HO CHI MINH CITY URBAN MASS RAPID TRANSIT LINE 2 INVESTMENT PROGRAM Ben Thank Tham Luong Route I. OVERVIEWS 1.1. Brief Project Background The Urban Railway Line 2 (Metro Line 2) is one of eight urban railways in Ho Chi Minh City (HCMC). The Ho Chi Minh City Mass Rapid Transit Line 2 Investment Program (the Metro Line 2 Project or the Project) is one part of the Urban Railway Line 2. The Project involves construction of a depot, ten (10) underground and one (01) elevated stations on the length of 11.3 kilometers (km) of urban dual rail line from Ben Thanh to Tham Luong (including 9.3 km underground, 0.2 km transition and 1.8 km elevated). The Project is implemented in the Districts No.1, No.3, No.10, No.12, and Tan Binh and Tan Phu Districts. 2. In initial plan, the Metro Line 2 Project, Ben Thanh Tham Luong has the total investment cost of 1.37 billions USD in which ADB fund: 540 millions USD, KfW: 313 millions USD, EIB: 195 millions USD and Vietnamese Government: 326.5 millions USD. However, the Project total investment cost and funding structure are under review and adjustment. 3. The Project has 11 stations including 10 underground stations, 01 elevated station (Tan Binh ) and 2 C&C Sections. According to updated data, the Project land acquisition scope is 249,777.1 m2, of which land acquisition area of households, individuals, organization with compensation an and support: 49,400 m2. All underground stations, including the two tunnels of the Project will be constructed under existing city roads, namely Truong Chinh and Cach Mang Thang Tam roads. Except for both ends of the underground stations where escalators will be constructed, the main body of the stations will be built within the existing "planning line" - a demarcated area from both edges of a road which restricts the construction of buildings even on privately-held lands for safety reasons. Each station will be constructed with gate stations and ventilation systems (include fan and ventilation pipes). Most of the land acquisition and resettlement impacts are from these gate stations and ventilation systems. Resettlement Progress Report Quarter 1V2016 P a g e 5

---S.- HO CIII MINH CITY URBAN MASS RAPID TRANSIT LINE 2 INVESTMENT PROGRAM Ben Thanh Them Luong Route 5. The Tham Luong Depot is located in District No. 12. In the long term, the Tham Luong Depot may also be required to serve Metro Line 6 and the proposed extension of Metro Line 2 from Thu Thiem to An Suong. Total land acquisition for construction of the Tham Luong Depot is about 25.7 hectares (ha), and will be divided into 2 phases: (i) phase 1: 18.84 ha for building the executive office and resettlement area households displaced from the depot area; and (ii) phase 2:7.76 ha for construction of infrastructure and the depot's auxiliary facilities. The layout of the Tham Luong Depot is shown in the Figure 2 below. As planned, after the project completion, there will be a sustainable urban transport system established in the Districts of the Project and provision of public transport with competitive price along the Project. The Project will reduce the increase of private means of transport, improve urban environment, reduce accident and air/noise pollution and create more friendly environment for pedestrians. The Project also support for the effort of minimizing climate change in the city by applying low carbon transportation and encouraging the change from using private means of transport, which is more energy efficient and emits less greenhouse. 1.2. Land acquisition and resettlement scope 7. According to updated data as at 31 March 2018, the Project implementation will affect 608 households 515 individuals and 93 organizations in 06 Districts of HCMC, including: District 1, 3, 10, Tan Binh, Tan Phu and 12. 111 cases will be totally recovered their land and need to be relocated. Remaining households (497) are partially affected on land, houses and structures. Total permanent land acquisition area for the Project implementation is 249,777.1 m2 (excluding Tham Luong Depot area). For more details, please refer to Item 11 and Table 2 in page 8 below. According to requirements of safeguard policy of the project regulated in ADB SPS 2009, quarterly internal monitoring reports on compensation, support and resettlement activities of the Project will be prepared by MAUR and submitted to HCMC PC and Donors (ADB, EIB and KfW). 9. Main objectives of the quarterly internal monitoring report for Quarter 112018 include: (i) Review the implementation progress of all issues related to resettlement activities of the Project in Quarter 1/2018. (ii) Activities expected to be implemented in Quarter 1112018. Resettlement Progress Report Quarter IV2O16 P a g e 8

