies, Knudson and Nissly voting aye. f. Hampe moved and Thies seconded to approve on third and final reading Ordinance No. 1017 amending the Code of Ordinances of the City of Iowa Falls, Iowa, by amending the International Fire Code. g. Knudson moved and Thies seconded to approve on second reading an Ordinance amending the Code of Ordinances of the City of Iowa Falls, Iowa, by amending the Uniform Plumbing Code. Roll Vote: Knudson, Thies, Hampe, Messa and Nissly voting aye. h. Messa moved and Nissly seconded to approve suspension of the rules and placing on third and final reading. Knudson moved and Hampe seconded to approve on third and final reading Ordinance No. 1018 amending the Code of Ordinances of the City of Iowa Falls, Iowa, by amending the Uniform Plumbing Code. Nissly moved and Knudson seconded to approve on third and final reading Ordinance No. 1019 amending the Code of Ordinances of the City of Iowa Falls, Iowa, by amending the International Mechanical Code. Roll Vote: Nissly, Knudson, Thies, Hampe and Messa voting aye. m. Thies moved and Messa seconded to approve on second reading an Ordinance amending the Code of Ordinances of the City of Iowa Falls, Iowa, by amending the National Electrical Code Roll Vote: Thies, Messa, Nissly, Knudson and Hampe voting aye. n. Hampe moved and Knudson seconded to approve suspension of the rules and placing on third and final reading. Roll Vote: Hampe, Knudson, Thies, Nissly and Messa voting aye. o. Messa moved and Knudson seconded to approve on third and final reading Ordinance No. 1020 amending the Code of Ordinances of the City of Iowa Falls, Iowa, by amending the National Electrical Code. Roll Vote: Messa, Knudson, Thies, Hampe and Nissly voting aye. 10. Building Code The Ordinance amending the Code of Ordinances of the City of Iowa Falls, Iowa, by amending provisions pertaining to the International Building Code died for lack of a motion. 11. Dogs a. The Council reviewed the appeal from Ranella Rose. Hampe moved and Messa seconded to deny the appeal. Vote: Hampe, Messa, Nissly, Knudson and Thies voting aye. b. Thies moved and Nissly to approve on second reading an Ordinance amending the Code of Ordinances of the City of Iowa Falls, Iowa, by adding to the Vicious Animal Definition. Roll Vote: Thies, Nissly, Messa, Hampe and Messa voting aye. c. Messa moved and Nissly seconded to approve suspension of the rules and placing on third and final reading. Roll Vote: Messa, Nissly, Knudson, Thies and Hampe voting aye. d. Hampe moved and Thies seconded to approve on third and final reading Ordinance No. 1021 amending the Code of Ordinances of the City of Iowa Falls, Iowa, by adding to the Vicious Animal Definition. e. The Council discussed recent dog attacks.

NEW BUSINESS 12. Request to Purchase Property a. The Council reviewed the request from Mark Butler to purchase the property located at 313 West 2nd Street for $250.00. b. Knudson moved and Thies seconded to approve Resolution No. 2012-27 tentatively approving sale of city property 2consisting of real property identified as Lot 4, Block 26 and the alley south of and adjacent thereto in Rocksylvania Addition to the City of Iowa Falls, Hardin County, Iowa, changing the 90 day time frame to 180 days. Roll Vote: Knudson, Thies, Hampe, Messa and Nissly voting aye. 13. Digester Covers Thies moved and Nissly seconded to approve the Change Order for the stainless steel digester slides with the price not to exceed $16,000.00. Roll Vote: Thies, Nissly, Messa, Knudson and Hampe voting aye. 14. Sanitation Trucks No action was taken on additional equipment for the new sanitation trucks. 15. Audit Services Messa moved and Knudson seconded to approve the proposal for audit services from Cornwell, Frideres, Maher & Associates, PLC for a three year period. Vote: Messa, Knudson, Thies, Hampe and Nissly voting aye. 16. Salary Resolution Thies moved and Hampe seconded to approve Resolution No. 2012-28 approving the 2012-2013 salaries changing Jody Anderson to Roger Nissly in the Council section. Roll Vote: Thies, Hampe, Messa, Nissly and Knudson voting aye. 17. Recreational Trail HMA Paving Hampe moved and Knudson seconded to approve the Statement of Completion Division 2 (REAP). Vote: Hampe, Knudson, Thies, Nissly and Messa voting aye. 18. City Bonding Capacity Scott Stevenson discussed with the Council the City s bonding capacity and the CIP.

19. Appointments a. Messa moved and Knudson seconded to approve the appointment of Warren Broman to the Planning & Zoning Commission for a term to expire May of 2017. Vote: Messa, Knudson, Thies, Hampe and Nissly voting aye. b. No appointment was made to the Board of Adjustment. c. Messa moved and Knudson seconded to approve the appointment Mona Bowden to the Airport Authority Board for a term to expire July 2016. Vote: Messa, Knudson, Thies, Hampe and Nissly voting aye. Knudson moved and Hampe seconded to approve the appointment of Sue McDowell to the Airport Authority Board for a term to expire July 2016. Vote: Knudson, Hampe, Thies, Nissly and Messa voting aye. d. No appointment was made to the Library Board. ADJOURNMENT Nissly moved and Knudson seconded to adjourn. Vote: Nissly, Knudson, Thies, Hampe and Messa voting aye.
