Technical Assistance for Ben Luc Long Thanh Expressway Project I. PROJECT INTRODUCTION Inception Report 1.1 Project summary Ben Luc - Long Thanh Expressway Project has an overall length of 58km. It traverses through 16 communes in 7 districts of 3 provinces. The start of the project is from My Yen commune and part of an access-road in Tan Buu commune, Ben Luc district, Long An province; then it goes through Binh Chanh, Tan Quy Tay, Hung Long and Da Phuoc communes in Binh Chanh district; Nhon Duc and Long Thoi Commune in Nha Be district, Binh Khanh commune in Can Gio district, Ho Chi Minh City; then goes through Vinh Thanh, Phuoc An communes in Nhon Trach district, Long Phuoc and Phuoc Thai communes in Long Thanh district, Dong Nai province. Technical Assistance for Ben Luc Long Thanh Expressway Project The land acquisition area along the route varies from 56m - 73m wide. Inception Report To minimize resettlement impacts as required by ADB s policy, the Road safety corridor provided by Decree No.11/2010/ND-CP will not be applicable for this project. Vietnam Expressway Corporation (VEC) is the implementing agency for implementation of the Project. Overall alignment Map The site clearance and resettlement activity is divided into 03 subprojects which have been assigned to Ho Chi Minh city, Long An and Dong Nai provinces for implementation. After that, each province continues decentralization to assign its districts to become sub-project investors for the implementation of site clearance and resettlement. 1.2. Project implementation progress - PPTA has started since 2009. - Technical design adjustment started in the end of 2011. - The site clearance and resettlement implementation plan was conducted from 2011 to 2014. - The construction is expected to start in the end of 2013 and complete in 2017. 1.2.1 Overall Progress until now (May, 2013) Because land acquisition and resettlement work has been decentralized and assigned to be the sub-project investor who directly implement resettlement. Accordingly, the land acquisition and resettlement of the project will be divided into 07 different progresses: Long An Ben Luc: the preparation for compensation payment to households is completed. The URP is waiting for the approval from ADB. Page 6

Technical Assistance for Ben Luc Long Thanh Expressway Project Inception Report Can Giuoc Advanced compensation has been paid to 165/227 affected households (72.69%). ERP has been submitted to EPMU in January and April, 2013 by KEI-NE and waiting for the approval from ADB.. b. Ho Chi Minh Binh Chanh has been conducting DMS and price valuation. The compensation payment is expected to start in Nov, 2013. Nha Be: Advanced compensation has been paid to 121/428 affected households (28.27%). Nha Be s URP was submitted to EPMU in Jan, 2013. ADB has required additional update to livelihood restoration in URP which will be submitted in June, 2013. Can Gio: Advanced compensation has been paid to 193/198 affected households (97/47%). URP has been submitted to EPMU in Oct, 2012 and Jan, 2013 by KEI-NE and waiting for the approval from ADB. c. Dong Nai Nhon Trach has been conducting DMS and price valuation. The compensation payment is expected to start in the end of 2013. Long Thanh has been conducting DMS and price valuation. The compensation payment is expected to start in the end of 2013. 1.2.2 Resettlement and relocation implementation progress a. Long An Ben Luc and Can Giuoc: have introduced 03 completed resettlement sites and available in the districts (02 sites in Ben Luc, 01 site in Can Giuoc) for resettlement options. b. Ho Chi Minh Can Gio and Nha Be have introduced 04 completed resettlement sites and available in the districts (03 sites in Can Gio and 01 site in Nha Be) for resettlement options. Binh Chanh has been reviewing the available resettlement sites in the district for resettlement selection. c. Dong Nai Nhon Trach and Long Thanh: The PPC has made decision to construct 04 resettlement sites (Long tho and Phu Thanh Vinh Tan in Nhon Trach district); Tan Hiep and Phuoc Thai in Long Thanh district) for resettlement. Some highlights for resettlement and compensation work 1.4.1 The compensation payment has been conducted According to the Loan Agreement 2730-VIE, Appendix 5, Resettlement, Section 9 and 11: (9) The Borrower and VEC shall ensure that the RP is updated, on a district by district basis, upon completion of detailed designs and is submitted to ADB for review and concurrence. No land acquisition or site clearing shall commence until (a) the RP has been updated and agreed between VEC and ADB; and (b) provisions of such updated RP have been implemented. In case of differences between the Borrower s laws and regulations and the Safeguard Policy Statement, the Safeguard Policy Statement shall prevail. The Borrower shall ensure that VEC is responsible for internal monitoring of resettlement and will