STATEMENT OF PROBABLE CAUSE The Complainant states that the following facts establish probable cause: Complainant and/or Signing Officer designated below, declares under penalty of perjury, that he/she has reviewed police reports relating to the above-named Defendant and the allegations contained herein, and/or has spoken with peace officers having knowledge of the incident, and based upon that information, believes the following to be true and correct. On or about September 14, 2017 at approximately 11:00pm, Agents from the Cannon River Drug and Violent Offender Task Force witnesses Joshua Larkin Reiter DOB: 11/01/1973 (hereinafter Reiter) driving a Silver Dodge Durango. Agents knew Reiter s driver s license was canceled inimical to public safety. Agents followed the vehicle from a distance until the vehicle pulled into the Kwik Trip at 500 Laurel Court in the City of Northfield in Rice County. Agents observed Cole Earl Thompson DOB: 11/20/1979 (hereinafter Thompson) in the passenger seat of the vehicle. Agents knew Thompson had a federal warrant for his arrest due to a federal probation violation where the underlying offense was sale of methamphetamine. Agents confirmed the warrant through the U.S. Marshall s Office. Agents waited until Reiter and Thompson entered the Kwik Trip. Once inside, agents confronted the two defendants and placed each under arrest. Reiter was arrested for Driving After Cancellation Inimical to Public Safety. Thompson was arrested pursuant to his federal arrest warrant. During a search incident to arrest an agent searched Reiter and found a set of keys for the Durango. On the key chain was a canister containing a glass vial. In the vial was 0.24 grams of heroin. Agents know Reiter and Thompson occupy a high position in the drug distribution hierarchy. Agents are aware Thompson and Reiter were driving from Lake Street in Minneapolis where they picked up controlled substance from drug cartel members. Agents are aware that Thompson is the top distributor and Reiter is a runner for Thompson. Thompson has the runners wire money back to Mexico in order to fund the shipments of controlled substances into Minnesota. Once in Minnesota, Thompson sells pounds of controlled substances to high level dealers. Those high level dealers break down the pounds of controlled substances and sell them in smaller quantities to mid-level dealers. Thompson and Reiter are a main source of methamphetamine into the region. Based on the above, agents had reasonable suspicion to believe drugs may be in the Durango. Agents contacted Rice County Sheriff s Office to have a K9 officer respond to their location. A K9 sniff was conducted on the Durango and the K9 alerted on the vehicle for the odor of controlled substances. Based on the above information and the K9 sniff, agents obtained a search warrant for the Durango. The Durango was sealed on scene and towed back to Faribault Police Department. The search warrant was then executed on the vehicle. During the search agents found numerous items of evidence. Agents found just over a pound of methamphetamine, specifically 454.94 grams, which did test positive for methamphetamine. The methamphetamine was found sitting on top of a black leather bag on the floor immediately behind the center console. The meth was open, obvious, and accessible by both Thompson 4

and Reiter. Agents found 111.83 grams of marijuana in the vehicle. Three large bags were found in a black drawstring bag located behind the passenger seat on the floor. The remaining marijuana was found in the black leather bag which was under the Methamphetamine. Also found in the black leather bag was 1.72 grams of black tar heroin, 67 pills of Acetaminophen Hydrocodone, 101 pills of Carisoprodol, 2 pills of Alprazolam, 2 pills of Acetaminophen Oxycodone, 2 pills of Diazepam, and 1 pill of Oxycodone. The amount of Methamphetamine required for a 1st Degree Sale is 17 grams. Thompson and Reiter possessed more than 26 times the amount required to prove first degree sale. Hydrocodone is a Schedule II Narcotic. Oxycodone is a schedule II Narcotic. Carisoprodol is a Schedule IV controlled substance. Alprazolam is a Schedule IV controlled substance. Diazepam is a Schedule IV controlled substance. Thompson has been convicted of an offense similar to Minnesota Statute 152.021 in federal court. Thompson was convicted of Possession With Intent to Distribute in Excess of 50 grams of Methamphetamine on April 8, 2008. PLEASE TAKE NOTICE: Pursuant to Minn.
