SWAIN, Commissioner LANCE GOUGH, Executive Director Doc_10 PROCESSING, COUNTING AND TABULATING EARLY VOTING AND GRACE PERIOD VOTING BALLOTS 1. Early voting and grace period voting shall be conducted on a touchscreen voting device called an Edge 2 Plus, or E2P. 1 Voters using a touchscreen device mark their candidate or proposition choices on the touchscreen and then submit the ballot by pressing cast ballot on the touchscreen. The touchscreen device records the ballot and the voters choices. The votes are stored electronically on several locations on the E2P, including on a USB compatible flash drive or memory stick. 2 2. Prior to the start of early voting and grace period voting, the Board s warehouse shall provide to the IT Department a list of E2P units that will be used for early voting and grace period voting, along with the serial number and location of each unit. The Board shall create files in WinEDS 3 that serve as place-holders, or buckets, to receive vote data stored on the memory stick. A bucket shall be created for each memory stick used in each early voting and grace period voting E2P unit expected to be in service. Vote data on each memory stick can only be deposited in its own pre-assigned bucket on WinEDS. 3. At the end of each day of early and grace period voting, each Early Voting Site shall send to the Board s IT Department a hand-written report called the Daily Ballot Statement, 4 which lists the number of votes on a given E2P unit. The IT Department staff will manually enter all data from the Daily Ballot Statement into a spreadsheet. 4. If an early voting or grace period E2P unit incurs a problem or error such that it cannot continue in service, the error shall be noted and documented on the Daily Ballot Statement. The Early Voting Site administrator shall send the memory stick for the affected unit to the Early Voting Supervisor after properly securing and sealing the stick and recording it on a Returned Early Voting Materials Statement. The Returned Early Voting Materials Statement must be completed and signed by the EV Supervisor, the EV Transportation Deputy and the Board employee responsible for sorting, inventorying and 1 Section 19A-75 of the Code (10 ILCS 5/19A-75) permits election authorities to use what is called direct recording electronic voting systems, or touchscreen voting, to conduct early voting. 2 Memory sticks perform three functions. First, they copy the election configuration the files that tell the E2P how to work (contests, candidates, ballot styles, etc.) onto the E2P. Second, they store encrypted vote data. Third, at the conclusion of voting, they are used to transfer the encrypted vote data from the E2P to the WinEDS software residing on the Board s central tabulation server. For this last function, the memory stick is nothing more than an electronic file cabinet it does not calculate, sort, total or change the data on the stick. 3 WinEDS is the core application and database used by the Board to manage the election process. Its functionality includes election setup (defines the precincts, contests, candidates, etc. for the election), precinct assignment, ballot management, cartridge (or memory stick) management and vote tally. 4 The Daily Ballot Statement has columns for Early Voting officials to list the touchscreen voting unit serial number for each machine, the results cartridge & seal serial numbers, the public counter opening count, the public counter closing count and the daily ballot count, as well as other miscellaneous information. securing the memory stick. An EV Supervisor will transfer the memory stick to the IT Department using a Transfer of Early Vote Results Cartridge Statement. Any such memory stick shall then be locked in a transfer case until after the conclusion of early/grace period voting. 5. During early and grace period voting, vote data on the E2Ps are encrypted and copied to memory sticks. At the conclusion of early and grace period voting, Early Voting officials shall place these memory sticks in a sealed bankers bag, secure the bankers bag in a larger container (which is also sealed) and deliver the container to the Board s IT Department. A three-part Returned Early Voting Materials Statement shall be prepared by the Early Voting Site administrator listing, among other items, the E2P memory sticks for each unit and the container seal numbers. Persons designated to transport the materials and to receive the materials at the Board s central office are required to sign the Statement verifying transport and receipt of the same. The IT Department shall secure all memory sticks until they are ready to be processed. 