SSIs registered with NSIC under single point registration are exempted from submission of cost of tender form, EMD & security deposit to the extent of monetary limit. The unit claiming concession of NSIC is required to submit proof regarding current registration with NSIC for the tendered items along with their approved Monetary Limit with attestation 13. EMD and Security Deposit will not bear any interest. 14. Near relatives of BSNL Employees either directly recruited or on deputation is prohibited from participating in tenders in different units of BSNL. The near relatives for this purpose means a. Members of Hindu Undivided family b. Husband and wife. c. The one is related to the other in the manner as father, mother, sons, daughters, daughters-inlaw, sons-in-law, brother, brother s wife, sister, sister s husband. A certificate to this effect is given in the prescribed format enclosed. 15. The tender will be accepted based on the report submitted by the Tender Evaluation Committee nominated by GMT, Calicut. Tenderer whose tender is accepted will have to execute an agreement in a stamped paper worth Rs.200/-within 10 days of being asked to do so, failing which the EMD will be forfeited to the BSNL and the tenderer will be blacklisted. After execution of the agreement, the approved rate and contract shall be valid up to one year from the date of execution of agreement. Tender opening &Evaluation of Bids: The envelopes containing the tender offer that are not properly sealed as mentioned vide para 2 will not be opened and will be rejected outright. The first and second envelopes will opened initially on the date of opening as announced in NIT. The Tender Evaluation Committee nominated by GMT, Calicut will evaluate the bids and the samples of items for the assessment of quality. The qualified bidders will be decided based on the report submitted by the evaluation committee. The envelope marked financial bid will be opened only for the qualified bidders. The date and time of opening of financial bid will be conveyed to all qualified bidders and their representatives will be allowed to attend the financial bid opening. 16.1 The GMT, BSNL Calicut reserves the right to accept or reject any bid and to cancel the bidding process and reject all bids, at any time prior to award of contract without assigning any reason what-so-ever and without thereby incurring any liability to the affected bidder or bidders on the grounds for the BSNL s action. 16.2 The General Manager, BSNL Calicut reserves the right to reject any tender at any stage without assigning any reason and it is not obligatory to accept the lowest tender. 16.3 The General Manager Telecom, BSNL, Calicut shall be the final authority for deciding 6 Signature of Bidder:
successful tenderer and his decision shall be final and binding. 16.4The GMT, BSNL, Calicut reserves the right to terminate the contract entered into at any time by giving a written notice of 7 days if the discharge of the contractual liabilities of the contractor is not satisfactory to the above said officer or his representatives without prejudice to any other penal action he may choose to take against the contractor within the terms & conditions of this Tender Documents. The GMT, BSNL, Calicut shall not be held responsible for any loss or damage suffered by the contractor as a result of the cancellation of the letter of acceptance and work order. 16.5 In case the performance of the contractor is not satisfactory, the GM, BSNL Calicut also reserves the right for employing other agencies for urgent execution of work in the exigencies of service and the extra cost if any will be recovered from the contractor. 16.6 The tenderer will be bound by all terms and conditions and specifications as detailed in the tender documents. Any tender with conditions other than those specified in the tender document is liable to be summarily rejected. No modification by the contractor in any of the conditions will be permitted after the tender is opened. In the event of any failure to comply with any of the clauses of this tender notice, the tender is liable to be cancelled and EMD/SD will be forfeited along with taking such other action as may be deemed fit by GMT, BSNL, Calicut including blacklisting name of the tenderer or the firm. 16.7 The GMT, BSNL, Calicut may waive any minor infirmity or non-conformity or irregularity in a bid which does not constitute a material deviation, provided such waiver does not prejudice or affect the relative ranking of the bidder. 16.8 The GMT, BSNL, Calicut reserves the right to accept or reject any tender or all the tenders including the lowest and also to cancel the tender without assigning any reason whatsoever. The decision of GMT in this regard is final and binding. 16.9 Work Order will be issued by AGM (Cable Planning), O/O GMT, Calicut-1 as and when required by BSNL after assessing the requirements. Firms registered with NSIC should note that in case they fail to comply with the faithful performance of the contract, the quality of performance will be noted in the performance register in this office and will be notified to the NSIC. 16.10 The items should be transported within 10 days of accepting the work order. 16.11 L.D.Clause: Delayed transportation of items will attract Liquidated Damages at the rate of 0.5% of the total value of the item for each week of delay or part thereof for a period up to 10 weeks and thereafter @ 0.7% of the value of the delayed supply for each week of delay or part thereof for another 10 weeks of delay. The LD will continue to be charged at a flat rate of 0.7% of the value of the delayed supply for each week of delay beyond 20 weeks of delay. Quantum of liquidated damages assessed and levied by the purchaser shall be final and not challengeable by the supplier. 16.12 The rate may be quoted in the Financial Bid attached along with the tender document, in figures and in words in English. tender would be optional by GMT, Calicut. 17 SPECIAL CONDITIONS OF CONTRACT 1. Loading and unloading will be done only during office hours. Hence the vehicle should reach the loading/unloading spot in the prescribed day and time. 2. The Contractor shall be responsible for any accident or loss to any person, Public / Private property & BSNL property, that may occur during transportation. 3. If required, the tenderer shall produce the original documents such as Registration Certificates for the transport operation, Income tax clearance certificate. 4. For any reason if the hired vehicle is stopped and not allowed for further journey, the tenderer has to make alternate arrangement for providing standby vehicle to take the responsibility to get adjusted the amount so spend by the officer to reach the destination. 