University Hospital Lewisham Lewisham High Street London SE13 6LH Tel: 020 8333 3000 Fax: 020 8333 3333 Web:www.lewishamandgreenwich.nhs.uk 31 January 2018 Request Reference: RFI-002187 I am writing with regards to your request for information which was received by the Trust on 02 December 2017. Your request will now be dealt with under the Freedom of Information Act 2000. I now will respond to the request. Trust Merger Before I do this however, please note that with respect to the information we hold, Lewisham and Greenwich NHS Trust was formally created on 01 October 2013 following the merger of the Queen Elizabeth Hospital in Woolwich (QEH) from the decommissioned South London Healthcare NHS Trust with University Hospital Lewisham (UHL). This means that any data requested before October 2013 for QEH is unlikely to be held by the Trust. Where this applies, we will confirm this. Your Request I would like to find out how much the Trust spent on translation and interpreting in the past financial year. Where possible, I would be grateful if you could break this down by: - Interpreting vs translation We cannot give a breakdown between Interpreting vs Translation as the information we have does not differentiate between the two. - Language Please refer to attachment RFI-002187 One Trust serving our local communities

- Department The Trust can tell you that there were less than 10 patients within certain departments requiring translation and interpreting, however the precise figure is subject to a Refusal Notice under FOIA. The relevant exemption is at sections 40(2) and 40(3)(i)(a) personal data. The Trust relies on this exemption because the number of patients is so low that if it was to be disclosed there is a risk of patients being identified. The Trust therefore maintains that the information is personal data within the meaning of section 1(1) of the Data Protection Act 1998 ( DPA ), which states, personal data means data which relate to a living individual who can be identified (a) from those data, or (b) from those data and other information which is in the possession of, or is likely to come into the possession of, the data controller, and includes any expression of opinion about the individual and any indication of the intentions of the data controller or any other person in respect of the individual; As the information does not relate to you section 40(2) of FOIA applies. The Trust then went on to consider whether disclosure of the personal data would breach any of the Data Protection Principles. This is covered by section 40(3)(i)(a) of the Freedom of Information Act 2000. The relevant principle in this case is Principle 1, Personal data shall be processed fairly and lawfully and in particular, shall not be processed unless (c) at least one of the conditions in Schedule 2 is met, The Trust maintains that it would be unfair to disclosure the precise figures of patients and can find no relevant condition for processing in Schedule which would permit this. It would be most useful if you could send this as an excel file. Re-use and Copyright Please be aware that under the Re-Use of Public Sector Regulations 2015 the supply of this information is free to be used for your own use or for news reporting. Where this applies the source should be stated. For all other types of re-use e.g. publication or otherwise distributing information for public circulation, permission of the copyright owner will be necessary which may incur a charge. In most cases this will be the Trust. For documents, where copyright does not belong to the Trust the applicant will need to apply separately to the copyright holder One Trust serving our local communities

for their terms and conditions. This is in accordance with the Copyright, Designs and Patents Act 1988 (CDPA). This will be highlighted where relevant. Breach of copyright law is an actionable offence and the Trust expressly reserves its rights and remedies available pursuant to the CDPA and common law. Further information on copyright is available at the following website: http://www.ipo.gov.uk/copy.htm Internal Review If you unhappy with your response you can request a formal internal review. All requests must be provided in writing either via email or to the postal address above. This should be done within two months of receipt of your response letter. All appeals must quote the original reference number and provide a reason for the appeal. Information Commissioner s Office Should you still remain unhappy with the outcome of your appeal you can write directly to the Information Commissioner s Office to ask for an independent review at the following address:- The Information Commissioner s Office Wycliffe House, Water Lane Wilmslow Cheshire, SK9 5AF Website: http://www.ico.org.uk/ Helpline: 0303 123 1113 In general, the ICO will only review cases where all internal review processes have been exhausted. I hope this answers your request. If you have any further queries about this matter then please do not hesitate to contact me. Yours sincerely foi.lg@nhs.net One Trust serving our local communities