Updating number of affected households of the project (PAll) 10. According to the figures updated to 31 March 2018, total affected households of the Project is 608 PAHs, of which 515 households and 93 organizations. Among 608 affected households, 111 households are fully affected and have to be relocated; and the remaining (497) households are partially affected on their houses and structures. Details of number of affected households, classification of affected households are described in Table 2 below. Therefore, total affected households at the end of March 2018 is 608, changed compared at the end of June 2017 because there are some small affected cases not land acquisition. However, number of affected households may continue change when the District PCs approving the detailed compensation plans. The changes of the total affected households (if any) will be updated in the next resettlement progress reports. 2.2. Updating progress of the Updated Resettlement Plans (URPs) 12. According to the plan agreed with ADB Mission in April 2016, the URP of the Project will be updated and submitted one time for all affected districts of the Project in October 2016. However, due to some difficulties during implementation, the implementation progress of related activities in some districts was not ensures. Therefore, ADB and MAUR discussed and agreed the adjustment of updating and submitting plan of the Resettlement Plan for the Project to suit with the actual situation. Accordingly, the URPs will be updated and separately submitted for each district right after finalizing the draft detailed compensation plan and announcing to affected households. 13. The draft version of the URPs for Districts No. 3 and Tan Phu were prepared and submitted to the ADB and the City Compensation and Apraisal Board for review on 15 October 2016. After review, ADB provided the comments for the draft URPs on 07 November 2016, accordingly, ADB requested the City Compensation and Apraisal Board review and comment the draft URPs before submission. In December 2016, the MAUR explained to the City Compensation and Apraisal Board the relevant contents of Entitlement Matrix, Greavance Redress Mechanism, income restoration measures which mentioned in the draft URPs for Districts No.3 and Tan Phu. In February 2017, the City Compensation and Apraisal Board had comment. Dated 17/02/20 17, MAUR has revised, supplement the contents as required by ADB, the City Compensation and Apraisal Board and HCMC-PC to finalize the URPs for Districts No.3 and Tan Phu and resubmitted to ADB. On 21/4/2017, ADB has comments from URP District 3 and Tan Resettlement Progress Report Quarter IV2O16 P a g e 110

On 12/6/2017, ADB approved URP District 3. 14. Draft version of URPs for Districts No.1, No. 10, No.12 were prepared and submitted to ADB in December 2016. On 09/6/2017, MAUR updated and supplemented the relevant contents as comments of ADB, City Compensation and Apraisal Board, HCMC-PC for the URPs for Districts No.1, No. 10, No.12, Tan Phu, Tan Binh and resubmitted to ADB.On 23/6/2017, ADB approved these URPswith condition that MAUR shall finalize these URPs according comments ADB. 15. Then, MAUR had completed contents, re-submitted and on 28th February 2018, ADB had Fax letter to approve URPs of 6 districts. However, HCMC PC has still concerned about performance of AM in URP so that they have not yet considered and approved IJRPs. 2.3. Detailed Measurement Survey (DMS) 16. The DMS includes many different activities and can be divided into 02 main activities groups: (i) investigation, survey, measurement of affected land area, houses and structures; and (ii) legal verification of affected land, houses, structures. As of 31 December 2016, all districts completed the work of DMS. 2.4. Arrange the apartments for relocation 17. In preparing for relocation of the relocating households, District Compensation and Site Clearance Boards havearranged the fund of apartments for reloation. Accordingly, 142 apartments for relocation have been prepared in District 4 including District No. 1, No. 3, No. 10 and Tan Binh with the number of arranged apartments: (i) District No. 1: 09 flats in apartment building 203 Nguyen Trai District No. 1; (ii) District No. 3: 16 flats in SCREC apartment building Ward No. 12 District 3 and 30 flats in apartment building No. 4 Phan Chu Trinh Ward No. 12 Binh Thanh District; (iii) District No. 10: 33 flats in Nguyen Kim apartment building Ward No. 7 District No. 10; and Tan Binh District: 38 flats in Lot A, Tan Tru apartment building Ward No. 15 and 19 flat in Lot J Bau Cat 2 apartment building Ward No. 10 Tan Binh District. 18. Apartment price for relocation will be also defined according to market price. Consultants will appraise the price and propose price for each apartment and DOC will issue letter announcing official selling price. Information on resettlement flat selling price will be noticed to affected households together with Ti price during the announcement of the draft detailed compensation plans by the District Compensation and Site Clearance Boards. 19. As of 31 December 2016, DOC has issued the apartment price for relocation in Districts No.10, No. 1 and No.3. Apartment price for relocation in Tan Binh district has issued in February 2017 by the DOC. 2.5. Announcement of the Ti price and draft detailedcompensation plan to the PAils 20. Up to 31 December 2016, based to land price appraised by the Independent Land Price Apraisal Consultant, DONRE has announced the d proposed compensation price-frame (Ti) in all affected districts. The Ti prices have also been publicly announced by the Resettlement Progress Report Quarter 1V20 16 P a g e 11