6. Beginning at 7:00 P.M. on the Monday before Election Day, all E2P memory sticks used for early voting and grace period voting at all early voting sites shall be unsealed by two Board employees, audited and the encrypted contents thereof copied to a table file within WinEDS in the manner set forth below. A comparison shall be made between the memory sticks in the sealed pouches and memory sticks shown on the Daily Ballot Statement spreadsheet. If there is a memory stick that cannot be accounted for, the cause shall be determined and appropriate action taken. The encrypted contents of each memory stick, including defective memory sticks, shall be copied to its corresponding bucket within a table file within WinEDS. As the encrypted contents of each memory stick are copied to WinEDS, each stick shall be audited to see whether the stick contents can be copied to the WinEDS file. Board staff must determine if there is a discrepancy or apparent discrepancy and why. (a) (b) If a bucket was created for an E2P on the initial list provided by the warehouse, but that E2P was never used, the extra bucket created to hold results data for that E2P shall be removed from WinEDS. If an E2P was used but it was not on the initial list from the warehouse (thus no bucket exists into which to copy the results data), the existence of the E2P needs to be confirmed by the Daily Ballot Statement and an additional bucket must be created. (c) If a memory stick cannot be copied to WinEDS due possibly to hardware malfunction, the Board shall obtain an audit trail report 5 from the E2P. The copying and audit process shall continue until completed and everything reconciled. The data shall be preserved and queued within their respective buckets in WinEDS until the tally function is started after 7:00 p.m. on Election Day. 5 The E2P electronically stores vote totals and a complete audit trail of voting activity. The Audit Trail Transfer function is a special Polls Closed function that allows a copy of the Audit Trail to be made. This function copies the E2P internal Audit Trail memory onto a special Audit Trail Transfer Cartridge. The primary reason for using this function is in case a results cartridge is misplaced or is in some way damaged or unreadable by WinEDS. Page 2 of 3

7. After 7:00 p.m. on Election Day, the contents of the early voting and grace period buckets shall be tallied within WinEDS. Tallied early voting and grace period voting election results shall then be released, along with results from in-precinct voting, to the precinct results and sent to the reporting application, which shall generate results reports for release to the public. 8. The IT Department shall secure all early voting and grace period memory sticks in a sealed transfer case. 9. Access to the computer room shall be strictly controlled at all times by the IT Department Director and entrance shall require an employee badge. 10. A reasonable number of pollwatchers as authorized by Sections 7-34 and 17-23 of the Election Code, at least one representative of each established political party and authorized agents of the State Board of Elections will be permitted to observe the processing of early/grace period memory sticks and the tallying of early/grace period voting results at all times. Upon receipt of a vote by mail ballot returned by any means authorized by statute, the Board shall endorse upon it the day and hour of receipt and shall enclose the same unopened, together with the application made by the voter, in a container securely sealed with the words, This container contains vote by mail ballot(s) and must be opened on Election Day, together with the number and description of the ward in which said ballot(s) is to be voted and the Board shall thereafter safely and securely keep the same in the office until processed and counted. 1 Such ballots may be processed by the Board in its central counting location beginning on the day the ballots are received by the Board, but the results of the processing may not be counted until Election Day after 7:00 p.m., except as provided herein. 2 2. Within one day after receipt of a vote by mail ballot, the Board shall enter the date of receipt, the voter s name, street address, e-mail address, and ward and precinct information into the Vote by Mail Database and shall transmit such information to the State Board of Elections by electronic means pursuant to a process established by the State Board of Elections. 3 3. Within 2 days after a vote by mail ballot is received, but in all cases before the close of the period for counting provisional ballots, the Board s clerks shall examine each ballot to determine whether the ballot is valid and should be counted, or whether the vote by mail ballot should be rejected and not counted. 