SUMMARY The report represents results of monitoring the implementation of compensation and site clearance at component of building of freshwater supply system (FSS) at Mong Duong thermal power plant (TPP) of Mong Duong electricity center. The FSS has affected to the area of Mong Duong ward, Cam Hai commune, Cam Pha city, Quang Ninh province. The report includes three parts: Part 1: Introduction, objectives, monitoring methodology of independent monitoring (IM); Part 2: Monitoring of site clearance and RP compliance at component of building of FSS. Part 3: Conclusion and recommendations Including the following contents: The eleventh monitoring aim has described to general progress of the entire project; rate of progress of compensation and site clearance at component of building of FSS; implementation status by now; review and resolution for remaining issues shown in the tenth monitoring and arising issues in this monitoring; proposals and plans for the next monitoring. PART I: INTRODUCTION, OBJECTIVES, MONITORING METHODOLOGY OF INDEPENDENT MONITORING The FSS was signed under the contract of construction with the schedule of work was in 18 months with the contractor Song Da -11 JSC. by thermal power -1 project (TPP) PMU on October 11 th 2012. Currenlly, the system has been completed and the pumping system is working to provide freshwater to Mong Duong electricity center since April 27 th 2014. The implementation of site clearance and RP compliance at component of building of FSS has basicly completed which consist of the pipeline system and the recervoir of freshwater in the area of Mong Duong ward, Cam Hai and Cong Hoa communes. All of local people are affected by the component of building of FSS who had received their compensation, remaining people who are affected by the area of freshwater recervoir, they had the relocation and resettlement in the other places; they already build their new houses and got the stable life. The task of supporting of livelihood restoration has been done and initially has good results. Most of the affected families have expressed their satisfaction and they were really supporting this project. No one has any complaints or the asking except a few of aspiration from the households that have been considered to resolve by investor. 1. OBJECTIVES OF THE ELEVENTH MONITORING (i) Review the problems existing since the 10 th monitoring and ones which are resolved. Determine next direction and resolution for the unresolved ones. 5

(ii) Monitor the implementation of compensation and resettlement for current components, check its compliance with the project s RP, (iii) Check if determined RP and mitigation measures ensure fairness and support affected people in order to improve their living quality or at least recover one before the project implementation. (iv) Evaluate effectiveness, impacts and sustainability of the resettlement activities. Recommend necessary adjustments in the resettlement implementation for the project s following components. 2. MONITORING METHODOLOGY External monitoring team reviews documentation at office, observes, meets and interviews stakeholders in relation to review the compensation payment, complaints and recommendations of affected households and monitor RP implementation for households impacted by the freshwater pipeline and freshwater reservoir. Information resources are as follows: - PMU s head office at Operation building of Mong Duong Electricity Center; - Mong Duong Ward People s Committee, Cam Pha City; - People s Committees of Cam Hai and Cam Hoa Commune; - Compensation Council of Cam Pha city at head office of Cam Pha City People s Committee; - Visit and interview affected households and ones having problems. PART II: MONITORING ON SITE CLEARANCE AND RP COMPLIANCE WITH COMPONENT OF PIPELINE SYSTEM AND RESERVOIR OF FRESHWATER I. SUMMARY Referring with the tenth monitoring report, some problems have been resolved actively and successfully by PMU and Compensation Council. The monitoring results of site clearance and compensation progress until the monitoring time in November 2014 are as follows: a. Currently, the site clearance and RP compliance with component of building of FSS have been done; it s consist of the pipelines passing to Cam Hai and Cong Hoa communes and the freshwater reservoir in the area 10, Mong Duong ward. b. All of 65 households in the area who are affected by pipelines that had received full compensation from the tenth monitoring. In the reservoir area, it 6

