Statutory Instruments Supplement No. 48 Supplement to Official Gazette No. 97 dated 24th November, 2014 S.I. 2014 No. 76 Animals (Diseases and Importation) Act CAP. 253 ANIMALS (DISEASES AND IMPORTATION CONTROL) (AMENDMENT) REGULATIONS, 2014 The Minister, in exercise of the powers conferred on him by section 14 of the Animals (Diseases and Importation) Act, makes the following Regulations: 1. These Regulations may be cited as the Animals (Diseases and Importation Control) (Amendment) Regulations, 2014. 2. Regulation 2 of the Animals (Diseases and Importation Control) Regulations, 1961 (L.N. 1961 No. 53), in these Regulations referred to as the principal Regulations is amended by deleting the definition of "prescribed cercate" and substituting the following: " "prescribed certificate" means a certificate which purports to have been given by an official veterinarian of the government of the exporting country."; and by inserting in the appropriate alphabetical order the following: " "Veterinary Authority"means the governmental authority of a member country of the World Organisation for Animal Health, comprising veterinarians, other professionals and paraprofessionals, having the responsibility and competence for ensuring or supervising the implementation of animal health and welfare measures, international veterinary certification and other

2 STATUTORY INSTRUMENT standards and recommendations in the Terrestrial Code in the whole territory.". 3. The principal Regulations are amended by deleting regulation 4 and substituting the following; "Landing of animals 4.( 1) No animal shall be landed at any port in Barbados other than the Bridgetown Port, Grantley Adams International Airport or Port St. Charles. (2) Notwithstanding paragraph (1), the Senior Veterinary Officer may in his absolute discretion grant a permit in writing for an animal to be landed at such other port and upon such conditions as may be specified in the permit. (3) Where an animal is landed at a port pursuant to paragraph (2), the master or captain of the vessel shall comply with regulation 6.". 4. The principal Regulations are amended by deleting regulation 6 and substituting the following: "Requirement for entering a port 6. Where any vessel having on board any animal arrives in Barbados, the master or captain shall not bring the vessel into a port until he has completed and signed a declaration in the form specified in Part I of the First Schedule to these Regulations; and

STATUTORY INSTRUMENT 3 he has been granted permission by the Inspector for such vessel to enter the port". 5. Regulation 11 of the principal Regulations is amended by deleting paragraph (1) and substituting the following: "(1) No dog or cat shall be imported into Barbados except in accordance with these Regulations."; by deleting paragraph (3) and substituting the following: "(3) The certificate referred to in paragraph (2) shall state that the dog or cat is in good health and is free from symptoms of infectious and contagious diseases; and the dog or cat has been vaccinated against rabies."; and (c) by deleting paragraph (4) and substituting the following: "(4) The certificate referred to in paragraphs (2) and (3) shall also contain any other requirements which the Senior Veterinary Officer may impose.". 6. Regulation 12 of the principal Regulations is amended by deleting paragraph (1) and substituting the following: "(1) No horse shall be imported into Barbados except directly from the countries specified in Part A of the Third Schedule to these Regulations."; by deleting paragraphs (3) and (4) and substituting the following:

4 STATUTORY INSTRUMENT "(3) The certificate referred to in paragraph (2) shall state that the horse is in good health and good physical condition and is free from any infectious or contagious diseases; and that, so far as it has been possible to ascertain, no case of vesicular stomatitis, dourine (mal du coit), surra (mal de calderas), glanders (farcy), epizootic lymphangitis, equine rhinopneumonitis, equine influenza, equine viral arteritis, equine infectious anaemia, equine encephalomyelitis, anthrax, contagious equine metritis, ulcefative lymphangitis, rabies, strangles, mange, west nile virus or any other disease of equines, as is required by statute to be notified to the Veterinary Authority in the country of origin has occurred on the premises from which the horse originated during the 90 days immediately prior to the date of exportation. (4) The certificates referred to in paragraphs (2) and (3) shall also contain any other requirements which the Senior Veterinary Officer may impose.". 7. Regulation 13 of the principal Regulations is amended by deleting paragraph (1) and substituting the following: "(1) No cattle, sheep, goat or pig shall be imported into Barbados except directly from the countries specified in Part B of the Third Schedule to these Regulations."; and by inserting immediately after paragraph (5) the following: "(6) The certificates referred to in paragraphs (3), (4) and (5) shall also contain any other requirements which the Senior Veterinary Officer may impose.".