By the end of February 2017, District PCs will summarize the PAHs' comments on the TI price and propose the final price for compensation (T2) to the HCMC-PC for review and approval. The T2 price will be the legal basis for District PCs issuing the compensation decisions for the PAHs. 22. On October, November 2017, HCMC PC had considered, approved land price adjustment coefficient to calculate compensation, support of the Project in districts: 1, 3, 10, 12, Tan Binh and Tan Phu (T2 price). Currently, PC of districts drafted decision of land acquisition, decision of resettlement plan approval for each affected case. After HCMC PC consider and approve URP, PC of districts will issue the above-mentioned decisions. 2.6. Public consultation and information disclosure 23. Project information Booklets (PIB) has been prepared for providing to affected households during the implementation of compensation, support and resettlement activities. This is a document briefing the policy on entitlement of affected households based on the Resettlement Framework of the Project (2010) and Resettlement Plan (2012) accepted by HCMC and ADB. 24. Main information in PIB include: Brief on the Project: (i) Project's impacts; (ii) Project owner and Implementation agency; (iii) stages and implementation time frame; (iv) Expected Project Total Cost Estimate; (v) Donors' name and investment amount for the Project. Compensation, support and resettlement policy for affected households by the Project: (i) compensation, support and resettlement principle of the Project; (ii) compensation, support policy for affected houses, structures, architectural items; and (iv) other support policies. Grievance Redress Mechanism. - Contact address: provision of name, address, phone number of the agencies related to the Project compensation. 25. During the announcement of draft TI price in affected wards of all affected districts (06), MAUR coordinated with the District Compensation and Site Clearance Boards to provide information and conduct consultation with affected people and agencies/organizations affected in land acquisition, resettlement and issues related to the construction of stations in the Districts. 26. Consultation activities were conducted in Districts No.1, No. 3, No.10, No.12, Tan Binh anh Tan Phu from October 2016 to February 2017 with the participation of the representatives from local government, communist party organizations and households affected by the Project. Main issues consulted with affected households and organization include: (i) affected scope of stations according to DMS result; (ii) legal condition and entitlement of compensation, support and resettlement; (iii) implementation plan and participation of affected people and communication; (iv) Grievance Redress Mechanism; and (v) How were comments and recommendations Resettlement Progress Report Quarter IV2O16 P a g e 12

Pifi was also provided to affected people and posted at offices of residential group and offices of WPCs. 27. During consultation, affected households expressed their concerns on issues related to compensation, support and resettlement policy of the Project. Issues related to impacts to income of business households during construction, compensation unit price, grievance redress mechanism... were also raised by households. Questions from affected households were responded by representatives from District Compensation and Site Clearance Boards and MAUR. Detailed information on consultation will be also updated into the Updated Resettlement Plans of the districts. 2.7. Complaint and complaint solving 28. As mentioned in the previous progress report, the Grievance Redress Mechanism set up in RP 2012 is not consistent with actual condition of the Project. Therefore, a procedure of complaint solving was set up and proposed to be applied for Line 2 Project. The established procedure was based on ADB requirements and Vietnamese legal procedures on complaint solving and the provisions of the HCMC-PC on the settlement of complaints. 29. Summary of the procedures for settlement of complaints which was proposed for the Metro Line 2 Project as followings: The PAHs, who disagrees with any content related to the activities of compensation, assistance and resettlement of the Metro Line 2 project may send their inquiries or complaints to the competent authorities for review and resolve in accordance with the following steps; and the aggrieved affected person will not have to pay any fee for his/her case. 30. MAUR is responsible for recording and documentation of the complaints and grievances related to land acquisition and resettlement and present the progress of grievance redress in the quarterly reports submitting to HCMC-PC and ADB. 31. In January 2017, HCMC-PC has send the official document to the ADB to propose the procedures for settlement of complaints of the Metro Line 2 Proejct as mentioned above and the procedures has been updated in the URPs of the districts. 