Governor s Address: Shri Satyendra Jain, Hon ble Minister of PWD moved the following Motion: That this House expresses its gratitude to Hon ble Lt. Governor for his address delivered to the Assembly on 16 March 2018. Shri Girish Soni seconded the Motion. 4. 2.14 PM Ruling of the Chair regarding Shri Kailash Gahlot continuing as Minister: On the objection of the opposition members regarding Shri Kailash Gahlot continuing as Minister in spite of being disqualified, the Chair ruled that as per Constitutional provisions read with the Section 43(2) of the GNCTD Act, 1991, Shri Kailash Gahlot could continue up to six months as Minister without being a Member of the House. He informed the Members that the Hon ble Supreme Court had also upheld this position hence there was no grounds to prevent Shri Kailash Gahlot continuing as a Minister. 5. 2.28 PM Presentation of Reports : I. 7. 5.49 PM Shri Saurabh Bharadwaj moved the following Resolution with the leave of the House: The Legislative Assembly in its sitting on 16 th March 2018 resolves that: Whereas, the ongoing sealing drive in various markets in the National Capital Territory of Delhi has wreaked havoc among the traders has left thouss of workers unemployed; It takes a lifetime in many cases generations to set-up any establishment for livelihood; A metropolis of the size of Delhi has come up over centuries has witnessed hard working people contributing immensely to the country s economy; After 2012, the Hon ble Supreme Court of India had given ample opportunities to the DDA Municipal Corporations in Delhi to regularise the existing commercial establishments; The unjustified sealing drive being carried out today is a direct consequence of the negligence inefficiency of Delhi Development Authority Municipal Corporations of Delhi; Not only are the MCDs resorting to sealing of commercial establishments by force without even checking the papers/documents, but Delhi Police has also been unleashed to terrorise innocent traders their family members, which was seen in full force in Amar Colony Lajpat Nagar recently; Such a state of affairs in the country s national capital is unacceptable an atmosphere of fear prevails in Delhi markets today; Now therefore, this House strongly condemns the use of force brutalities committed on innocent traders their families; Dems that the ongoing sealing in various markets of Delhi be immediately stopped; Further resolves that the Central government should take all possible steps, including bringing a new bill/amending existing laws in the ongoing Budget Session of Parliament or Ordnance to halt sealing with immediate effect. Shri Vijender Gupta, Hon ble Leader of Opposition suggested that the Resolution be amended to include changes in the Master Plan by DDA stopping of sealing activities by the Monitoring Committee of the Hon ble Supreme Court. Shri Arvind Kejriwal, Hon ble Chief Minister agreed to the suggestion. Further resolves that the Central government should take all possible steps, including bringing a new bill, amending existing laws in the ongoing Budget Session of Parliament, or issuing Ordinance; Also resolves that DDA should suitably amend the Master Plan; Also resolves to request the Monitoring Committee of the Hon ble Supreme Court to hold the sealing activities till such time as the Central Government takes suitable corrective steps. The amended Resolution was adopted with voice vote. 8. 6.02 PM Announcement regarding Assembly Secretary: The Chair announced that he had relieved Shri Prasanna Kumar Suryadevara on the request of the Hon ble Speaker of Andhra Pradesh Assembly. He placed on record the valuable contribution of Shri Prasanna Kumar Suryadevara during his tenure. The also announced that he had appointed Shri C. Velmurugan as Secretary till further orders.