has 127 affected households (AHs) who had received full of compensation, too (in which 37 households had to relocated to have their resettlement). All of them bought the land and to built the new houses and they got the stable life by now. c. Information dissemination and community consultation were conducted in compliance with the regulated process by PMU and the City Compensation Council; however, in order to help the affected people be aware clearly and adequately of the project information and their rights as well as benefits, it is necessary to increase the dissemination during the project implementation; d. At the eleventh monitoring time, some accrued problems since the tenth monitoring have been solved; e. The compensation payment according to the project policy is basically finished. Livelihood restoration activities have been conducted. These households have no complaints about compensation and site clearance but only have a few ideas orally relating to some aspirations of them that have considered to resolve by investor. f. Activities relating to gender and ethnic minorities have been implemented according to approved Resettlement Plan (RP); g. Land management of Mong Duong ward was not really good so that lead to the confusion and mistakes in the counting and compensation plans, some households had got the approval decision but after that they had to take the determination again. However, this problem has been resolved by compensation council and PMU and People s Committee of Mong Duong ward. II. IMPLEMENTATION STATUS BY NOW 1. Implementation progress of compensation for the site clearance of freshwater pipeline component: According to summarized report of PMU and field trip monitoring, the implementation of site clearance and resettlement according to approved RP at the component of freshwater pipelines basically have completed in the task of site clearance. Since 2014, the payment has completed for 65 households who were the pipelines passed and 127 affected households by the freshwater reservoir since 2012 to 2014. On January 1 st 2014 the implementation of storage of freshwater in the reservoir was began working. And now, it has completed with the guarantee of the cote design is 15 meters. The operation of pumping is supplying freshwater to Mong Duong electricity center. 7

2. Main problems in the site clearance and compliance with RP The information dissemination and community consultation were implemented and their implementation were relatively good. Before the project is implemented, the meetings of local people were held to consult to their feedback about the compensation and resettlement. Materials for disclosing the information were quite full, however the project information materials are only posted at the CPC but not distributed to the people. 4 households had their petitions about mistakes in the Detailed Measurement Survey (DMS) and price application which are needed to be correct are lacking the amount in the Detailed Measurement Survey, confusion in the land origin, etc.; and these petitions were counted and made the full payment method to them by the Land Fund Development Center (LFDC) and People s Committees Mong Duong ward. These households have received their compensation and no ones have complaints about plan of compensation payment any more. For households who have their affected assets, they were compensated 80% of the value of their assets. PMU had the petition to LFDC and People s Committees of Cam Pha city and they have additional compensated in accordance with the ADB s policies and there is no complaints from local people about this content. The task of compensation payment and site clearance at the component of freshwater pipeline have completed. A total of 192 households in which there are 65 households in the area of pipelines system and 127 households are in the reservoir area, they were already compensated in the years since 2012 to 2014. Mr. Nguyen Cong Chi who is in charge of PMU said that: The task of site clearance and resettlement at component of pipeline system have completed in June, 2014. All of households were compensated and the resettled households bought the land and built their new houses to get their stable life. By now, there is basically no complaints; a few of other comments for some matters as lack of assets, mistakes in counting, low land prices have been resolved. Program for livelihood restoration were implementing since quarter 1, 2014 to the affected households, until now, two training courses have been done; PMU have supported and introduced the output for the majors of car repairing service and cooking. The training course for M&E repairing service will be opened in December when it has enough the participated candidates at the area 10; the training fee and lunch fee will be paid by PMU. Mrs. Nguyen Thi Dang, leader of area 10, Mong Duong ward said that: Compensation Council have paid for the item of compensation and site clearance to all of 127 affected households by freshwater pipeline at the area 10. Most of households were satisfied with the compensation payment, no one has complaints. The resettled households were relocated from 8