4 (a) The Board s clerks shall compare the voter's signature on the certification envelope of that vote by mail ballot with the signature of the voter on the voter registration card on file for that person in the office of the Board. If the Board s clerk determines that the signatures match and if the ballot is otherwise valid, the ballot shall be accepted for processing and counting. (b) In addition to the voter's signatures not matching, a vote by mail ballot may be rejected by the Board s clerks: (i) if the ballot envelope is open or has been opened and resealed; (ii) if the voter has already cast an early voting or grace period ballot; (iii) if the voter voted in person on Election Day or the voter is not a duly registered voter in the precinct; or (iv) on any other basis set forth in the Code. Prior to each run through the Agilis System, Agilis shall be updated with a file containing the most current information regarding who has already cast a ballot, either by vote by mail, during Early Voting, during Grace Period registration or on Election Day. The Agilis shall reject as a duplicate ballot any vote by mail voter s ballot returned by a vote by mail voter who has already cast a ballot in the same election. b. The Agilis shall, for each vote by mail ballot, retrieve and display the electronic image of the signatures for the voter on the vote by mail certification envelope and on the voter s voter registration record. i. If the Board s clerk determines that the signatures match, the clerk shall click Accepted and click Submit on the Agilis System. ii. If the Board s clerk determines that the signatures do not match, or that the vote by mail voter is not qualified to cast a vote by mail ballot, the clerk shall click Rejected and click Submit on the Agilis System. The clerk shall mark across the face of the certification envelope the word "Rejected" and the ballot shall not be cast or counted. If the Board s clerk determines that any of the conditions set forth in subparagraphs (a) and (b) above apply, the clerk shall mark across the face of the certification envelope the word "Rejected" and the ballot shall not be cast or counted. 5 If a vote by mail ballot is rejected by the Board s clerks for any reason, the Board shall, within two (2) days after the rejection but in all cases before the close of the period for counting provisional ballots, notify the voter that his or her ballot was rejected. 6 (i) The notice shall (1) inform the voter of the reason or reasons the ballot was rejected; (2) state that the voter may appear before the Board, on or before the 14 th day after the election to show cause as to why the ballot should not be rejected; or (3) if the Certificate Envelope was not completed and/or signed, the Board shall send the voter a blank Certificate and inform the voter he or she may sign and date the Certificate and return it to the Board by the date indicated on the notice. If a vote by mail ballot is rejected, the voter may present evidence to the Board supporting his or her contention that the ballot should be counted. 7 (i) The Board shall appoint a panel of three (3) election judges to review the contested ballot, application, and certification envelope, as well as any 5 10 ILCS 5/19-8(g) 6 10 ILCS 5/19-8(g-5) 7 10 ILCS 5/19-8(g-5) Page 2 of 6

No more than two (2) election judges on the reviewing panel shall be of the same political party. (ii) Each political party, candidate, and qualified civic organization shall be entitled to have present one pollwatcher for each panel of election judges therein assigned. (iii) The reviewing panel of election judges shall make a final determination as to the validity of the contested vote by mail ballot. The judges' determination shall not be reviewable either administratively or judicially. (iv) A vote by mail ballot subject to this subparagraph that is determined to be valid shall be counted before the close of the period for counting vote by mail and provisional ballots. 4. The following vote by mail ballots, which shall be endorsed by the Board with the day and hour of receipt and if otherwise found to be valid under the requirements of the Election Code, shall be counted in the office of the Board beginning after 7:00 p.m. on the day of the election and during the period for counting vote by mail and provisional ballots, except if the vote by mail ballot is rejected as provided in paragraph 3 above: (a) Each vote by mail ballot returned to the Board, by any means authorized by Articles 19 and 20 of the Code and received by the Board before the closing of the polls on Election Day, which shall be endorsed by the Board with the day and hour of receipt. 8 (b) Each vote by mail ballot that is mailed to the Board and (i) is postmarked no later than Election Day or (ii) absent a postmark, the certification date is a date preceding the Election Day, but is received by the Board after the polls close on Election Day and on or before the 14 th day after the election 9 (c) All Federal Write-In Absentee Ballots ( FWAB ) from military and overseas civilians pursuant to Article 20 of the Election Code if 10 (i) the voter is eligible to vote, which in some cases requires that the voter be registered. (ii) the ballot is submitted from a location outside the United States, except that ballots cast by members of the U.S. Armed Forces vote by mail from their residences while on active duty may be submitted from within the United States. (iii) APO, FPO and foreign postmarks are an indication that the FWAB was submitted from outside the United States, but cannot be required as a condition to counting an FWAB. (iv) no regular vote by mail ballot from the voter was received by the Board on or before the date the FWAB is to be processed and counted. (d) All vote by mail ballots marked and returned by military and overseas civilians pursuant to Article 20 of the Election Code and marked using the Chicago UOCAVA ballot-access and ballot-marking system. 