submit progress reports on resettlement activities to ADB on a quarterly basis, as part of the Project progress reports. (11) The Borrower shall ensure that VEC does not issue a notice of possession of site for any expressway section until its head of District Compensation and Site Clearance Committee has officially confirmed in writing that (a) payment has been fully disbursed to the affected persons and rehabilitation measures are in place as per the RP and its updates; (b) already-compensated affected persons have cleared the area in a timely manner; and (c) the area is free from any encumbrances In fact, Can Giuoc district in Long An province, Can Gio and Nha Be districts in Ho Chi Minh city have made advanced compensation payment for the affected households. However, the local people said that there was not any notice of ownership of the site, land acquisition, resettlement and relocation for affected households. This shows that that the local authorities have complied with Clause 11 of the agreement, which has not affected the ownership and relocation of affected households. 1.4.2 Deployment of Income Recovery Program Planning The income restoration plan has been carried out consultations at the third round for Long An and Dong Nai provinces and the second round for Ho Chi Minh city. The first round included consultation with local authorities, the second round conducted consultation with affected households and the third round reconsulted the local government to reaffirm the results of the first and second rounds. On this basis, the RP Consultant has been requested to provide the outline of income restoration program to the updated RP for submission to ADB for approval. OBJECTIVES AND SCOPE OF INDEPENDENT MONITORING 2.1 Objectives of resettlement monitoring Inception Report The main objective of the independent resettlement monitoring is to review and assess periodically and independently (i) the achievement of the resettlement objectives; (ii) the changes in living standards and livelihoods; (iii) the restoration and/or improvement of the socio-economic conditions of the affected people; (iv) the effectiveness and sustainability of entitlements; and (v) the need for additional mitigation measures. The strategic lessons for policy development and future plans will be drawn from the monitoring and evaluation of resettlement. This can be done through the Research, Assessment and Implementation after resettlement that EMA will perform from 6-12 months after completion of resettlement work. 2.2 The scope of consultant work The consultant will carry out the resettlement independent monitoring for subprojects under the regulations outlined in the Resettlement Policy Framework (RF) of the projects approved by ADB and the Vietnam Government and the RP includes: a. Monitoring the implementation of resettlement (DMS, legality, compensation, compensation payment, assistance, resettlement, rehabilitation and life stabilization for affected households, consultation information, grievance redress, gender issues and others. b. Implement monitoring along the entire project route under resettlement impacts, including 7 affected districts and 19 communes in the provinces as in the table above. There are total 10 monitoring missions with the frequency of 3 months / 1 time. During the 10 monitoring missions, EMA will hold 100% sample survey of severely affected households (relocated households and households with loss of 10% or more of agricultural land / income level) and 20% of slightly affected households. c. Implement final monitoring and evaluation for the entire project after the completion of resettlement activities in 06 months Frequency of monitoring will be carried out every 3 month, starting from July 2013 to March 2016. The final monitoring and evaluation for the entire project within 06 months will be conducted after the completion of resettlement activities. A total of 11 consultants will carry out monitoring visits. Page 12

Technical Assistance for Ben Luc Long Thanh Expressway Project III. TASKS AND MONITORING METHODS Inception Report 3.1. Semestral monitoring of resettlement plan 3.1.1 Main activities: Main Activities: Resettlement External Monitoring activities are works relative to compliance monitoring during resettlement implementation, the main activities of the EMA will revolve around the following: a. Review existing baseline data and gather additional socio-economic information, as necessary, on sample AP households; b. Monitor updating and implementation of the RP; c. Identify any discrepancy between policy requirements and actual implementation of resettlement; d. Monitor the resolution of complaints and grievances of APs; e. Provide recommendations for improving resettlement updating and implementation; f. Review compliance with regard to use of ADB loan funds for land acquisition and resettlement; g. Issuing