the area of reservoir to group 1, 5 and 8 in are 10 to bought the land and to built the houses, by now they have stable life. In those 37 resettled households that have 7 others from this area went on Hai Lang commune, Tien Yen ward to live. In the compensation progress, it had some ideas and comments but they have been solved by PMU, Compensaion Council and Mong Duong ward, by now it basically has no problems. The implementation of training of Income Restoration have opened 2 courses, it will be starting to open more the training course of M&E Service at the end of November when enough participated cadidates. III. FINDINGS IN THE ELEVENTH MONITORING 1. Detailed measurement survey (DMS): 1.1.Making DMS process: Measurement activity was conducted by a measurement team, including representative of Compensation Council of Cam Pha city, representatives of some agencies, organizations, Employee as well as affected households, president of Ward/Communal People s Committee and residential group leader. The measurement team was responsible for determining exactly amount of each type of losses of the households, making record signed by participants and affected households as well as making compensation plan for site clearance. 1.2. Accuracy of DMS: The DMS was conducted democratically and publicly. The records were signed sufficiently by the participants and were posted publicly. When there is any query about the loss, the measurement team would meet directly the households, determine again and confirm the amount of losses. Types of impacts were various, including residential, garden, agricultural, forestry and aquatic land, crop, housing, architectural structures and particularly, 37 households will have to relocate to a new place. Currently, they bought the land and built their houses and they already get their stable life. 2. Information dissemination, community consultation and participation of the people: 2.1. Information dissemination: Information dissemination of Mong Duong TPP 1 project was implemented in compliance with the regulated process. During the implementation and updating RP, PMU, Resettlement and Compensation Council of Cam Pha City and local authorities cooperated together to disclose the project information to people at the project area. The major project information and RAP have been disseminated to all of the affected households via public handbook and information posted at People s Committee of ward/commune and other public areas. 9

LFDC of Cam Pha City is copying and stamping dossiers and compensation plan to hand over to households for being archived. Public meeting was hold, information regarding zoning, unit price and compensation plan in the ward and residential area was posted in the Ward People s Committee, and coordinated with Poxry consultancy to disseminate information regarding compensation, resettlement, livelihood and consult with people. 2.2. Public consultation: Public consultation covers information related to project planning, legal dossiers on site clearance, capital source, compensation and resettlement policies, project duration, entitlement and obligation of affected households on site clearance issue, greivance redress process. People Committee of Dong Duong ward, Employer and consultant units have directly held the community consultation and gathered people s opinions. 2.3. Participation of local people: The affected households could participate in the information dissemination and public consultation meetings. 100% of the affected households representatives participated in the DMS and signed the records. 3. Application and payment of the compensation Approval for compensation and assistance plan for the site clearance of Freshwater supply system has been implemented based on following legal documents: Law on organization of People s Council and People s Committee of Quang Ninh Province dated on 26/3/2003; Decree No. 197/2004/ND-CP dated on 03/12/2004 by Vietnamese Government regarding Compensation, assistance and resettlement in case the government acquires land; Decree No. 69/2009/ND-CP dated on 13/08/2009 by Vietnamese Government; Circulation No. 06/2007/TT-BTNMT dated on 02/07/2007 by Ministry of Natural Resources and Environment (MNRE); Circulation No. 14/TT-BTNMT dated on 01/10/2009 by MNRE; Decision No. 499/QD-UNMD dated on 11/02/2010; Decision No. 1748/QD-UBND dated on 11/6/2010 by Quang Ninh Provincial People s Committee (PPC) promulgating supplement compensation, assistance and resettlement plan in case the government acquires land in Quang Ninh province; 10