11 8 10 ILCS 5/19-8(b) 9 10 ILCS 5/19-8(c) 10 10 ILCS 5/20-1 et seq. 11 10 ILCS 5/20-1 et seq. PROCESSING, COUNTING AND TABULATING VOTE BY MAIL BALLOTS (e) (i) The procedures for accepting and processing Chicago UOCAVA ballotaccess and ballot-marking system ballots shall be set forth in separate procedures. All vote by mail ballots that are defective or damaged in that they contain overvotes or they cannot be read by the 400-C, a high-speed scanner, (including ballots for which no markings can be read by the equipment) and all Federal Write-In Vote Absentee Ballots to be counted shall be counted using a replacement ballot made pursuant to the Board s INSTRUCTIONS FOR MAKING REPLACEMENT BALLOTS FOR VOTE BY MAIL BALLOTS. 5. Except as otherwise provided herein, vote by mail ballots received by the Board after closing of the polls on an Election Day shall be endorsed by the Board with the day and hour of receipt and shall be safely kept unopened by the Board for the period of time required for the preservation of ballots used at the election, and shall then, without being opened, be destroyed in like manner as the used ballots of that election. 12 6. The preparation and insertion of vote by mail ballots into the 400-C high-speed scanner shall be conducted by a panel or panels of election judges appointed in the manner provided by law. Each panel or team shall consist of one Democratic and one Republican judge of election. 7. The procedures set forth in Articles 17 and 18 of the Code shall apply to all ballots processed and counted in these procedures. 8. Examine each ballot for write-in votes. (a) (b) Record a write-in vote on a write-in record for each valid write-in vote for a candidate that does not create an overvote (more votes than allowed for an office) and for which votes may be wholly or partially counted. To be a valid write-in vote: (i) (ii) (iii) (iv) The voter must have written in the name of the candidate on the line reserved for write-in candidates at the bottom of listing of candidates for the office sought (the spelling of a candidate s name does not have to be exact so long as the intention of the voter can be determined); The voter must have placed an arrow or solid mark in the designated area reserved for casting a write-in candidate; The candidate s name must be on a list of write-in candidates who timely filed a Declaration of Intent to be a Write-in Candidate, which list shall be supplied to the judges of election; In a party primary, the candidate s name must be written-in on the correct party ballot; There are no identifying marks on the ballot; and The write-in vote does not create an overvote for the office. (v) (vi) DO NOT record a write-in vote on the write-in record for any candidate for an office if: (i) There is a write-in vote but the write-in vote is invalid (i.e., the write-in vote does not meet the criteria set forth in subparagraphs (a)(i) through (vi) above), or (ii) 12 10 ILCS 5/19-8(e) There is an otherwise valid write-in vote but it creates an overvote. An overvote is created if the voter: Page 4 of 6

PROCESSING, COUNTING AND TABULATING VOTE BY MAIL BALLOTS (c) (1) casts an otherwise valid vote for a write-in candidate (i.e., meets the criteria set forth in subparagraphs (a)(i) through (v) above, but not (vi)) and (2) also casts a vote for another candidate whose name is printed on the ballot for the same office, if doing so results in more votes for an office than allowed by law. Make a replacement ballot (see Instructions for Making a Replacement Ballot) and record a vote on the replacement ballot for the candidate whose name is printed on the ballot for an office (but not for the write-in candidate for the same office) if the voter: (i) (ii) casts a vote for such candidate and also casts an invalid write-in vote for the same or a different candidate for the same office. 9. Valid vote by mail ballots shall be placed in sealed cases in a locked room nearby the Agilis Ballot Sorting System. At a time and place determined by the Board, the sealed cases shall be transported to a secure room where the valid vote by mail ballots shall be given to a panel or team of judges of election. Each team shall: (a) (b) (c) (d) (e) Verify the seal number on the case and then open the seal on the case. Open the Certification envelope and remove the ballot from the Certification envelope being careful not to deface or destroy the certification thereon or mark or tear the ballots. Initial the ballot. Place the ballots in a Transfer Case in ward and precinct order with the appropriate header card, if necessary, to be processed by the 400-C high-speed scanner. When a case of vote by mail ballots has been completed, notify a Board employee. 10. All ballots will be secured until transported to the Central Counting Station for processing. 