The regular meeting of the Warrensburg Town Board was held on Wednesday, February 10, 2016 at the Albert Emerson Town Hall at 7:00 p.m. with the following members present: PRESENT: Supervisor Kevin B. Geraghty Joyce Reed Linda Baker- Marcella Bryan Rounds John Alexander OTHERS PRESENT: Kathy Rounds, Deputy Town Clerk; Robert Hafner, Town Attorney; Dexter Duell, Water Department Head; Ed Pennock, Highway Superintendent and numerous town residents. RESOLUTION #36-16 MINUTES On motion of Baker-Marcella, seconded by Reed, the RESOLVED, that the minutes of January 5th, 2016 and January 13th, 2016 be accepted. REPORTS OF TOWN OFFICIALS Reports were received and read from the following Town Officials: Town Clerk, Supervisor, Assessor, Justice, Dog Control Officer and Enforcement Officer. COMMITTEE REPORTS Committee reports were given from the following: Highway, Landfill, Lighting, Historian, Museum, Parks and Rec., Sewer and Water. PUBLIC ANNOUNCEMENT Supervisor Geraghty announced the AUD reports for the Town of Warrensburg and the consolidated Health District have been filed with the State. DISCUSSION - NEW WAY LUNCH WATER BILL Supervisor Geraghty opened discussion explaining he has a request from New Way Lunch about their water bill, they used about 200,000 gallons then they normally do. Supervisor Geraghty said they contacted the Town and the Town Employees went down and went through the building with the owner and found some leaky toilets and such. Supervisor Geraghty said the owner has an $800.89 water bill due February 15th and she is asking for a thirty-day extension with no penalty, she would pay that bill on March 15th.

Baler-Marcella asked if the Town Board could legally do this, waive the penalty. Attorney Hafner explained because it is not taxes, it is water rents the town can do it. Attorney Hafner explained the Town Board could not waive penalties on Town Taxes but because it is water rents they can legally do this, even though it is penalty, it is an alternate method of getting payment for water used. Baker-Marcella said she wished to ask her fellow Town Board members how they would determine if someone else came in and said they were in the hospital when this happened, is this going to set a precedent or open a can of worms. Baker-Marcella said they have given special consideration to people who have had leaks and taken care of them and she has had no problem, she is totally in support of helping New Way Lunch. Baker-Marcella asked if they could credit that amount to the bill and then still charge them the late fee that everyone has to pay after the due date. Alexander told Baker-Marcella he knew what she was saying but to him it is the same, they are just trying to reach out to someone who reached out to us. Baker-Marcella asked if there was just some way else they could do it. Baker-Marcella asked why they could not take $80.00 off the bill and then have them pay the $80.00 late fee so other people would not be asking for it as well. Discussion ensued on different water rent requests that the Town has dealt with, the policy that is followed, the Board having the right to waive the late fee, the penalties, and reducing the water bills. Supervisor Geraghty said he could not say that somebody has not gone to the Clerks Office, and, asked for something and the Clerk may look at it and say she is sorry she can not do anything about it, and it is not brought to the Town Board. Supervisor Geraghty said the Town has a procedure in place, if they have a complaint we ask them to make a sheet out and we have asked to see them. Supervisor Geraghty said in this case it is a specific case, made for a specific reason. Supervisor Geraghty said some people may fall through the cracks but if John Q public brings a valid excuse in he is certainly going to ask the Water Department to investigate and if it warrants, he will certainly bring it to the Town Board. Supervisor Geraghty said anyone can certainly have one of these complaint forms at any time, the Town Board is the only one who can rule on these.

Baker-Marcella said she wished to clarify that she was not talking about having them pay the total amount, she wanted to give them the $80.00, she did not wish to establish a precedent but if the Supervisor is telling her they have waved this for other people then that is absolutely what should happen. Supervisor Geraghty said they absolutely have. RESOLUTION #37-16 WAIVE PENALTY AMOUNT OF EIGHTY DOLLARS FOR NEW WAY LUNCH On motion of Alexander, seconded by Rounds, the IT IS RESOLVED, to waive the penalty of $80.00 for New Way Lunch, account M0683 and allow the bill to be paid in March of 2016 because the applicant had undetected leaks. RESOLUTION #38-16 AMEND TOWN CLERK FEE SCHEDULE FOR LANDFILL FEES On motion of Alexander, seconded by Reed, the IT IS RESOLVED, to amend the Town Clerk Fee Schedule for Landfill fees to allow for the following electronic fees for TV's and Monitors: 2"- 13" $ 4.00 each 14"- 19" $ 8.00 each 20"- 24" $12.00 each 25"-32" $20.00 each Over 32" $30.00 each and IT IS FURTHER RESOLVED, to remove scrap metal from the fee schedule. RESOLUTION #39-16 RESOLUTION RECOGNIZING WARRENSBURG WRESTLING TEAM AND COACH On motion of Reed, seconded by Baker-Marcella, the attached resolution was ADOPTED

PRIVILEGE OF THE FLOOR Steve Parisi told the Town Board he had received a canvas photograph from Carl Brainard that is about 6 feet by 6 feet that had been removed from the Merrill Magee House after Grace died. Mr. Brainard was the caretaker of the place. Mr. Parisi said the Museum displayed it when they first received it but they really do not have room to put it on permanent display and it occurred to him to do a long term loan to the Merrill Magee Inn if they have a wall they would like to put it on. Mr. Parisi said he had not spoken to any one else about this, he would need to talk to the Historical Society but he felt he should he receive the Town's permission first. Supervisor Geraghty said he was okay with doing that and the rest of the Town Board stated their agreement. RESOLUTION #40-16 BUDGET MODIFICATIONS On motion of Alexander, seconded by Reed, the attached resolution was ADOPTED The Town Board entered into an Executive Session at 7:27 p.m. The Town Board came out of Executive Session at 7:35 p.m. It was announced there was no action taken. RESOLUTION #41-16 PAY BILLS On motion of Alexander, seconded by Rounds, the IT IS RESOLVED, to pay the warrants in the following amounts: General Fund $93,272.13 Highway Fund $32,909.38 Lighting Fund $ 8,676.06 Sewer Fund $13,659.35 Water Fund $11,383.30 Safe Routes To School $102,194.40 Floyd Bennett Memorial $ 1,737.40 Countryside Sewer $ 2,275.00 Brownfield Paper Mill Park $ 1,896.30