Decision No. 398/QD-UBND dated on 27/02/2012 by PPC regarding issuing unit price of compensation for assets invested on land when the government acquires land in the province area; Decision No. 4166/QD-UBND dated on 26/12/2011 by PPC regarding regulations on types of land price in the province implemented in 2012; Decision No. 3566/2013/QĐ-UBND dated on 26/12/2013 by PPC regarding regulations on types of land price in the province implemented in 2014; Decision No. 2808/QD-UBND dated on 20/9/2010 by PPC regarding approval for Construction specific planning at rate 1/500 of freshwater supply system item of Mong Duong Thermal Plant 1 at Mong Duong ward, Cam Pha city. In particular, the compensation for the site clearance and the resettlement of the freshwater supply system was conducted as follows: Freshwater pipelines and power line affected to 65 households that have been completed the compensation plan and it were approved in the payment decision in 2014 in the amount of VND 17.059.295.200. Regarding the lake area, there are 127 affected households have been paid in the amount of VND 84.012.033.600. Time of payment was from 2012 to October, 2014. Table 1. Assistance Types of project assistance according to ADB s policies, such as one for resettlement households movement, stabilizing life and production, job switching, vulnerable subjects, etc., were implemented adequately by Compensation Council of Cam Pha City according to the project RP. 5. Income restoration Program of Income Restoration has started from the quarter 1, 2014. After the livelihood implementation plan was approved by ADB, PMU collaborated with local government and LFDC to do the plan and it have been done as following activities: To organize the media program and to disseminate the model of economic development effectively on the radio and the television in Quang Ninh province. PMU also has worked with the Center of Broadcasting of Cam Pha city to perform some communication reportages to show some models of economic development effectively. However, due to the characteristic of terrain and geography of this reservoir area (area 10, Dong Mo, Mong Duong ward) that has the resettled households who are affected by hilly terrain, the local people mainly income from the planting of timbers (as acacia wood) or food crops or raising of small livestock, so the model of farm is inappropriate and ineffective with the actual situation in this area. For the implementation of management training about IRP in the grade of ward, commune: it was established the department of livelihood restoration consist of PMU, LFDC of Cam Pha city, the mass of commune and ward as Farmers Association, Women s Union, Fatherland Front, etc. The department of Income Restoration have worked with the unit of consultancy HTC to do the implementation of preparing of document, lectures and training organization of TRP management for officers of ward, commune; it had finished in June, 2014. For the implementation of training, supporting to restoration of model of encouragement agricultural expansion (agricultural promotion): the department of Income Restoration had worked with Economic Department of Cam Pha city and the center of encouragement agricultural expansion of Cam Pha city to do the implementation of preparing of document, lectures and training organization for breeding and planting that is suitable to this area for households; it had finished in June, 2014. For the implementation of vocational training: under the proposal, it will be implemented 5 basicly majors: mechanical welding engineering, cars and motors repairing service, M&E service, 12

industrial garment, cooking. The department of Income Restoration have worked with local people in groups and wards to get their aspiration. The effection have got that most of people were expecting to have a training for Motors Repairing Service, Civil Electricity Service, Mechanical Welding Engineering. PMU have contacted to training center or vocational center of city in Quang Ninh province to open the classes for local people. Particulars as follows: Candidates are participated to program of income restoration who are severely affected households and resettled ones. At the moment, department of Income Restoration have organized 3 training courses for 74 students including : Agricultural Promotion, Motors Reparing Service, Cooking. Training time was 3 months, the address for classes was in center of area 10, Mong Duong ward that were organized by center of vocational training of Cam Pha city, all of fee (training fee, lunch fee) were paid by Thermal Power 1 PMU. The program had finished in October 2014. PMU supported to introduce the jobs to local candidates in the majors of Motors Repairing Service or Cooking, it had good results. In schedules, it will be opening the training course for M&E Service in the end of November 2014 when enough about 15 to 20 candidates. 6. Complaint resolution Many meetings and consultations were conducted with affected households in the freshwater lake items in area 10, Mong Duong Ward by Compensation Council of Cam Pha Town, Consultancy, PMU and Mong Duong Ward People s Committee. Content of the meetings focuses on explanation for people s queries about the project application of unit price, compensation and assistance policies and information dissemination. In the 10 th monitoring time, some households who had these queries were considered and addressed by Compensation Council of Cam Pha Town, Consultancy, PMU and Mong Duong Ward People s Committee. Until the 11 th monitoring time (November 201 4), the grievance was basically resolved completely. At the moment, some of aspiration of households are being solved by PMU and Compensation Council as: (i) The households want to have the bank loan with the preferential rate is 0.32% per year, they required that the local government will help them to get the lending from banks but it s the unmortgaged loan. However, banks don t accepted to this option yet. Currently, PMU and Compensation Council are finding to the other suitable method for the local people. (ii) The severely afffected households at the area 10, specially the resettled ones who had the aspiration to get the cultivated land from forestry farm of this area. However, according to PMU, this method was unfeasible. 13

