Instructions to Bidders A tender once submitted shall not be withdrawn within a period of 120 days from the day of opening of the tenders. If a tenderer withdraws his tender his earnest money deposit shall stand forfeited and he shall render himself liable to be debarred from submitting any tender for works under NPCC LTD for a minimum period of one year. Interested Bidders should submit sealed bid viz. Price Bid as below: Online Submission of Bids Bidding through E-Tendering System: (a) (b) The bidding under this contract is electronic bid submission through website www.npcc.eproc.in. Detailed guidelines for viewing bids and submission of online bids are given on the website. Any citizen or prospective bidder can logon to this website and view the Invitation for bids and can view the details of work for which the bid is invited. The prospective bidder can submit bids on line; however the bidder is required to have enrolment /registration in the web site and should have valid Digital Signature Certificate (DSC) in the form of smart card/e-token. The DSC can be obtained from any authorised certifying agencies. The bidder should register in the web site www.npcc.eproc.in using the relevant option available. Then the digital signature registration has to be done with the e-token, after logging into the site. After this the bidder can login the site through secured login by entering the password of the e-token & the user id/password chosen during registration. An authorized representative of the Agencies/firms shall use DSC for uploading documents. The authorization shall be in the form of a legally enforceable written power of attorney executed on non-judicial stamp paper of appropriate value duly notarized and scan copy of the same shall be submitted along with bid. After getting the bid schedules, the Bidder should go through them carefully and then submit the documents as asked, otherwise, the bid will be rejected. SCOPE OF WORK AND GENERAL INSTRUCTIONS FOR TENDER 1. The NPCC Ltd requires the service of reputed, well established and financially sound manpower Company/Firm/Agency to provide assistance to its officers in field quality control in PMGSY work. 2. The contract is likely to commence from 1 st week of January 2019 and would continue for a period of 12 (Twelve) months. The period of the contract may be further extended beyond the contracted period provided the requirement of NPCC persist at that time or may be curtailed/terminated before the contracted period owing to deficiency in service or substandard quality of manpower deployed by the selected Company/Firm/Agency. NPCC also, reserves the right to terminate this initial contract at any time after giving one week notice to the selected service providing Company/Firm/Agency. 3. NPCC Ltd has initial requirement of 07 (Seven) skilled personnel who are well conversant with quality control work related to rural road development/pmgsy road work. However, this requirement of 07 (Seven) personnel may increase or decrease for which one week s advance notice in writing will be given to the agency to suitably increase or decrease manpower being deployed by him. 4. The envelope containing the offer may be super scribed as Providing 7 (Seven) nos. of skilled manpower for field quality control and laboratory of PMGSY work, Paschim Medinipur and addressed to Zonal Manager NPCC Ltd EZO. 5. Conditional bids shall not be considered and will be out rightly rejected. 6. All the entries in the tender form should be legible and filled clearly. If the space for furnishing information is insufficient, a separate sheet duly signed by the authorised signatory may be attached. No overwriting or cutting is permitted in the Bid Form. In such cases, the tender shall be summarily rejected. Page 5 of 9
TERMS AND CONDITIONS 1. The contract shall be for a period of 12 (Twelve) months unless it is curtailed or terminated by NPCC owing to deficiency of service, sub-standard quality of service of personal engaged, breach of contract etc. 2. Letter of Award will be issued to Lowest bidder. 3. On issue of letter of award for the work, the contracting agency shall submit CV s of personnel, he intends to deploy for approval of the Zonal Manager. 4. The contract shall automatically expire on completion of twelve months unless extended further by the mutual consent of contracting agency and NPCC. 5. The contract may be extended, on the same terms and conditions or with some addition/deletion/modification, for a further specific period manually agreed upon by the successful service providing Company/Firm/Agency and NPCC. 6. The contracting Company/Firm/Agency shall not be allowed to transfer, assign, pledge or sub-contract its rights and liabilities under this contract to any other agency without the prior written consent of NPCC. 7. NPCC at present, has requirement of 7 (Seven) skilled personal on urgent basis. The requirement may further increase or decrease during the period of initial contract also and the tenderer would have to provide additional person, if required, on the same rates, terms and conditions. 8. The payment shall be made on conclusion of the calendar month only or on prorata basis for per month. 