Burns Town Council Meeting May 9, 2016 The Burns Town Council met in regular session May 9, 2016. Members present were Mayor Ralph Bartels, Council Members Rocky Stoner, Betty Nussbaum, Dennis Bastian, and Harvey Humphrey. Also present was Town Clerk Toni McNamar, Town Maintenance Darius Mandel, John Thompson with Cheyenne Light Fuel and Power, Brian Everleth. At 7 pm Mayor Ralph Bartels called the meeting to order and the Pledge of Allegiance was preformed. Mayor Bartels announced the meeting was being recorded. Approval of Consent Agenda: April 11, 2016 council meeting minutes Town Vouchers Town Treasurers Report Utility Vouchers Council Member Humphrey moved to approve the consent agenda. Council Member Bastian seconded this motion. Motion carried. Public Comment: Jim Clark was present to state his opinion on the four way stop. Jim reported that there has never been an accident at this intersection, there is no longer a school at this location, and the town of Burns owns three of the four streets that meet at the stop sign. Jim Clark feels that the stop signs should come down. Council Member Stoner reported that he has spoken with the county and they had suggested putting a counter up in that area to see which direction has the least traffic prior to removing stop signs. Council Member Stoner feels that the four way stop should remain. Council Member Nussbaum would like the north and south stop signs removed like it was before. Council Member Bastian reported that when we done the survey most of the people that responded wanted the stop signs removed. Mayor Bartels reported that not many people responded to the survey. Council Member Bastian reported that we gave them the opportunity to respond to the survey and if they did not respond they must not care one-way or the other. Mayor Bartels stated that the stop signs should stay. Council Member Nussbaum sees no need for them, we have a speed limit and don t need a four way stop.

Council Member Stoner moved that the four way stop remain in place. This motion died due to a lack of a second. Council Member Nussbaum moved that the north and south stop sign be removed. Council Member Bastian seconded this motion. Mayor Bartels called for a roll call vote: Stoner stop signs remain Bastian remove stop sign, Nussbaum remove stop sign, Humphrey stop sign remain. Bartels stop signs remain. Motion did not pass four way stop will remain. Building Permit: The Council was present with a building permit for a handicapped ramp to be installed at 246 S Main Street. Mayor Bartels reported that the fire marshal had requested and received a letter from the property owner giving the town of Burns access to the underground utilities that the ramp will need to go over. Council Member Humphrey moved to grant variance to allow handicapped ramp. Council Member Bastian seconded this motion. Motion carried. Council Member Bastian moved to approve the building permit for a handicapped ramp at 246 S Main Street. Council Member Humphrey seconded this motion. Motion carried. The council was present with a building permit for a car port at 240 S Washington Ave. The fire marshals have reviewed this permit and recommend approval of this permit for a car port. Council Member Bastian moved to approve building permit for car port at 240 S Washington Ave. Council Member Stoner seconded this motion. Motion carried. Ambulance Report: Brian Everleth thanked the council for their approval of the handicapped ramp. Brian reported that he did not have a report for the council on the calls responded to in April, he reported that there were 10 calls. Brian reported that he had the paperwork for the billing service based out of Denver that the Council had approved when Erica was the supervisor of the ambulance service. Brian reported that it had been signed by the previous Mayor. Brian reported that it will take about 5 months before we can start billing. Brian reported that Burns EMS will send the information to the billing service and they will do the billing. The billing service will send the bills to the insurance companies. The billing service will be paid on a percentage bases on what the town collects in fees. Toni McNamar inquired does the billing company take their percentage out of the money collected and then send the town the money or do we have to send them money after they bill us. Brian will be checking into this. The council had agreed not to send anyone to