7. Internal monitoring Through desk study, Consultancy recognizes followings: (i) With regard to Mong Duong Thermal Power PMU, at their office of the main plant in Cua Ong ward, Cam Pha city, the document was archived sufficiently; Compensation Council of Cam Pha supplied information frequently and adequately for PMU. (ii) Reporting from the stakeholders to Mong Duong Thermal Power MMPU was frequent and in time. (iii) Legal documents issued by City and Province and grievance of households locating in the area of Mong Duong ward are archived adequately. 8. Relocation: There are 37 resettled households at the freshwater lake of area 10, Mong Duong ward, all of which resettled by themselves according to their wishes presenting at the meetings with the Compensation Council and there are registration application of households (whic h were sent to the households by Employer and People Committee of Mong Duong ward). At the time of monitoring in November 2014, all of resettled households have received compesation, they bought the land, built their houses and get the stable life. In which, there are 7 resettled households relocated to Hai Lang commune, Tien Yen ward to live. The remaining ones built the new houses at group 1, 5, 8 in are 10, Mong Duong ward, Cam Pha city. To consult the resettled households comments, EMA have received their satisfied feedbacks about the implementation of compensation and their life by now. The resettled household Dang A Ung, 55 ages, Dao ethnic people said that: My family have received VND 1,2 billion of compensation, we bought the land at area 10 with VND 150 million, to built house and to bought interior funitures with VND 850 million, remaining VND 200 million for saving in the bank. Currently, my family has the stable life, my family has 2 grown-up children and they are working outside, so that we have no ones to participate to income restoration program. My family has no idea about the project but we have the aspiration to grant some of the arable land. Although we have the spacious life in a new place but we have a little or nothing of land for cultivation. The resettled household Phung Dinh Vinh, 46 ages, Dao ethnic people said that: we are affected to 0.7 hectars consist of forest, cultivated land and living land. We have received VND 700 million from the compensation, we bought the land at area 10 with VND 80 million, to built the house and to bought the lorry with VND 300 miliion for our transport business. My 14

family has no idea about the project but we have the aspiration to grant some of the cultivated land because in the new place that is narrow, we have a little or nothing of land for cultivation. IV. CONCLUSION AND RECOMMENDATIONS (i) In the 11th monitoring, EMA focussed on monitoring the implementation of site clearance and RP compliance at the component of freshwater supply system. Until to November 2014, the implementation of site clearance and resettlement basically have been completed. In which, the pipeline system had completed since the end of 2013. The area of reservoir (area 10, Mong Duong ward) actively had implemented in the task of site clearance by Thermal Power 1 PMU and Cam Pha LFDC and People s Committee of wards in November 2014. (ii) A few small matter has been solved as: there are some comments of local people about cofusion of assets, land because of them splited to their brothers, descendant of the family, some cases of lack of assets These matters have been checked and solved quickly by Thermal Power 1 PMU and Cam Pha LFDC, there is no disadvantage to any the affected households. Beside of that, some households who wish to be trained, bank loans and some cultivated land. (ii) Thermal Power 1 PMU and consultancy agencies need to increase monitoring during the implementation of the components in order to ensure that any adverse impact on the people will be inventoried and compensated timely in compliance with the project policy. (iv) Cam Pha LFDC, is the agency directly implementing the site clearance and the compensation payment; therefore, it is necessary to have a better cooperation with the stakeholders, particularly the followings: supply frequently and timely documents and data of the site clearance and the resettlement to Thermal Power 1 PMU adequately and frequently, cooperate better with Consultancy and the stakeholders to help them complete their tasks well. (v) The stakeholders need to pay attention to sustainable income restoration program for people; especially for vulnerable and difficult households, it is necessary to have long-term strategies so that they can have better lives after resettlement and livelihood strategy for each severely affected or relocated households needs to determine clearly the project impacts on them and their members; (viii) The livelihood program needs to be implemented with the cooperation of authority levels and other stakeholders in order to make the most favourable conditions for the severely affected households to participate to job trainings and after that, they will be have the placement or supporting for job to restore their income. 15

V. FOLLOWING MONITORING PLAN In the following monitoring (the 12 th monitoring), Consultancy will focus on evaluating the whole of issue of site clearance, resettlement and income restoration of the entire project. This report will be updated all of issues related to site clearance and resettlement, income restoration This is also the final assessment for the entire project that has been implemented. Evaluating monitoring will be referred to the issues that had achieved and not achieved yet; the effect of the income restoration program and the remaining matters that can be showed the experiences for the implementation of next project. The external monitoring will focus on following issues: The inventory activities and making DMS The information dissemination, public consultation and the people s participation The application and payment of the compensation The assistance The relocation for the resettlement The income restoration Gender and ethnic minorities issues Grievance redress Internal monitoring 16