9. NPCC reserves right to terminate the contract after giving a week s notice to the contracting agency. LIABILITIES, CONTROL ETC. OF THE PERSONS DEPLOYED 10. The contracting agency shall ensure that the skilled personnel so deployed in the NPCC conform to the following technical specifications of age, educational and skill qualifications. The skilled personnel should be Graduate from a recognised University/Board and between18-40 years of age. 11. The Field quality control personnel should be conversant with various testing performed for quality check of PMGSY works. They should also be conversant with maintenance of records and working of computers. 12. Their character and antecedents should be got verified by the agency. 13. NPCC is a Central Government Enterprise office and has five working days (i.e. Monday to Friday) in a week from 09.30 to 6.00 hrs. With lunch break of ½ an hour from 13.30 hrs. to 14.00 hrs. Generally, persons so deployed will adhere to such working hours. 14. In case of person employed by the successful Company/Firm/Agency commits any act of omission/commission, that amounts to misconduct/ indiscipline/ incompetence and the successful Company/Firm/Agency will be liable to take appropriate disciplinary action against such persons, including their removal from site of work, if required, by NPCC. 15. The tendering Company/Firm/Agency shall replace immediately any of its personnel who is found unacceptable to NPCC because of security risks, incompetence, conflict of interest, improper conduct etc., upon receiving written notice from this Ministry. 16. The agency shall depute a coordinator who would be responsible for immediate interaction with the NPCC so that optimal services of the persons deployed by the agency could be availed without any disruption. 17. The selected agency shall immediately provide a substitute in the event of any person leaving the job due to his/her personal reasons. The delay in providing a substitute beyond 3 (Three) working days would attract a penalty @ Rs. 500 per day on the service providing agency. 18. It will be the responsibility of the service providing agency to meet transportation, food, medical and any other requirements in respect of the persons deployed in NPCC, NPCC will have no liabilities in this regard. 19. For all intents and purposes, the service providing agency shall be the Employer within the meaning of different Labour Legislations in respect of skilled personnel so employed and deployed in this NPCC. The persons deployed by the agency in NPCC shall have no claims of any Master and Servant relationship against the NPCC. 20. The service providing agency shall be solely responsible for the redressal of grievances/resolution of disputes relating to the persons deployed, NPCC shall, in no way, be responsible for settlement of such issues whatsoever. 21. NPCC shall not be responsible for any financial or other injury to any person deployed by service providing agency in the course of the performing the functions/duties, or for payment towards any compensation. 22. The person s deployed by the service providing agency shall not claim nor shall be entitled to pay, perks and other facilities as admissible to regular/confirmed employees of NPCC during the currency or after expiry of the contract. 23. In case of termination of this contract on its expiry or otherwise, the persons deployed by the service providing agency shall not be entitled to any claim for any absorption in the regular/ otherwise capacity in this Ministry. LEGAL 24. The tendering agency will be responsible for compliance of all statutory provisions relating to Minimum Wages, Provident Fund and Employees State Insurance etc. In respect of the persons deployed by in NPCC. 25. Tendering agency shall also be liable for depositing all taxes, levies, cess etc. On account of service rendered by it to NPCC to the concerned tax Page 7 of 9
collection authorities from time to time as per extant rules and regulations on the matter. 26. The tendering agency shall maintain all statutory registers under the law. The agency shall produce the same, on demand, to the concerned authority of NPCC or any other authority under law. 27. The Tax Deduction at Source (T.D.S) shall be deducted as per the provisions of Income Tax Act, as amended from time to time and a certificate to this effect shall be provided to the agency by NPCC. 28. In case the tendering agency fails to comply with any statutory/taxation liability under appropriate law, and as a result there of NPCC is put to any loss/obligation, monetary or otherwise, NPCC will be entitled to get itself reimbursed, to the extent of the loss or obligation in monetary terms. 29. The agency shall raise the bill, in triplicate, along with attendance sheet (duly verified by NPCC officer in respect of the persons deployed and submit the same to Zonal Manager, EZ, NPCC Ltd in the first week of the succeeding month. 30. Zonal Manager, EZ, NPCC reserves the right to withdraw/relax any of the terms and conditions mentioned above so as to overcome the problem encountered at a later stage. Page 8 of 9