The principal Regulations are amended by deleting regulation 15 and substituting the following: "Poultry and poultry hatching eggs 15.(1) No poultry or poultry hatching eggs shall be imported into Barbados except from the countries specified in the Fourth Schedule and in accordance with the terms of a permit granted by the Senior Veterinary Officer. (2) No poultry imported under paragraph (1) shall be landed in Barbados unless the prescribed certificate in respect of the poultry is delivered to the Inspector. (3) The certificate referred to in paragraph (2) shall state that the country, region or zone from which the poultry or poultry hatching eggs have originated is free from Newcastle Disease and notifiable Avian Influenza. (4) The certificate referred to in paragraph (3) shall also contain any other requirements which the Senior Veterinary Officer may impose.". 9. Regulation 16 of the principal Regulations is amended by deleting paragraphs (I) and (2) and substituting the following: "(1) Subject to the provisions of paragraph (2) of this regulation, no carcass or any portion of the carcass of any poultry shall be imported into Barbados except directly from the countries specified in the Fourth Schedule; and

6 STATUTORY INSTRUMENT in accordance with the terms of a written permit granted by the Senior Veterinary Officer. (2) The provisions of paragraph (1) of this regulation shall not apply to any carcass or part of a carcass of any poultry which has been fully cooked.". 10. Regulation 17 of the principal Regulations is amended by deleting paragraphs (1) and (2) and substituting the following: "(1) Subject to the provisions of paragraphs (2) and (3), of this regulation, no fresh carcass, whether frozen or chilled, nor any cooked, cured, pickled or smoked carcass of any cattle, pig, sheep or goat or any portion of any carcass shall be imported into Barbados except from any of the countries specified in the Fifth Schedule; and in accordance with the terms of a permit granted by the Senior Veterinary Officer. (2) The provisions of paragraph (1) of this regulation shall not apply to any importation made by or on behalf of the Government of Barbados acting on the advice of the Senior Veterinary Officer; or any commercially-canned meats, imported in hermetically sealed metal cans and fully processed in a manner approved by the Senior Veterinary Officer as being satisfactory for ensuring that such importation is unlikely to result in the introduction or spread of disease in Barbados and accompanied by the official meat inspection certificates of the country of origin.";

STATUTORY INSTRUMENT 7 11. The principal Regulations are amended by deleting regulation 18 and substituting the following: "Animal products or animal by-products 18. No animal products or animal by-products including hides, skins, horns, hair, wool, bones, bone meal, meat scrap and tankage shall be imported into Barbados except in accordance with the terms of a permit granted by the Senior Veterinary Officer and subject to such conditions as he may impose.". 12. The principal Regulations are amended by deleting regulation 19 and substituting the following: "Fodder and litter 19. No fodder or litter shall be imported into Barbados except directly from any of the countries specified in Part B of the Third Schedule; and in accordance with the terms of a permit granted by the Senior Veterinary Officer.". 13. The principal Regulations are amended by deleting paragraph (1) of regulation 25 and substituting the following: "Fees 25.(1) The fees set out in the Sixth Schedule shall be payable by the consignee or importer of an animal to the Comptroller of Customs or to the Inspector in respect of the matters specified and those fees

8 STATUTORY INSTRUMENT payable to the Comptroller of Customs shall be paid into the Consolidated Fund.". 14. The principal Regulations are amended (c) (d) by deleting the First Schedule to those Regulations and substituting the First Schedule as set out in Part I of the Schedule to these Regulations; by deleting the Third Schedule; by deleting the Fourth, Fifth and Sixth Schedules to those Regulations and substituting the renumbered Third, Fourth and Fifth Schedules as set out in Part II of the Schedule to these Regulations; and by (i) (ii) deleting paragraph 2 of the Seventh Schedule to those Regulations; renumbering the Seventh Schedule as the Sixth Schedule; and (iii) substituting paragraph 2 of the renumbered Sixth Schedule as set out in Part III of the Schedule to these Regulations.

(Name of Captain or Master) (Name of Vessel) that to the best of my knowledge and belief no animals; or of animals (Number) are being carried on board the above-named vessel. of the vessel hereby declare (Signature of Captain or Master) (Date) Attention is drawn to regulation 26 of the Animals (Diseases and Importation Control) Regulations, 1961 (L.N. 1961 No. 53) which makes it an offence for a person who is required to make a declaration to enter in it any material particular which he knows to be false, or to sign it knowing it to be false. The maximum penalty for either of these offences is a fine of $100."