2.8. Complaints, inquires received and solved 32. According to Vietnamese legal regulation, complaint related to compensation, support and resettlement of the Project will only start when authorities issue administrative decisions such as land acquisition decision and compensation, support and resettlement decisions. Therefore, as of31 March 2018, no complaint related compensation, support and resettlement of the Project was received. 33. During implementation of related activities such as DMS, announcement of draft Ti price, compensation plan drafting... related questions from affected households will be reviewed and solved by People Committee of Wards anddistrict Compensation and Site Clearance Boards. 2.9. Difficulties during implementation 34. In Tan Binh district, due to the large number of affected households and more than 50% of total AHs of the project, the implementation of DMS activities, legal documentation Resettlement Progress Report Quarter 1V2016 P a g e 113

By 3 1/12/2016, the detailed compensation plan has been finalized. Detailed compensation plan was publicly listed and opinions of affected households in Tan Binh were implemented in February 2017. Summary of activities related to compensation, support an resettlement of the Project by 31 March 2018 and comparison of milestones agreed in MOU dated December 2016 is shown in Table 3 below. After the HCMC PC comments on and finalizes the revised URPs, ADB will forward these documents to its Safeguard Department for comment. After comments from the Safeguard Department are given to MAUR, HCMC PC will implementation progress as of3l March 2018 MAUR coordinated with the District Compensation and Site Clearance Boards of Districts No. 1, No.3, No. 10, No. 12, Tan Phu and Tan Binh to implement consultation activities from October 2016 to February 2017 combining with the announcement of Ti price. Verification of legal ity for use of land, houses and land-attached assets for Tan Birth District is expected to be completed in February 2017. URPs for districts No.3 and Tan Phu have been prepared and submitted to the Compensation Apraisal Council and ADB for review in October and November 2016. In February 2017, MAUR submitted the revised URP of District 3 and Tan Phu (including Compensation Appraisal Council reviewed). In April 2017, ADB had comments the revised URP of District 3 and Tan Phu. In May 2017, MAUR submitted URPs for Districts 1,3,10,12, Tan Binh and Tan Phu. In June 2017, ADB approved of URP for District 3. ADB approves URP for districts 1,10,12, Tan Binh and Tan Phu provided that MAUR will complete these URPs in ADB opinion. Then, MAUR had completed contents, resubmitted and on 28th February 2018, ADB had Fax letter to approve URPs of 6 districts. COMPENSATION, ASSISTANCE AND RESETTLEMENT ACTIVITIES EXPECTED TO BE IMPLEMENTED IN QUARTER 1112017 3.1. Updating the Resettlement Plan of the Project 35. In June 2017, ADB approved URP. for districts 1,3,10,12, Tan Birth and Tan Phu provided that MAUR will complete these URPs in ADB opinion. 36. Currently, MAUR had completed contents, re-submitted and on 28th February 2018, ADB had Fax letter to approve URPs of 6 districts. 37. Currently, HCMC PC has still concerned performance of AM in URPs so that they have not yet approved URPs. In June 2018, MAUR continuously report HCMC PC relating to AM after ADB responded on concerns of HCMC Appraisal Compensation Committee relating to AM. 3.2. Implementation of compensation, support and resettlement activities of the project 38. Activities of compensation, support and resettlement payment of the Project will be commenced after ADB and HCMC PC agreed and approved URPs of districts. 3.3. Other related activities a. Relocation Muslim Cemetary at 360C CMTT District No. 3: 39. Further to information provided in the Quarterly Report 11/2017. To date, the Muslim Community has had Management Board. The activities related to compensation, assistance and reloction of the Muslim Cemetery will be performed by the new Management Board. Currently, the new Management Board is coordinating with the Compensation Board of District 3 to complete the legal documents prepared for the relocation work. b. Compensation, assistance and relocation for the PAHs at the Tham Luong Depot in District No. 12: 40. For Area 1-18.84 ha: Up to 31 March 2018, the compensation, assistance were paid for 90 PAHs in a total of 92 PAHs. The remaining PAl-Is (Ms. Nguyen Thi Mong Thuy HH and Mr. Nguyen Van Truong HH) have complaints on the land using right and these cases are being reviewed by the Court, therefore the amount of compensation, assistance for these HHs has been transferred to the accounts in State Treasury of District No. 12. District 12 Compensation Board continues to work with Ms. Thuy and Truong to soon not hand over the site for the project. 41. For the Area 11-7.76 ha: There are 18 affected households due to land acquisition of Area II. To date, there are 12 households received compensation, support and handed over their land for the project.
