In this connection, I would like to bring to the attention of your Excellency s Government allegations I have received of indiscriminate air strikes by coalition forces in civilian areas in Yemen, which have resulted in numerous deaths and injuries of civilians. According to the information received: On 12 July, at least 20 civilians were killed, during an airstrike which hit the Al- Umal Residential Complex in AL Naser Area, Sa wan District, Sana a. The Al-- Umal Residential Complex is home to Yemen s Al-Muhamasheen marginalized community and is located about one kilometer away from the Al-Seyanah Military Base, the American Embassy, and Sa wan Tourist City. On 28 September 2015, according to reports received by OHCHR at least 33 people were killed in a reported coalition-led airstrike while attending a wedding celebration in Wahijah Village, outside of the Red Sea port city of Al Mukha, Taizz Governorate. On the same day, two humanitarian workers were killed alongside other civilians during an airstrike in the Al-Swaida, Al-Wazi iyah District, Taiz Governorate. On 6 October 2015, a coalition-led air strike hit a wedding party in Yemen's Dhamar Governorate, resulting in the death of at least 47 civilians and 58 being injured, among them many women and children.

Indiscriminate airstrikes have been reported in many parts of Yemen since the escalation of violation on 26 March 2015. 2,615 civilians have been reportedly killed due to the fighting across the country. Of this total figure, 1641 civilians were killed as a result of coalition led airstrikes, thus, approximately 60 per cent of all deaths caused during the fighting to date. I express very serious concern about the alleged incidents of indiscriminate air strikes in civilian areas by coalition forces, which have resulted in a large number of deaths and injuries of civilians in Yemen. While I do not wish to prejudge the accuracy of these allegations, they indicate a prima facie violation of the right of every individual to life and security and not to be arbitrarily deprived of his or her life, as set forth in articles 3 of the Universal Declaration of Human Rights (UDHR) and articles 5 and 14 of the Arab Charter on Human Rights (ACHR), to which Saudi Arabia is a State Party since 2009. The allegations of indiscriminate killings of civilians may also constitute a breach of Common article 3 to the four Geneva Conventions which establishes the minimum standards that all parties involved in a non-international armed conflict should observe concerning the treatment and protection of civilians, and provides that persons taking no active part in hostilities shall be treated humanely and should not be subject to violence to life and person, in particular murder of all kinds. The indiscriminate shelling of civilian populated areas and civilian objects may amount to war crimes. In connection with the above alleged facts and concerns, please refer to the Reference to international law Annex attached to this letter which cites international human rights instruments and standards relevant to these allegations. It is my responsibility, under the mandate provided to me by the Human Rights Council, to seek to clarify all cases brought to my attention. I would therefore be grateful for your observations on the following matters: 1. Please provide any additional information and/or comment(s) you may have on the above-mentioned allegations. 2. Please provide information on whether your Excellency s Government as leading member of the coalition forces was informed of and/or provided consent or assistance to carry out the above mentioned airstrikes. 3. Please provide information on any assessment made, to your knowledge, by coalition or other forces involved prior to carrying out the abovementioned airstrikes in order to determine and ensure that civilian populations and objects vital to its life and health are effectively protected against the effect of shelling. Please specify the targeting criteria used and the procedural safeguards, if any, employed to ensure that these actions complied with international law. 2

4. Please provide information on any investigation carried out by Saudi authorities and/or other coalition forces into the above mentioned airstrikes, as well as details on all casualties caused by these and other coalition-led air strikes since the beginning of the air bombing campaign. 5. Please indicate whether the victims and families of the victims have or will receive reparation. I would appreciate receiving a response within 60 days. While awaiting a reply, I urge that all necessary interim measures be taken to halt the alleged violations and prevent their re-occurrence and in the event that the investigations support or suggest the allegations to be correct, to ensure the accountability of any person(s) responsible for the alleged violations. Your Excellency s Government s response will be made available in a report to be presented to the Human Rights Council for its consideration. I would like to inform your Excellency s Government that a letter of similar content will be sent to the Government of Yemen. Please accept, Excellency, the assurances of my highest consideration. Annex Reference to international human rights law In connection with above alleged facts and concerns, I wish to draw your Excellency s Government s attention to article 3 of the Universal Declaration of Human Rights (UDHR) and articles 5 and 14 of the Arab Charter on Human Rights (ACHR), to which Saudi Arabia is a State Party since 2009, which guarantee the right of every individual to life and security and provides that these rights shall be protected by law and that no one shall be arbitrarily deprived of his or her life. I would like to remind your Excellency s Government that its obligations under international human rights law continue to apply in the context of armed conflict, as acknowledged by the International Court of Justice (Legality of the Threat or Use of Nuclear Weapons, Advisory Opinion, I.C.J. Reports 1996, paras. 24-25; Legal Consequences of the Construction of a Wall in the Occupied Palestinian Territory, Advisory Opinion, I.C.J. Reports 2004, para. 106.), the Human Rights Committee (General Comment 29, States of Emergency, para. 3) and the Committee on Economic, Social and Cultural Rights (Concluding observations on the initial report of Israel; 2001, para. 12). Customary international law requires States to take all feasible precautions to avoid, and in any event, to minimize incidental loss of civilian life, injury to civilians and damage to civilian objects. International humanitarian law, through the principles of proportionality, distinction and precaution, prohibits deliberate attacks on civilians and civilian objects, and attacks which do not discriminate between civilians and combatants or military objectives, or which cause disproportionate harm to civilians objects in relation to the anticipated military advantage which may be gained by such attack. International humanitarian and human rights law also provide that States must investigate allegations of war crimes committed either by their nationals or armed forces, or on their territory by a foreign State, or over which they have jurisdiction, and, if appropriate, prosecute the suspects, and make full reparation for the loss or injury caused. The Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions, (resolution 1989/65 Economic and Social Council) recall that exceptional circumstances including a state of war or threat of war, internal political instability or any other public emergency may not be invoked as a justification of such executions, and that it is States duty to conduct thorough, prompt and impartial investigations of all suspected cases of extra-legal, arbitrary and summary executions, and bring to justice all persons identified by the investigation as having participated in those executions. The families and dependents of victims of extra-legal, arbitrary or summary executions shall be entitled to fair and adequate compensation within a reasonable period of time. The obligation to investigate gross violations of international human rights law and serious violations of international humanitarian law effectively, promptly, thoroughly 4

and impartially and, where appropriate, take action against those allegedly responsible, is further enshrined in the Basic Principles and Guidelines on the Right to a Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law (General Assembly Resolution 60/147, Chapter II, paragraph 3). 5
