RESOLUTION NO. A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK ESTABLISHING THE COST OF CANDIDATE STATEMENT FEES FOR THE 2017 MUNICIPAL ELECTIONS. THE COUNCIL OF THE CITY OF BURBANK RESOLVES: 1. Pursuant to Section 2-3-1206 of the Burbank Municipal Code, each candidate for a City of Burbank elective office may prepare a candidate's statement and submit it to the. 2. The City shall not provide a subsidy for candidate's statement submitted to the and therefore candidates are responsible for all costs including printing of. Pursuant to the Federal Voting Rights Act, the City is required to print a multilingual Voter Information Pamphlet (English, Spanish, Korean, Tagalog and Thai) pursuant to the Federal Voting Rights Act. Therefore, if a candidate wishes to print their candidate statement in any of the above languages all ccosts also includefor the printing, translation and taxes. shall be the responsibility of the candidate. In addition, if a candidate desires to have their statement printed in any other language not required by the Federal Voting Rights Act, the candidate will have to pay all costs for printing, translation and taxes. The shall estimate the total cost of printing, handling, translating and mailing the candidates' statements, and shall require each candidate filing a statement, as a condition of having his or her statement included in the Voter Information Pamphlet, to pay in advance an estimate of his or her pro rata share. Within thirty (30) days of the election, the shall bill each candidate for any cost in excess of the deposit or shall refund any unused portion of the deposit. No statement will be included in the Voter Information Pamphlet where the payment for the pro rata cost has not been made timely. However, if, pursuant to Burbank Municipal Code Section 2-3-1207, a candidate is determined to be indigent, the shall print and mail the statement without requiring the indigent candidate to pay the fee in advance. 3. The shall provide each candidate or the candidate's representative a copy of Burbank Municipal Code Sections 2-3-1206 and 2-3-1207 and this Resolution at the time nominating petitions are issued. 4. All previous resolutions establishing Council policy on the payment for candidates' statements are hereby repealed. 5. This resolution shall apply to the 2017 Municipal Elections to be held on February 28, 2017, and April 11, 2017, and shall have no further force or effect after conclusion and collection of the cost of candidate statements for said election as Page 1