11. Processing vote by mail ballots on the 400-C high-speed scanner: (a) Judges of election shall verify the seal numbers on the transfer case and then open the seals on the cases. (b) For each precinct, a Board employee shall insert the precinct header card and precinct vote by mail ballots in the 400-C tray and press Start. (c) The 400-C will scan and record the data from each ballot and deposit the ballot in the outstack tray. (d) Ballots not processed and deposited in the outstack tray need to be further examined by the judges of election and possibly run through the 400-C again. (e) When all ballots for a precinct have been processed through the 400-C, a Board employee will press End and the precinct data is stored. (f) Continue with the next precinct until all precincts are processed. 12. When all precincts have been processed through the 400-C high-speed scanner, the processed vote by mail data will be transferred to a USB compatible flash drive or memory stick. Memory sticks containing such data shall be secured in a sealed banker s bag and sent to the Board s central computer for counting after 7:00 p.m. on Election Day. After 7:00 p.m. Election Day the contents of the 400-C memory sticks Page 5 of 6

PROCESSING, COUNTING AND TABULATING VOTE BY MAIL BALLOTS shall be copied to WinEDS and votes shall be tabulated, tallied and added to the vote totals for the precincts for which they were cast. 13. Each political party, candidate and qualified civic organization shall be entitled to have present one pollwatcher for each panel of judges assigned. Such pollwatchers shall be subject to the same provisions as are provided for pollwatchers in Sections 7-34 and 17-23 of the Election Code and shall be permitted to observe all proceedings with regard to the central counting of vote by mail ballots, including the signature comparison between that which is on the ballot envelope and that which is on the voter registration card. Whenever a discrepancy exists during the canvass of votes between the unofficial results and the certificate of results, or whenever a discrepancy exists during the canvass of votes between the certificate of results and the set of totals which has been affixed to the certificate of results, the ballots for that precinct shall be retabulated to correct the return. 2. A team consisting of at least two (2) Board employees will be assigned to each station. Democratic and Republican judges of election will monitor the audit and retabulation. 3. Recount Materials. A Board employee will deliver the following materials to each team: (a) (b) (c) (d) (e) Transfer Case Memory pack and/or results cartridge Closing security seal Certificate of Results Form (Form OD) Touchscreen Tally Sheets 4. Open Transer Case (a) (b) (c) (d) Break the security seal on the Transfer Case Record the seal number and the precinct and ward on Form OD. Open the Transfer Case and examine the contents. If a memory pack and/or results cartridge is found, inform a Board supervisor. The memory pack/results cartridge will be checked to see if it contains valid vote totals. (i) If you are informed that the memory pack/results cartridge is valid; (1) Indicate on Form OD under "NOTES", "A memory pack/results cartridge was found and it contains valid vote totals." (2) Sign Form OD, place the top copy of the form (white) inside the Transfer Case. Place the bottom copies of the Form (yellow and Page 1 of 5

(3) Go to Step 6 and follow the instructions. (e) If no valid memory pack/results cartridges were found in Step 4(d) above, the ballots must be counted. Proceed to Step 5. 5. Counting the ballots The counting process may vary, depending upon whether (i) only optical scan ballots need to be counted, (ii) only touchscreen ballots need to be counted, or (iii) all ballots need to be counted. Board staff will give the employees instructions regarding what ballots will need to be counted. (a) Optical scan ballots (if necessary) (i) Remove the plastic bag containing voted optical scan ballots from the Transfer Case, break the Voted Ballots Security Seal on the plastic bag containing optical scan ballots and remove the ballots from the plastic bag. (1) Remove ballots marked Provisional, if any. Notify a Supervisor. Insert Provisional ballots in optical scanner only if instructed to do so by a Supervisor. Provisional ballots should be inserted into the optical scanner only if it appears that judges of election also mistakenly inserted such ballots into the optical scanner on Election Day. (ii) (iii) Remove all optical scan ballots in Envelope W, write-in votes. Insert optical scan ballots into an optical scanner. (1) The optical scanner will separate ballots that do not contain a judge's initials. Ballots not containing a judge's initials will not be counted. (2) The optical scanner will also separate ballots that contain write-in votes. (3) The optical scanner will be programmed so that it will NOT detect or return ballots that contain overvotes or undervotes. (iv) After all optical scan ballots have been inserted into the optical scanner, produce a Results Tape reflecting optical scan precinct results. (1) Produce additional Results Tapes if instructed to do so by a Supervisor.

