PART II - CODE OF GENERAL ORDINANCES Chapter 18 - BUSINESSES ARTICLE VII. - TRANSIENT MERCHANTS Sec. 18-223. - Sales or attempted sales on private property. Sec. 18-223. - Sales or attempted sales on private property. (a) License required. It shall be unlawful to enter or approach any owner or occupant of a private residence or business to solicit or attempt to solicit a sale or order for the sale of goods, wares and/or merchandise, without first obtaining a valid license from the city. (b) Application. Applicants for a license must file with the city clerk a completed city application for a private premises license, and pay the license fee established by resolution of the board of city commissioners, except that the following shall be exempt from payment of the license fee: (1) Solicitation on behalf of any nonprofit organization, as designated by the Internal Revenue Service; (2) Any person selling farm or orchard products grown or produced by that person; or (3) Solicitation on behalf of any business or for-profit organization, as long as the business or organization has legally occupied a room, store or office within the city for six months or longer. (c) Investigation and issuance. (1) Within 48 hours of receipt of the application, the city shall investigate the application to ensure it is complete, truthful, and that a license should be issued. (2) No license shall be issued to the applicant if any person seeking to operate under the license, within the last ten years, has been convicted or adjudged to be a juvenile offender of: a felony, battery, theft, any crime involving dishonesty, prostitution, promoting prostitution, patronizing a prostitute, soliciting for immoral purposes, lewd and lascivious behavior, illegal use, possession or sale of narcotics or non-narcotic drugs, sodomy, sodomy for hire, promoting sodomy for hire, patronizing a person offering sodomy for hire, loitering for the purpose of soliciting, incest, gambling, promoting obscenity, promoting obscenity to minors, displaying material harmful to minors, sexual battery, or bigamy. (3) The city clerk shall timely notify the applicant whether the license will be issued, and if so, that the applicant may obtain the license from city hall. A badge shall be issued to every person operating under the license, and said badge shall be carried by the person named on the badge at all times while taking any action regulated by this section. (d) Non-transferable. No license or badge may be transferred to any other person. A license only authorizes activities by the person specifically named on a badge issued under this section. (e) Revocation of license. A license may be revoked for the following: (1) Fraud, misrepresentation or false statement contained in the application or during any activities regulated by the section; (2) Any violation of this section; (3) Conviction by any badge-holder of any crime described in subsection (c)(2) of this section; (4) Conducting activities regulated by this section; or (5) Failure to collect and submit any applicable sales tax.