certification that each AP has received the full payment; and h. Post-Resettlement Implementation Evaluation Study. i. Review effectiveness of income restoration activities; monitor the extent that women participate in the resettlement consultations and benefit from income restoration programs; timeliness of disbursement of compensation and assistance; effectiveness of consultations (in terms of inclusiveness, timeliness and extent to which they provide opportunities for participation in decision making); appropriateness of replacement cost upon which compensation paid. Specific Issues: Specific to resettlement updating and implementation activities, the EMA will address specific issues such as the following: a. Impact and strategy for Gender, including the extent of the participation of women in resettlement activities such as consultations and income restoration measures as well as the extent to which livelihoods of women have been restored and/or improved. ; j. Extent to which the livelihoods and living standards of APs have been restored as well as extent to which the living standards and livelihoods of vulnerable APs have been improved; k. Resettlement impacts caused during construction activities; l. Participation of APs in scheduling, updating and implementing of RP; m. Competence, regularity, internal monitoring report; n. Allocation of government s fund for land budget, non-land assets, bonus for AHs; With regard to use of ADB loan funds for land acquisition and resettlement, the EMA will monitor and assess the following: a. Identify whether APs are covered under the RP and that they are all eligible for compensation, resettlement and rehabilitation assistance, irrespective of tenure status, social or economic standing, and any such factors that may discriminate against achieving the project objectives. Timing of disbursement of payment and documentation DMS and payments; b. Channeling of funds (if done transparently, efficiently and effectively); c. Compliance to use of loan funds (thru Second Generation Imprest Account or SGIA) which are limited to VEC providing funds for payments: (a) to Page 14

Technical Assistance for Ben Luc Long Thanh Expressway Project Inception Report project affected persons for land and other assets acquired to facilitate the construction of the HLD Expressway; (b) to AP for resettlement compensation and allowances as set out in the approved updated Project Resettlement Plan, and (c) for incremental expenses incurred by the City, Provincial and District Resettlement Committees necessary for the implementation of the approved updated RP (e.g., relocation site development, income restoration program); and d. Proper documentation on liquidation of any amount paid from any SGIA for land or other assets (a) a valid validation certificate issued by an independent valuer acceptable to both the Government and ADB; (b) the results of the detailed measurement survey (DMS) for the AP receiving the payment, signed as agreed by AP, setting out the assets to be acquired; (c) that receipt of payment is acknowledged by the AP. The EMA is also required to be present during disbursement of compensation to APs and to issue certification that each AP has received the full payment. 3.1.2 Report The consultant will prepare monitoring reports for each monitoring trip with the following contents: a. The process of updating and implementation of land acquisition and resettlement plan including any changes in the conditions of the RP; b. Identify issues and propose solutions to inform the implementation unit and solve issues according to schedule; c. Identify the specific issues of gender and ethnic minorities, as appropriate; d. Report on the progress of the implementation process of the next jobs and issues outlined in the previous reports, e. Audit the resettlement. EMA report form is attached. 3.1.3 Monitoring methodology 1. Compliance monitoring methods will be used in the summary as follows : a. Review of detailed measurement survey (DMS) documents to be able to establish a baseline for monitoring and evaluating project benefits. The EMA to check on a random basis the DMS process with APs from identification to agreement on DMS results. During the conduct of the DMS, the EMA will monitor the DMS process (based on the random sample survey) to determine and assess if DMS activities are being carried out in a participatory and transparent manner. Technical Assistance for Ben Luc Long Thanh Expressway Project Inception Report b. Review of Socio-economic Survey (SES) baseline prepared during PPTA. If land acquisition does not occur for at least two years, EMA will carry out another SES. The SES data will be gathered at the individual as well as household level. A sample target should be set for percentage of vulnerable groups such as households headed by women, poor and landless, etc. A post resettlement survey will be carried