Forum: Fifth Committee of the General Assembly Issue: Financing of the United Nations administrative mission in Kosovo (UNMIK) Student Officer: Mohamed Mohsen Position: Deputy Chair Introduction The United Nations Interim Administration Mission in Kosovo (UNMIK), was initially put in place in order to help the Security Council achieve an overall objective, namely, to ensure conditions for a peaceful and normal life for all inhabitants of Kosovo and advance regional stability in the western Balkans. The mission was made as a result of Security Council Resolution 1244, it was intended to offer a secure and civil presence. Initially, UNMIK was dearly needed in the aftermath of the Kosovo war in order to setup a secure government and ensure peace and civility, now the UNMIK has fairly minor day to day operations as Kosovo has declared independence and signed into law a new constitution. However, there is still tension regarding Kosovo s independence, as Serbia and other countries refuse to recognize the independence of Kosovo. The territorial dispute between the Serbian government and the ethnically Albanian population of Kosovo has yet to be resolved, even as 113 of 193 member states of the United Nations have recognized Kosovo as an independent state - a clear majority of European countries being within those ranks of those recognizing the independence of Kosovo. 1 That being said, the majority of the duties of the UNMIK are done under the auspices of, or in Research Report Page 1 of 10 1 A Review of NATO's War Over Kosovo. tandem with, the European Rule of Law Mission in Kosovo (EULEX); indeed, there were even plans for all the duties of the UNMIK to be handed over to EULEX, but following the Russian Federation s opposition to Kosovo s unilateral declaration of independence, Secretary General Ban Ki-Moon decided to redesign the mission and extend it temporarily. Currently, UNMIK still does police areas of Kosovo and ensure the rule of law, offering a presence of peace and civility. The approved budget listed on the UNMIK s website is for the 2015 2016 period, and is listed as $40,031,000, many more funds have been invested since then into the mission. Definition of Key Terms Declaration of Independence A declaration of independence is when a country unilaterally claims that is independent from another body or country. Kosovo declared its independence from Serbia in 2008, in a move that the Assembly of Kosovo unanimously voted for. Interim Administration A provisional body to aid with the management of day-to-day public affairs and the enforcement of the rule of law and civility. Kosovo War The Kosovo War was an armed conflict between the Kosovo Liberation Army (KLA) and the forces of the Federal Republic of Yugoslavia (at this time this consisted of Serbia and Montenegro). The Kumanovo Treaty ended the war, with Yugoslav and Serb forces withdrawing from Kosovo, in order for international forces to take their place. Ethnically Albanian The Albanians are an ethnic group mostly in the Balkans, they share a common ancestry and culture different to that of Serbs who also occupy some of the same area in Kosovo. Occasionally, there is ethnic violence that flares up as a result of conflict between the two groups. Special Representative of the Secretary General A special representative of the Secretary General is a a respected expert designated by the Secretary General to represent their interests in meeting with heads of state on human rights and other issues. The Special Representative is the head of the UNMIK. Research Report Page 2 of 10

Outstanding Assessed Contribution Assessed contribution are the dues countries pay as part of their memberships of the United Nations. An outstanding assessed contribution is one that has yet to be paid. UN Peacekeeping Assessed Budget Article 17 of the UN Charter states that every Member State should contribute to peacekeeping missions around the world one way or another. Delegates should keep in mind that the assessed budget is an integral part of an effective GA5 resolution, taking into account the scope and resources required for the missions they are funding before assigning a carefully considered value for budgets. Delegates should also take care to apportion the budgets correctly, though contributions already take into account the respective economic situations of member states. Background Information The Kosovo Liberation Army (KLA) was an ethnically Albanian paramilitary group that sought the separation of Kosovo from the rest of the Federal Republic of Yugoslavia. In 1998, they began to attack Yugoslav outposts frequently. In acts of retribution, Yugoslavian paramilitary forces began to target KLA sympathizers as well as political opponents. The retribution exacted my Yugoslav forces resulted in the deaths of 1500-2000 civilians, as a result, NATO became involved in order to limit the humanitarian damage done. The Yugoslav government committed egregious acts of terror, murder and rape throughout the campaign. A UN security presence was direly needed, and so, Security Council Resolution 1244 was passed, asking Yugoslav forces to withdraw from Kosovo to make way for international forces, the UNMIK was also established in the resolution. The Mandate of the UNMIK as established in Resolution 1244 The resolution initially mandated that the United Nations Interim Administration Mission in Kosovo (UNMIK) was to ensure that citizens of Kosovo could enjoy substantial autonomy within the Federal Republic of Yugoslavia, providing a provisional administration. The UNMIK was designed to allow citizens of Kosovo to live peacefully without fear of conflict, as an extension of the international presence in Kosovo. Research Report Page 3 of 10

