OFFICE OF CITY ATTORNEY June 28, 2007 MEMO: TO MAYOR AND CITY COUNCIL RE: PARKING LOT INJUNCTION FROM: CITY ATTORNEY On Monday, June 25, 2007, Rodney Drenkow brought an action in Bremer County District Court versus Family Video Movie Club, Inc. for a Temporary Injunction prohibiting Family Video from pouring concrete for their parking lot, driveway or dumpster enclosure until establishing compliance with the Waverly Zoning Ordinances. Mr. Drenkow posted a $7,000.00 bond and the Judge issued an injunction temporarily prohibiting Family Video from undertaking these improvements until a hearing on the subject can to be held on July 9, 2007. The City of Waverly is not a party to this suit. The City has no liability exposure in this matter, which is entirely between two private parties. A copy of the Application for Temporary Injunction, Affidavit in Support of the Application, and Order Granting Temporary Injunction and Setting Hearing are attached. That the site plan does not meet the minimum set-back requirements specified by Waverly zoning ordinance 100.8.03, providing the Yard Frontage for "other permit uses" within R-3 districts is to be 30 feet and Side Yard width is to be 10% the lot width. 5. That site plan includes a notation for driveways on the Front Yard of the R-3 zoned district, violating Waverly zoning ordinance Section 100.19.05 providing that front and side yards shall be used for fences, walks, or landscaping only.