collections that are unable to pay. Toni inquired as to if the billing service understood this also. If the ambulance service does not collect then the billing service will not collect either. AMR had made an offer to purchase safety vests for members of the ambulance service to carry with them, the cost for these vest is about $300. If the town of Burns purchases them and bills AMR, they will reimburse the town for the cost of the vests. Council Member Stoner moved to purchase the vests and have AMR reimburse the town. Council Member Humphrey seconded this motion. Motion carried. Jolene reported on the craft show that the ambulance service is doing on May 21 st. She reported that they have approximately 15 crafters this far. She requested the use of 25 tables for this event. Brian reported that he had an application for a new EMT on the Burns Ambulance service, his name is Seth Wilson, he is currently on Fire District #4 and has recently completed the MET class. Council Member Stoner moved to accepts Seth Wilson on the ambulance service. Council Member Bastian seconded this motion. Motion carried. Utility Board Report: Utility Board Representative Humphrey reported that the utility board had some discussion on the Fourth Street Sewer project. The A-7 well and transmission lines project is currently out for bids. Maintenance Report: The maintenance report was reviewed. Darius reported that we had a drain pan put on north Main Street and it appears to be working good. While the concrete people where here they fixed a couple of curbs and replaced ramps on north side of this building. Darius reported that the conservation district will be bring us a tree to replace the dead one on Main Street by the plumbing shop, he reported the cost would be around $300. Darius reported that he would like to have plumbers look at the Main Street bathrooms and fix them correctly; they have not worked correctly for two years. Mayors Report Mayor Bartels thanked High West Energy for stopping buy and fixing our flag pole rope at the Burns Plex. Mayor Bartels reported that the council needs to discuss the fee to charge for the liquor license for The Burns Café. It is up to the town on what to charge within the range of $300 to $1500. She will be applying for a full retail liquor license. Jodee is doing the work required to get the dispensary room properly set up, at her cost. Mayor Bartels feels that we should

charge the full $1500. Council Member Humphrey feels that we should charge a flat fee of $500. Council Member Stone moved to charge $750 for the liquor license fee with the option to change rate at renewal time. Council Member Bastian seconded this motion. Motion carried. Mayor Bartels read a letter he had received that commented on how nice the town website was. Mayor Bartels reported that the ambulance has new shocks on it and also got the oil changed.. Council Reports: Council Member Humphrey reported that he has had several people contact him regarding not wanting to exercise when Brianna is holding her classes, he would like a scheduled posted so that people know when she is there so they can plan when they can come up and exercise. Jim Clark would like to see this schedule on the town website. Council Member Bastian reported that we had a cemetery board meet, there was discussion on tree planting in the cemetery, marking out an area for parking on the south side of the cemetery, and we have updated the website with the current pricing and new rules and requirements. Council Member Nussbaum reported that the conservation district will be her on the 23 rd to plant a cotton less cottonwood in front of the Burns Plex. Council Member Nussbaum reported that she has given out the money for planting flowers in the planters on Main Street. Betty reported that she has weeded three of the four flower beds. Council Member Stoner reported that he had Knife River grind the hump down in Main Street when they were here working on County road 213. Rocky reported that soccer is nearly over and baseball registration has started. Rocky reported that the score board design will be emailed to us on Monday if we like it we will go ahead and get it ordered. Rocky inquired about renting out houses for the baseball field for baseball season or just have people use the restrooms at the A-6 Park. Council Member Humphrey feels that the restrooms at the A-6 Park will be fine; we do not need to order out houses.

Old Business: The Council was presented with Second Reading of Ordinance 18A.40 fiscal Year Budget 2016/2017 Annual Appropriations. Council Member Bastian moved to approve seconded reading of Ordinance 18A.40 by title only. Council Member Humphrey seconded this motion. Motion carried. The council was present with the 2016/2017 fiscal year budget for the Burns Utility board with the recommendation from the utility board that they approve this budget. Council Member Humphrey moved to approve the 2016/2017 Fiscal Year Budget for the Burns Utility board. Council Member Bastian seconded this motion. Motion carried. Adjourn: At 8:07 pm Council Member Stoner moved to adjourn, the next meeting of the Burns Town Council is scheduled for June 13, 2016 at 7 pm.