out 01 year following completion of resettlement activities. Sampling will include 20% of severely affected APs as well as at least 10% of all other APs. The same APs interviewed during RP updating will be interviewed. Special attention will be paid to the inclusion of women, ethnic groups, the very poor, the landless and other vulnerable groups, with set questions for women and other target groups; and, the database disaggregates information by gender, vulnerability and ethnicity. With total number of survey households of about 1.500 households, each monitoring will conduct interviews for 150 affected households on the route. c. Participatory Rapid Appraisal (PRA), which will involve obtaining information, identifying existing or potential problems, and finding specific time-bound solutions through participatory means including: - Key informant interviews; - Focus group discussions on specific topics such as compensation payment, income restoration and relocation; - Community public meetings to discuss community losses, integration of resettled households in host communities or construction work employment; - Direct field observations, for example, of resettlement site development; - Structured and unstructured interviews of 20% marginally affected households and 100% of seriously affected households. The interviews should focus on affected women, ethnic minority, and other vulnerable groups to monitor and asses the progress the APs are making to restore their living standards; and, - In-depth case studies of problems are identified by internal or external monitoring and required special efforts to resolve. The PRA will follow good practice. d. Post-Resettlement Implementation will be carried out during the monitoring period. EMA will present the payment certificates for households at Page 16

Technical Assistance for Ben Luc Long Thanh Expressway Project Inception Report disbursement process. The EMA report will include the resettlement audits for every monitoring period. A report will be prepared and submitted to VEC and ADB for comments. Outline of the monitoring report is included in Appendix 2 3.2. Monitoring and final evaluation Between 6 to 12 months following completion of resettlement, the external resettlement monitoring consulting services will conduct an evaluation study to determine whether or not the objectives of resettlement have been achieved. The methodology for the evaluation study will be based mainly on a comparison of the socio-economic status of severely affected households prior to and following displacement. If the findings of the study would indicate that the objectives of the RP have not been achieved, the EM will propose appropriate additional measures to meet the RP objectives. Activities will include the following: a. Evaluate baseline data that was collected under the socio-economic survey to assess changes in: household income and expenditures, expenditure composition patters, primary and secondary occupations, borrowing amounts and debts patterns, materials conditions and possessions of consumer items, land area and tenure arrangements, school attendance of children, child malnutrition and general health, and distances to public services and infrastructure. b. Collect qualitative indicators on the APs' own assessment of changes in living standards before and after the project at households and community levels, which may be collected through open-ended questions, semistructured interviews, case-studies, or group discussions employing a range of PRA tools and methods. c. Verify with the APs that community services and resources damaged during construction works have been fully restored to their previous conditions and operational capacity. IV. OUTPUTS AND IMPLEMENTATION PLAN 4.1. Outputs The consultant will submit VEC and ADB reports including the Inception report, Semestral monitoring reports, Final evaluation reports and data collection and process. Implementation plan At the launch meeting between representatives of the PMU and the consultant unit (Infra-Thanglong) and Updating RP Unit reached a preliminary plan with some of the following contents: 1. EMA accelerate the completion of the draft inception report to submit to VEC and ADB on May 13, 2013. 2. As in written request to VEC by ADB on April 10, 2013 VEC, VEC needs to prepare additional TOR and implement the due diligence for the case of households who have received the compensation before the approved updated RP in Can Giuoc, Nha Be and Can Gio districts. The additional TOR will be conduted by the EMA then submitted to VEC on May 13, 2013. It is expected that the due diligence of the 03 districts will be completed before June 30, 2013. In addition, the plan to monitor the implementation phase is expected in Appendix 2. 4.3. Staff In agreement with the VEC, the Consultant unit will mobilize the Consultants to start work on May 08, 2013.
