COUNCIL MEETING MARCH 27, 2018 STATEMENT OF COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT On January 2, 2018, adequate notice of this meeting pursuant to the Open Public Meetings Act has been furnished by inclusion thereof in the Annual Schedule of Meetings for 2018 which has been posted on the bulletin board at Borough Hall, filed with the Borough Clerk, faxed to the Our Town, The Record, and The Community News newspapers and distributed to all persons, if any, requesting copies of same pursuant to said Act. INTRODUCTION OF ORDINANCES ORDINANCE # 4-18 CAPITAL ORDINANCE OF THE BOROUGH OF MAYWOOD, IN THE COUNTY OF BERGEN, NEW JERSEY AUTHORIZING THE INSTALLATION OF GENERATORS AT THE DPW BUILDING AND THE SENIOR/RECREATION CENTER IN, BY AND FOR THE BOROUGH, APPROPRIATING THEREFOR THE SUM OF $107,000 AND PROVIDING THAT SUCH SUM SO APPROPRIATED SHALL BE RAISED FROM A FEDERAL GRANT.

Council member moved for the introduction(s); seconded by Council member. Mayor Febre asked for a roll call vote. BE IT RESOLVED by the Mayor and Council of the Borough of Maywood that Ordinances # 4-18, pass on first reading and that said Ordinances will be further considered for final passage at a meeting of the Mayor and Council to be held on _April 10, 2018_at 7:30 p.m at the Borough Hall, 15 Park Avenue, Maywood, New Jersey at which time and place all persons interested therein will be given an opportunity to be heard concerning the same, and that the Borough Clerk is hereby authorized and directed to advertise the same according to law. Proclamation WHEREAS, autism is a pervasive developmental disorder affecting the social, communication and behavioral skills of those affected by it, and, WHEREAS, as more health professionals become proficient in diagnosing autism, more children are being diagnosed on the autism spectrum, resulting in rates as high as 1 in 68 children nationally and 1 in 41 in New Jersey, and, WHEREAS, while there is no cure for autism, it is well-documented that if individuals with autism receive early and intensive treatment throughout their lives, they lead significantly improved lives, and, WHEREAS, individuals with autism often require a lifetime of specialized and community support services to ensure their health and safety and to support families resilience as they manage the psychological and financial burdens autism can present, WHEREAS, Autism New Jersey is spearheading an awareness effort in order to educate parents, professionals and the general public about autism and its effects, NOW, THEREFORE BE IT RESOLVED that I, Adrian J. Febre, Mayor of the Borough of Maywood, County of Bergen in the State of New Jersey, do hereby proclaim April 2018 as NATIONAL AUTISM AWARENESS MONTH in the Borough of Maywood, and urge all employees and residents to become better educated about autism and create a better community for individuals with autism. RESOLUTION # 64-18 RESOLUTION AUTHORIZING CANCELLATION OF OUTSTANDING CHECKS and Whereas, the Audit recommends the review and cancellation of old stale dated checks, Whereas, after review the Municipal Court Administrator has requested checks from 2016 and 2017 Bail Account be cancelled in order to transfer monies back to the municipality, Now, therefore, be it resolved by the Mayor and Council of the Borough of Maywood that the listed stale dated checks be and are hereby cancelled effective this date March 27, 2018.

Municipal Court Bail Outstanding Check List as of March 27, 2018 Date Ck # Amount 9/2016 #1687 $ 5.00 12/2016 #1730 $ 31.00 5/2017 #1789 $ 500.00 TOTAL = $ 536.00 RESOLUTION # 65-18 RESOLUTION AUTHORIZING INTER-LOCAL GOVERNMENT SERVICES CONTRACT WITH THE MAYWOOD BOARD OF EDUCATION FOR THE 2018 MAYWOOD SUMMER CLUB PROGRAM WHEREAS, the Recreation Department of the Borough of Maywood has announced the 2018 Summer Club Program to be held at the Maywood Avenue School beginning Monday, June 25 th, 2018 running through Friday, August 3 rd, 2018 and then being held at Memorial School beginning on Monday, August 6 th, 2018 and running through Friday, August 17 th, 2018; WHEREAS, the program will run Monday through Friday (except holidays) from 8:15 a.m. to 3:00 p.m. and will include dancing, games, indoor gym, outdoor gym, arts and crafts, card games, use of playgrounds and special events; and WHEREAS, the program is open to all youths entering Kindergarten through 8 th grade in September, 2018; and WHEREAS, to implement said program, an agreement must be entered into between the Borough of Maywood and the Board of Education of the Borough of Maywood for the use of the facilities at both Maywood Avenue and Memorial School, NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE BOROUGH OF MAYWOOD, BERGEN COUNTY, NEW JERSEY, that the Mayor, Adrian J. Febre, is hereby authorized to execute and the Borough Clerk, Jean M. Pelligra, to attest an agreement between the Borough of Maywood and the Board of Education of the Borough of Maywood to carry out the foregoing purposes, of a form approved by the Borough Attorney. RESOLUTION # 66-18 RESOLUTION AUTHORIZING THE PURCHASE OF A NEW POLICE VEHICLE PURSUANT TO STATE CONTRACT WHEREAS, the Borough of Maywood is in need of a new police vehicle; and