AUDIT & RETABULATION OF BALLOTS IN PRECINCTS WHERE A DISCREPANCY EXISTS (v) (vi) Remove all optical scan ballots from the optical scanner. Place all ballots containing write-in votes back in Envelope W and reseal envelope. Place all remaining ballots in plastic bag, seal the bag, and write your names and date across the seal. Place sealed bag containing all optical scan ballots and Envelope W into the Transfer Case. (b) Touchscreen ballots (if necessary) (i) (ii) Remove the VeriVote Paper Roll ("VVPAT") containing the permanent paper record of votes cast from the Transfer Case. Employees shall examine the VeriVote Paper Roll by partially unrolling the paper roll to verify that the first ballot appearing on the Roll (actually the last ballot cast) is from the proper ward and precinct. (1) Immediately above the name of the first candidate appearing on the vote totals summary will appear a 4-digit numerical code. The first two digits in the 4-digit code represent the Ward #. The second two digits represent the Precinct #. For example, "0201" is the code for Ward 2, Precinct 1. (iii) If instructed by Board staff to do so, examine the vote totals summary appearing toward the end of the VeriVote Paper Roll. (1) One employee shall call out for each office and candidate the total number of votes cast for such candidate. (2) As the first employee calls out the information described in the previous section, a second employee shall record the total votes cast for each candidate and record that number in the "Totals" column next to the candidate's name on the Touchscreen Tally Sheet, which is a spreadsheet listing all of the offices and candidates appearing on the ballot in that precinct for which votes were cast. (3) Both employees shall date and sign the Touchscreen Tally Sheet (4) Skip the next steps in 5(b)(iv) and notify a Board Supervisor (see step 5(c) below). (iv) If instructed to do so, examine and count the votes cast on each ballot ("Official Public Record") listed on the VeriVote Paper Roll. (1) One employee shall call out "First Ballot."

AUDIT & RETABULATION OF BALLOTS IN PRECINCTS WHERE A DISCREPANCY EXISTS (2) A second employee shall make a "hash mark" (e.g., "I") in the column next to the row titled "Total Ballots Cast" on the Touchscreen Tally Sheet. For each subsequent ballot on the VeriVote Paper Roll, one employee shall call out "Next Ballot" and the second employee shall record a "hash mark" next to Total Ballots Cast for each ballot called out. (3) One employee shall examine each office listed on each ballot and read out loud: a. The name of each office b. The name of each candidate selected for each office c. If No Selection Made is printed, read out No Selection Made (4) As the first employee reads out the ballot selections, a second employee shall record each selection cast on the Touchscreen Tally Sheet. a. For each selection read by the first employee, make a "hash mark" (e.g., "I") on the Touchscreen Tally Sheet in the columns to the right of the candidate's name. For each column on the Tally Sheet, insert only a maximum of five "hash marks." Mark additional hash marks in the next column. (5) After all selections on the VeriVote Paper Roll for a precinct have been read and recorded on the Touchscreen Tally Sheet, a. Board employees shall calculate the total number of votes cast for each candidate and record that number in the "Totals" column next to the candidate's name. b. The employees shall calculate the total number of ballots cast as shown in the row titled "Total Ballots Cast" and record that number in the "Totals" column next to the row for "Total Ballots Cast." (6) Both employees shall date and sign the Touchscreen Tally Sheet. (c) A Board supervisor shall take the results cartridge and memory pack or paper roll to an IT Department employee, who will then transmit the results to the Board s IT Department. Once the results have been validated, the employees will complete the Final Procedures.

Final Procedures Make sure that the following steps are completed: (a) (b) All optical scan ballots are placed back inside the plastic ballot bag. Seal with tape and sign across the tape. Place only the following material inside the Transfer Case. (i) (ii) (iii) Place the ballot bag inside the Transfer Case along with any other material that was previously removed. Place a copy of the Touchscreen Tally Sheet inside the Transfer Case. Place top copy (white) of Form OD inside the Transfer Case. (c) (d) (e) Secure Transfer Case with the closing seal (after verifying that the closing seal number has been recorded on the Form OD). Place the memory pack and the pink and yellow copies of Form OD on top of the sealed Transfer Case. Raise your hands and notify a Board supervisor that you have completed the precinct. 7. Pollwatchers as authorized pursuant to Sections 7-34 and 17-23 of the Election Code shall be permitted to observe the audit and retabulation of ballots in precincts where a discrepancy exists. However, pollwatchers must obtain from the Board s central office pollwatcher credentials marked Obvious Discrepancies and submit such credentials to Board personnel upon arriving at the warehouse for the audit and retabulation of ballots.
