Clause 1., Report No. 15, 1997 BY-LAW NO. 97-38 A BY-LAW TO AMEND BY-LAW NO. 8499 "RESTRCTED AREA (ZONNG) BY- LAW OF THE CORPORATON OF THE CTY OF KNGSTON" (REZONE THE APPROXMATELY.9 ha (913 m 2) PARCEL OF LAND LOCATED ON THE SOUTH SDE OF PRNCESS STREET, BETWEEN PORTSMOUTH AVENUE AND HLLENDALE AVENUE, KNOWN MUNCPALLY AS 1318 PRNCESS STREET, FROM ZONE '' (ARTERAL) COMMERCAL OF BY-LAW NO. 8499 AND RESDENTAL OF BY-LAW NO. 541 TO ZONE '.35' (ARTERAL) COMMERCAL MODFED) PASSED: December 2, 1997 WHEREAS a public meeting was held into this amendment on November 2, 1997; hereby enacts as follows: NOW THEREFORE the Council of the Corporation of the City of Kingston 1. By-Law No. 8499 of the Corporation of the City of Kingston entitled "Restricted Area (Zoning) By-Law of the Corporation of the City of Kingston", as amended, is hereby further amended as follows: A. Zoning Map No. 12 showing lands located on the south side of Princess Street, between Portsmouth Avenue and Hillendale Avenue, comprising approximately.9 ha (913 m 2) and known municipally as 1318 Princess Street, is hereby amended by changing the zoning from Zone '' (Arterial) Commercial of City of Kingston By- Law No. 8499 and Zone 'Residential' of Township of Kingston By-Law No. 541 to Zone '.35' (Arterial) Commercial Modified. Zoning Map No. 12 as referred to in Section 2.2 of By-Law No. 8499 is hereby repealed and Zoning Map No. 12 attached hereto and marked as Schedule "A" is substituted insofar as the.9 ha parcel of land located on the south side of Princess Street, between Portsmouth Avenue and Hillendale Avenue is concerned. B. Schedule "B" of By-Law No. 8499 is hereby amended with respect to the.45 ha (45 m 2) parcel of land located on the south side of Princess Street, between Portsmouth Avenue and Hillendale Avenue, by deleting the designation of Residential Zone of Restricted Area By-Law No. 541 of the Township of Kingston and substituting therefore the designation of Restricted Area (Zoning) By-Law No. 8499 of the City of Kingston. C. By-Law No. 8499 is hereby further amended by adding the following thereto as Section 35.:
"35. On the approximately.9 ha (913 m 2) parcel of land located on the south side of Princess Street, between Portsmouth Avenue and Hillendale Avenue, known municipally as 1318 Princess Street, and designated '.35' on a copy of Zoning Map No. 12 attached to and forming part of By-Law No. 97-38 as Schedule "A", the following regulations shall apply: (i) Notwithstanding the provisions of Section 22.2 of this By-Law, the following uses only shall be permitted in the '.35' Zone: 9 retail stores, including retail stores selling general services; 9 lunch counters; 9 catering business; 9 banks; 9 electrical repair services, including radio and television repair services; 9 offices with a maximum size of 65 m 2 per building; and 9 accessory buildings to any use permitted in the '.35' Zone. (ii) Notwithstanding the provisions of Sections 22.3 (b), (c) and (d) of this By- Law, the minimum front, side and rear yard setbacks for the existing building only shall be as follows: on the east property boundary on the south property boundary on the west property boundary 6.m.37 m.78m (ii) n the event that the existing building on the site is removed, any new building shall be subject to the regulations of Section 22.3 of this By-Law.". n this By-Law "m" shall mean "metre" or "metres". 3. This By-Law shall come into force and take effect on its passing, provided no Notice of Appeal is filed to this By-Law, all in accordance with the provisions of Section 34, Subsections 19 and 3 of the Planning Act, R.S.O. 199, c. P.13; and where one or more appeals have been filed within the time period specified, at the conclusion of which, the provisions of Section 34, Subsections 19 and 3 of the Planning Act, R.S.O. 199, c.