WHEREAS, pursuant with membership in the Cranford Police Cooperative Pricing System Contract # 47-CPCPS, as approved by the NJ Department of Community Affairs, Beyer Ford located at 170 Ridgedale Avenue, Morristown, NJ 07960 has been awarded a contract for the 2018 Ford Police Interceptor Utility Vehicle at a state contract price of $ 25,961.00 base price for said vehicle; and WHEREAS, the Borough of Maywood desires to purchase the police vehicle; and WHEREAS, on the basis of price and other factors, the Chief of Police has recommended the award of a contract to Beyer Ford. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Maywood, Bergen County, New Jersey, that the Borough of Maywood hereby authorizes the purchase of a 2018 Ford Police Interceptor Utility Vehicle Contract Number 47-CPCPS, with required options at a price of $3,765.75 for a total cost of $29,726.75, in accordance with its proposal. RESOLUTION # 67-18 APPOINTING SALLY J. MILLER AS REGISTRAR FOR THE BOROUGH OF MAYWOOD WHEREAS, Sally J. Miller will hold the position of Registrar for the Borough of Maywood, County of Bergen, New Jersey through March 30, 2018; and NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Maywood that Sally J. Miller be appointed as Registrar of the Borough of Maywood effective April 1, 2018; and BE IT FURTHER RESOLVED that this appointment be for a three year term effective April 1, 2018 through March 30, 2021; and BE IT FURTHER RESOLVED, that the Borough Clerk is hereby authorized and directed to forward a copy of the within resolution to Vincent T. Arrisi, State Registrar, Department of Health and Senior Services, Vital Statistics and Registration, P.O. Box 370, Trenton, NJ 08625-0370. RESOLUTION # 68-18 RESOLUTION APPROVING SETTLEMENT OF LITIGATION WITH OFFICER WALTER MOUSSOU IN THE BOROUGH OF MAYWOOD, BERGEN COUNTY, NEW JERSEY

WHEREAS, Police Officer Walter Moussou sought legal action against the Maywood Police Department; and WHEREAS, a settlement of the matter has been reached through mediation in the amount of $150,000.00; and WHEREAS, the Borough attorney and Joint Insurance Fund attorney, Natalia R. Angeli, Esq., recommend such settlement as it is in the best interest of the Borough; and WHEREAS, the Mayor and Council of the Borough of Maywood declare that such settlement is limited to the particular facts and circumstances surrounding the instant matter and further declare that same does not create a precedence or practice within the Borough of Maywood. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Maywood, County of Bergen, State of New Jersey that the Mayor be and is hereby authorized and directed to execute, and the Borough Clerk to attest, to any and all documents necessary to execute a settlement agreement and to finalize the settlement of litigation between the parties. BE IT ORDAINED by the Borough Council of the Borough of Maywood, in the County of Bergen, New Jersey, as follows: Section 1. The Borough of Maywood, in the County of Bergen, New Jersey (the "Borough") is hereby authorized to install generators at the DPW Building and the Senior/Recreation Center in, by and for said Borough. Said improvements shall include all work, materials and appurtenances necessary and suitable therefor. Section 2. The sum of $107,000 is hereby appropriated to the payment of the cost of the improvements authorized and described in Section 1 hereof (hereinafter referred to as

"purpose"). Said appropriation shall be raised from a Federal grant, as hereinafter provided. The sum of $107,000 received or to be received as a grant from the Federal Emergency Management Agency (FEMA) is hereby appropriated to the payment of the cost of said purpose.

Section 3. Said improvements are lawful capital improvements of the Borough having a period of usefulness of at least five (5) years. Said improvements shall be made as general improvements, no part of the cost of which shall be assessed against property specially benefited. Section 4. The capital budget is hereby amended to conform with the provisions of this capital ordinance to the extent of any inconsistency therewith and the resolutions promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services, is on file with the Borough Clerk and is available for public inspection. Section 5. This ordinance shall take effect at the time and in the manner provided by law.
