Call for Public Comments on Agenda & Non-Agenda Items The public was invited to address agenda items, submit items within the subject matter jurisdiction of the Board for future consideration, or speak to issues related to the function and operation of the County Board of Education. VII. Future Agenda Items A. Williams Site Visit 2014 Annual Report on the Status of Schools in Merced County VIII. Superintendent s and Board Members Report (Information/Discussion Only) A. Report on Attendance of MCSBA Summit for Educational Excellence: Steve Gomes stated that Capitol Advisors provided information on upcoming topics such as the LCAP, etc. Board members, Chris Chavez and Dennis Hanks reported that the summit was very informative. B. Head Start Update: Linda Kaercher reported that all Head Start centers and options are fully enrolled; 1060 preschool and 200 infants, toddlers, and pregnant women. The Early Head Start Child Care Partnership grant opportunity was submitted, notification expected between December and March. Previously reported pending license for Castle Head Start/Early Head Start received. Planada change of capacity pending additional sink. The Self-Assessment will take place November 17-21. Board members are welcome to participate. C. GASB 45 Actuarial Report: Janet Riley provided a PowerPoint presentation on Merced County Office of Education OPED (Other Post-Employment Benefits). D. Sunshine 2014-2015 Bargaining Unit Proposal from MCOTA. The 2014-2015 Bargaining Unit proposal from MCOTA was sunshined. E. Sunshine 2014-2015 Bargaining Unit Proposal from MCOE to MCOTA. F. Public Input on Sunshine 2014-2015 Bargaining Unit Proposal from CSEA, Chapter 541. The public was invited to provide input on the proposal. Comments were made by Linda Wilson, Lydia Flores, Cindy Andrade, Anita Sheffield in regards to CSEA s request for a 5% increase and health cap increase and the last raise was given back in July of 2007. G. Public Input on Sunshine 2014-2015 Bargaining Unit Proposal from MCOE to CSEA, Chapter 541. The public was invited to provide input on the proposal. H. Review of Board Bylaw 9270 Conflict of Interest: (For approval at the November Board meeting) I. Departmental Reports 1. Special Education Susan Coston provided an overview of services provided by the Special Education Department. Special Education is specially designed instruction and related services to meet the unique needs of individuals whose educational needs cannot be met with accommodations or modifications in the general education classroom. Special Education is available to students who meet the eligibility requirements as being disabled under individual with Disabilities Education Act (IDEA) from birth to age 22. J. Superintendent s Report Steven E. Gomes reported on the following: 1. Common Core Forum November 3, 2014 Atwater VCS 2. SSDA New and First-Term Orientation Workshops IX. Business Items for Action A. Gann Limit It is recommended that the Board of Education approve Resolution No. 2014-34 Adopting the Gann Limit. Fred Honoré moved and Dennis Hanks seconded a motion to approve Resolution No. 2014-34 Adopting the Gann Limit. The motion carried with a vote of 4-0-1 (Honey). B. Retirement Resolution It is recommended that the Board of Education approve Retirement Resolution as submitted. 1. Resolution No. 2014-35 Honoring Kathleen Flaherty Dennis Hanks moved and Fred Honoré seconded a motion to approve Retirement Resolution No. 2014-35 Honoring Kathleen Flaherty. X. Closed Session Pursuant to Education Code 35146 to Hear Appeal of Denial of Interdistrict Attendance Request 4:30 PM Appeal # 2014-05 The Board of Education met in closed session for the Interdistrict Appeal Hearing of student # 2014-05 XI. Closed Session to Deliberate Interdistrict Attendance Appeal The Board deliberated the Interdistrict Attendance Appeal The Board proceeded into Open Session. XII. Open Session for the Disposition of Interdistrict Attendance Appeal On the request for an appeal of denial of the Interdistrict Attendance Request submitted on behalf of Student #2014-05 it was moved by Dennis Hanks and seconded by Fred Honoré to uphold, for the 2014-2015 school year, Merced City Elementary School District decision to deny the parents appeal for an Interdistrict Attendance Agreement for attendance at the Merced City Elementary School District. The motion carried with a vote of 4-0-1 (Honey). Vote (by roll call) Hanks: Yes Honey: Absent March: Yes Chavez: Yes Honoré: Yes The Board proceeded into Closed Session. XIII. Closed Session for Appeal of Pupil Expulsion #2014-01 At approximately 5:23 PM the Merced County Board of Education met in closed session for the appeal of Pupil Expulsion #2014-01. XIV. Executive Session for Board Deliberate of Pupil Expulsion #2014-01 The Merced County Board of Education met in Executive Session to deliberate Pupil Expulsion #2014-01. XV. Open Session for the Disposition of Interdistrict Attendance Appeal In the Appeal of Pupil Expulsion #0214-01, Dennis Hanks moved and Chris Chavez seconded a motion that the Merced County Board of Education adopt the Findings of Facts and the Order affirming the decision of the Merced Union High School District.