5. Necessary insurance coverage for the items against damage/theft during transportation, from any nationalized insurance company should be provided by the contractor. 18 Description of work: 18.1.Transportation including loading, unloading and handling of 30 KMs of 40/33 mm PLB Pipe and 20 KMs of 96F OFC from SSA Store. Paruthippara, Trivandrum to BSNL store yard Malaparamba,Calicut-9 19 Bid shall remain valid for 60 days from date of opening of the bid. A time schedule for scrutiny & disposal of tender will be three months so as to ensure speedy disposal of the tenders. 20 If a vender registered with NSIC claiming concessional benefits is awarded tender and subsequently fails to obey any of the contractual obligation, he will be debarred from any further work/contract by BSNL for one year from the date of issue of such order. 21. 100% payment shall be made after transporting the materials fully in good condition and in correct quantity. 22. Payment will be settled after recovering any dues such as penalty and other statutory levies etc if applicable. 23. e-payment : In cities/areas where ECS/EFT facility is provided by banks, the bidder must have Accounts in such ECS/EFT facility providing banks and that bank account number shall be quoted in the bids by the bidder. The cost of ECS/EFT will be borne by BSNL in all cases where the payment to Contractor/supplier is made in a local branch i.e., bidder is having bank account in the same place where the payment is made by BSNL unit. In case payment is made to outside branch i.e., bidder is having bank account not in the same place from where the payment is made by BSNL unit, the crediting cost will have to be borne by the bidder/recipient only. 24. In case of any dispute regarding the contract, the decision of GMT, Calicut or any other officer nominated by him will be final and binding on the tenderer and of the law relating to the arbitration for the time being in force shall apply to such arbitration. 25. Force majeure: In the event of force majeure conditions such as acts of God, war declared or undeclared, hostilities, enemy actions, revolts, riots, legal lockouts, illegal strikes, epidemics, sabotage, extra ordinary act and regulations of Central or State Governments or Municipal bodies, the discretion to waive the tender conditions rests upon the GMT, BSNL, Calicut. 26. ABRITRATION: 26.1 In the event of any question, dispute or difference arising under this agreement or in connection there-with except as to matter the decision of which is specifically provided under this agreement, the same shall be referred to sole arbitration of the Chief General Manager, Kerala Circle or in case his designation is changed or his office is abolished then in such case to the sole arbitration of the officer for the time being entrusted whether in addition to the functions of the Chief General Manager, Kerala Circle or by whatever designation such officers may be called (hereinafter referred to as the said officer ) and if the Chief General Manager, Kerala Circle or the said officer is unable or unwilling to act as such to the sole arbitration or some other person appointed by the Chief General Manager, Kerala Circle or the said officer is unable or unwilling to act as such to the sole arbitration the agreement to appoint an arbitrator will be in accordance with the Arbitration and Conciliation Act, 1996. There will be no objection to any such appointment that the arbitrator is Government/BSNL Servant or that he has to deal with the matter to which the agreement relates or that in the course of his duties as Government/BSNL Servant he has expressed views on all or any of the matter under dispute. The award of the arbitrator shall be final and binding on the parties. In the event of such arbitrator to whom the matter is originally referred, being transferred or vacating his office or being unable to act for any reasons whatsoever such Chief General Manager or the said officer shall appoint another person to act as arbitrator in accordance with terms of the agreement and the person so appointed shall be entitled to proceed from the stage at which it was left out by his predecessors. 26.2The arbitrator may from time to time with the consent of parties enlarge the time for making and publishing the award, Subject to aforesaid Indian Arbitration and Conciliation Act 1996 and the Rules made there under, any modification thereof for there time being in force shall be deemed to apply to the arbitration proceeding under this clause. 26.3The venue of the arbitration proceeding shall be the office of the Chief General Manager, Kerala Circle or such other places as the arbitrator may decide. The following procedure shall be followed. 26.3.1 In case parties are unable to reach a settlement by themselves, the dispute should be submitted for arbitration in accordance with contract agreement. 26.3.2 There should not be a joint submission with the contractor to the sole Arbitrator. 26.3.3 Each party should submit its own claim severally and may oppose the claim put forward by the other party. 9 Signature of Bidder:
26.3.4The onus of establishing his claims will be left to the contractor. 26.3.5 Once a claim has been included in the submission by the contractor, a reiteration or modification thereof will be opposed. 26.3.6 The Points of defence will be based on actual conditions of the contract. 26.3.7 Claims in the nature of ex-gratia payments shall not be entertained by the Arbitrator, as these are not contractual. 26.3.8 The question whether these conditions are equitable shall not receive an consideration in the preparation of points of defence 26.3.9 If the contractor includes such claims in his submission, the fact that they are not contractual will be prominently placed before the Arbitrator. The award of the sole Arbitrator shall be final and binding on all the parties to the dispute. 27 ANNULMENT OF AWARD Failure of the successful bidder to comply with the provision of the tender conditions shall constitute sufficient ground for the annulment of the award and forfeiture of the bid security, in which event, BSNL may award the work to any other bidder at the discretion of BSNL or call for new bids. The following grounds individuals or collectively will become basis of annulment of award. 28. BSNL S RIGHT TO VARY QUANTUM OF WORK: The BSNL, at the time of award of work under the contract, reserves the right to decrease or increase the work by up to 25% of the total quantum of work specified in the description of work without any change in the rates or other terms and conditions. 29..