The Role of the UNMIK Today Most of the administrational duties of the UNMIK today have been handed over to EULEX. The group has fairly minor operations but still has a security presence within Kosovo. The UNMIK is heavily criticized by Kosovans, as it has failed to complete a number of its goals. For instance, key infrastructure within Kosovo has yet to be constructed, the UNMIK has been slow to transfer its responsibilities to Kosovan institutions, it has failed to implement an effective economic development strategy and the mission has failed to eliminate parallel structures in government - meaning there exists two branches of certain areas of government which fulfill the same duty. The criticism could prompt some to wonder about the redundancy of the UNMIK, though occasional ethnic violence occurs, Kosovo is now independent and its citizens enjoy autonomy from Serbia; nevertheless, Ban Ki Moon decided to extend the provisional status of the UNMIK because of refusal from the Russian Federation and the Republic of Serbia in recognizing Kosovo as an independent state. recognize Kosovo as an independent country. Among those who oppose the declaration of independence are the Republic of Serbia and the Russian Federation. This opposition perhaps breathed new life into the otherwise fading role of the UNMIK, which was redesigned in order to accommodate the new reality of Kosovo s situation. Russia s opposition to an Independent Kosovo Even before Kosovo had declared itself independent of Serbia, Russian Ambassador to the UN, Vitaly Churkin, said that Kosovo would not become members of the United Nations, they would not become members of international political institutions if they go down the road of unilateral declarations." Russia is adamant on the issue of Kosovo as they believe its independence would set a dangerous precedent for ethnically distinct regions in Russia. The UNMIK s presence could therefore be seen as justified, as with such strong international forces opposing the independent state, some would say there is a need for the international security presence the UNMIK provides. UNMIK Funding For the 2017-18 period, only 33 member states of the United Nations had paid their assessed contributions for the UNMIK. Additionally, there is an amount of 92.8 million United States Dollars - 4 percent of the total assessed contributions - that has yet to be paid. The UNMIK suffers from member states who have yet to pay their assessed contribution, and in the official budget report for the Secretary General for the 2017-18 period, the report stressed that a lack of logistics had resulted in an inefficient use of funds, for the 17-18 period, the budgetary committee allocated an additional 40.29 million United States Dollars to the mission. Major Countries and Organizations Involved EULEX (European Union Rule of Law Mission in Kosovo) The European Union Rule of Law Mission is Kosovo is the presence of the European Union(EU) police and civilian assets in Kosovo, it is part of the international security presence in Kosovo meant to ensure Kosovo s citizens enjoy safety and security. EULEX is an mission subjected to UNMIK, the two organisations work closely in tandem to achieve largely similar goals. The EULEX mission has recently received a new mandate until 2020. civilian mission under the Common Security and Defence Policy of the European Union. The Russian Federation The Russian Federation has vehemently opposed the independence of Kosovo due to the precedent it sets. Many speculate that if they allow Kosovo to achieve independence then several other ethnically distinct regions of Albania it is thus directly involved within the conflict as the member state heightens the contention surrounding the issue of an independent Kosovo, the UNMIK being a humanitarian and diplomatic mission must seek to resolve such tension. The Republic of Serbia The Republic of Serbia also refuses to recognize Kosovo as an independent state, indeed, the UNMIK was established because of the former Yugoslavia s humanitarian crimes resulting from a paramilitary movement fighting for an independent Kosovo. Serbia - being whats left of Yugoslavia - still opposes an independent Kosovo, despite a clear majority of Kosovars agreeing with the country s independence. Timeline of Events Date February 1998 Description of Event The Kosovo War between the KLA and the former Yugoslavia kicks off, as Yugoslav forces exact retribution of KLA sympathisers following the targeting of Yugoslav forces by the KLA. June 10th 1999 The UN Security Council passes Resolution 1244, establishing the an international presence in Kosovo and forming the United Nations Interim Administration Mission in Kosovo (UNMIK). The mission is designed to provide Kosovar citizens with safety and security in the aftermath of egregious human rights abuses committed by the former Yugoslav forces. The UNMIK acts as a transitional administration until Kosovo can govern itself. Research Report Page 6 of 10

June 11th 1999 The Kosovo War officially ends after Yugoslavia agrees to withdraw from Kosovo to make way for international forces, which allows missions such as the UNMIK to go into Kosovo and maintain safe and secure conditions. January 16th Russian Ambassador to the UN announces they would not allow an independent Kosovo to join international organisations February 17th Kosovar Assembly unilaterally declares independence from Serbia, Russian opposition to declaration causes Secretary General Ban Ki Moon to reconfigure the mission. Relevant UN Treaties and Events On the situation relating Kosovo, June 10th 1999 (S/RES/1244) Budget for the United Nations Interim Administration Mission in Kosovo for the period from 1 July 2017 to 30 June 2018 : report of the Secretary-General, 23 Jan. 2017 On the situation in Kosovo, October 24th 1988 (S/RES/1203) Financing of the United Nations Interim Administration Mission in Kosovo, July 5th 2018 (A/RES/72/295) Previous Attempts to solve the Issue The United Nations Fifth Committee of the General Assembly has passed a host of resolutions pertaining to the funding of the UNMIK, some of them trying to address the issue of member states not paying their assessed contributions - their attempts include re-apportioning assessed contributions. Regarding the scope of the UNMIK and redundancies regarding its role alongside EULEX, though its responsibilities were meant to be handed off to EULEX, the UNMIK was kept in the face of Russian opposition to Kosovo s Independence. Possible Solutions Delegates could try to address the failure of member states to pay their assessed contributions by heightening penalties on member states who have failed to pay their contributions for an extended period of time. For instance, further restrictions on voting power and influence within the UN. Additionally, to address possible redundancies with regard to the role of the UNMIK, they could choose to limit the scope - and by extension the funding - of the UNMIK. Delegates should carefully consider which duties intersect between UNMIK and EULEX and make appropriate considerations for any solutions they put forth. In order to fully make the UNMIK redundant, delegates could repurpose the mission or allocate more funding towards diplomatic efforts to reach sustainable agreements with the Russian Federation and the Republic of Serbia; this should include efforts to defuse residual tension between the ethnically Albanian population of Kosovo and the Serb minority that is in favor of a united Serbia. Delegates could also consider keeping the existing UNMIK budget in place but re-allocating the budget. If delegates feel that the budget should be kept but more funding should be allocated to diplomatic personnel rather than the security forces present currently, then they can reflect this in their resolutions. Delegates should pay careful attention to existing resolutions regarding the mission passed by the fifth committee of the General Assembly in order to assess what hasn t worked in the past in the way of potential solutions to the issue of financing the mission.
