1. Approval of Minutes of the Regular Meeting of August 3, 2004. 2. Approval of expenditures: Payroll of 7/30/04 - $874,898.19 Voucher Register of 8/6/04 (FY 04-05) - $650,041.74 Voucher Register of 8/5/04 (FY 03-04) - $390,871.64 Voucher Register of 7/30/04 (FY 04-05) - $518,863.26 Voucher Register of 7/29/04 (FY 03-04) - $323,711.92 * *(Councilmember Schuyler will not participate in approval of check #244500 for $35.44 payable to Schuyler Mower and Offroad.) 3. Award of Contract for Design, Engineering and Construction Management Services for Wastewater Treatment Plant Upgrades. Wastewater Superintendent Susan Halpin s_halpin@ci.lompoc.ca.us Recommendation: that the City Council award to Brown and Caldwell the contract to design, engineer, and provide construction management services for the project to upgrade the Lompoc Regional Wastewater Reclamation Plant for a cost not to exceed $5,958,981. REPORT 3 4. Grant Application to the Office of Traffic Safety for Sobriety Checkpoints Chief of Police William F. Brown, Jr. b _brown@ci.lompoc.ca.us Recommendation: that the City Council: A. authorize the Chief of Police to submit a grant application to the State of California, Office of Traffic Safety, in the amount of $18.750 to pay overtime costs for the Sobriety Checkpoint Program for Local Law Enforcement Agencies II. B. Upon the grant award, authorize the City Administrator or his designee to sign and execute the project agreement form with the Office of Traffic Safety to finalize the acceptance of the grant. Appointment of Council Representative for County Economic Vitality Committee (Possible 3-year term with meetings starting by October 2004). PUBLIC HEARINGS: 6. CONTINUED PUBLIC HEARING Adoption of the Public, Education, and Government (PEG) Cable Television Access Operating Budget, Fees and Charges, and Policies and Procedures. On August 3, 2004, the City Council voted unanimously to continue the Public Hearing item relative to PEG to a future meeting. Staff anticipates that this matter will be heard again on Tuesday, September 7, 2004. No public testimony or discussion concerning this matter will take place at this time. (Mayor DeWees will not participate in this item due to a conflict of interest. Mayor Pro Tempore Janice Keller will be the presiding officer for this item of business.) 7. Seabreeze Estates Residential Project - A request by DS Ventures for City Council review of the Planning Commission's recommendations regarding the revised Seabreeze Estates project for 366 residential units, located on two parcels comprising approximately 77-acres located within the City of Lompoc, immediately southeast of the intersection of Central Avenue and Bailey Avenue. Assessor Parcel Numbers 93-070-062 (Northern Parcel) and 93-070-063 (Southern Parcel). Planning Division File Nos. EIR 01-01, GP 01-02, ZC 02-06, DR 02-19, ZC 01-02, DR 01-02, and LOM 508; and North Parcel (APN 93-070-062) approximately 37.82 acres 216 residential units are proposed: 48 2-unit duplex buildings 15 8-unit apartment buildings South Parcel (APN 93-070-063) approximately 39.43 acres 150 single-family residences are proposed. Breese l_breese@ci.lompoc.ca.us Appeals submitted by Richard Monk of Hollister and Brace, representing DS Ventures, LLC, for City Council consideration of the Planning Commission action of August 2, 2004: a) denying Zone Change (ZC 01-02) to amend the City s Zoning Map designation for Assessor Parcel Number 93-070-063 known as the southern parcel of the Seabreeze Estates project from Single Family Residential (7-R-1) to Single Family Residential Planned Development (R-1, PD) and Open Space (OS); and,
b) denying Zone Change (ZC 02-06) to amend the City s Zoning Map designation for Assessor Parcel Number 93-070-062 known as the northern parcel of the Seabreeze Estates project parcel from Planned Manufacturing (PM) to Medium Density Residential, Planned Development (R-2, PD), Public Facilities (PF), and Open Space (OS). The City Council will consider all applications related to the Seabreeze Estates Project; City Code provides that Planning Commission recommendations for denial of Zone Change applications are acted upon by the City Council only if an appeal is filed. Recommendation: The Planning Commission recommends that the City Council take the following action: (1) Take Public Testimony; Actions Regarding the Environmental Impact Report and CEQA Findings: (2) Adopt Resolution No. 5184(04) certifying the Final EIR and Amendment (EIR 01-01) to the Final EIR for both Northern and Southern Parcels; (3) Adopt Resolution No. 5185(04) adopting the California Environmental Quality Act (CEQA) Findings of Fact and A Statement Of Overriding Considerations (EIR 01-01) for the Southern Parcel; (4) Adopt Resolution No. 5186(04) adopting the California Environmental Quality Act (CEQA) Findings Of Fact and A Statement Of Overriding Considerations (EIR 01-01) for the Northern Parcel; Action Applicable to Northern and Southern Parcels: (5). Adopt Resolution No. 5187(04) amending the City's General Plan (GP 01-02) as follows: To the Circulation Element (on a vote of 3-2 with Commissioners Harman and Rodenhi voting no): a. Roadway Designations Map Change Bailey Avenue between Central Avenue and North Avenue to a Rural Road designation; b. Add to Definitions A description of a Rural Road, Purpose and Description; and c. Bikeway Routes Map Change the Class I designation on the extension of North Avenue to a Class II designation. To the Land Use Element Map: a. Approve the request to change the existing land use designation from Low Density Residential with School Overlay to Low Density Residential for the Southern Parcel (APN: 93-070-63); and b. Deny the request to change the existing land use designation from Light Industrial with Park Overlay to Medium Density Residential on 24.71 acres and to Community Facility on 4.09 acres for the Northern Parcel (APN: 93-070-62); Actions Applicable to the Northern Parcel:
(6) Deny the request to amend the City s Zoning Map (ZC 02-06) designation for the Northern Parcel (APN: 93-070-62) from Planned Manufacturing (PM) to Medium Density Residential, Planned Development (R-2, PD), Public Facilities (PF), and Open Space (OS) A timely appeal has been filed; staff recommendations regarding the appeal are provided below. (7) Direct staff to prepare a Resolution with appropriate findings regarding the appeal submitted by Richard Monk of Hollister and Brace regarding Zone Change ZC 02-06 (affecting the Northern Parcel); Should Council resolve to approve the request to amend the City s Zoning Map (ZC 02-06) designation for the Northern Parcel from Planned Manufacturing (PM) to Medium Density Residential, Planned Development (R-2, PD), Public Facilities (PF), and Open Space (OS), Waive further reading and Introduce Ordinance No. 1500(04); (8) Adopt Resolution No. 5189(04) denying the Preliminary Development Plan (DR 02-19) for conceptual design of 96 duplex units, 120 apartment units, site plan, parking, and landscaping for the Northern Parcel; Actions Applicable to the Southern Parcel: (9) Deny the request to amend the City s Zoning Map (ZC 01-02) designation for the Southern Parcel from Single Family Residential (7-R-1) to Single Family Residential, Planned Development (R-1, PD) and Open Space (OS); A timely appeal has been filed; recommendations regarding the appeal are provided below.
