ORDINANCE NO. 2019-152 AN ORDINANCE OF THE CITY OF WACO, TEXAS, AUTHORIZING THE ELECTION OF UNOPPOSED CANDIDATES FOR THE POSITIONS OF COUNCIL MEMBER DISTRICT II, COUNCIL MEMBER DISTRICT IV, AND COUNCIL MEMBER DISTRICT V FOR THE WACO CITY COUNCIL AND CANCELLING THE MAY 24, 2019 GENERAL ELECTION; REQUIRING THE CITY SECRETARY TO POST A COPY OF THIS ORDINANCE AT EACH CITY OF WACO POLLING PLACE; AUTHORIZING CERTIFICATES OF ELECTION TO BE ISSUED; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING A SAVINGS CLAUSE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE IS PASSED IS OPEN TO THE PUBLIC AS REQUIRED BY LAW; AND DECLARING AN EMERGENCY. WHEREAS, on February 5, 2019, the Waco City Council issued an order calling for a General Election to be held in the City of Waco on May 4, 2019 for the purpose of electing City Council Members for Districts II, IV and V; and WHEREAS, on January 16, 2019, Hector Sabido filed an application for a place on the City of Waco ballot for Council Member District II; and WHEREAS, on January 16, 2019, Dillon Meek and Nicholas St. John each filed an application for a place on the City of Waco ballot for Council Member District IV; and WHEREAS, on January 16, 2019, Jim Holmes filed an application for a place on the City of Waco ballot for Council Member District V; and WHEREAS, the filing deadline for an application for a place on the City of Waco ballot was February 15, 2019; and WHEREAS, on February 18, 2019, Nicholas St. John filed a Certificate of Withdrawal pursuant to and in accordance with Section 145.001, Texas Election Code; and WHEREAS, the filing deadline for write-in candidates for the General Election to be held in the City of Waco on May 4, 2019 was February 19, 2019; and WHEREAS, as of 5:00 p.m. on February 19, 2019, no candidate filed a declaration of write-in candidacy for Council Member Districts II, IV or V; and WHEREAS, on February 20, 2019, the City Secretary certified that the candidates for Council Member Districts II, IV, and V were unopposed and a copy of this certification is attached as Exhibit A; and

WHEREAS, under these circumstances, Subchapter C, Chapter 2 of the Texas Election Code authorizes the City Council to declare the candidates elected to office and cancel that election, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WACO, TEXAS: Section 1. That the Waco City Council hereby declares HECTOR SABIDO elected to the position of Councilmember for District II of the City Council of the City of Waco, Texas. Section 2. That the Waco City Council hereby declares DILLON MEEK elected to the position of Councilmember for District IV of the City Council of the City of Waco, Texas. Section 3. That the Waco City Council hereby declares JIM HOLMES elected to the position of Councilmember for District V of the City Council of the City of Waco, Texas. Section 4. That the General Election for May 4, 2019 is cancelled. Section 4. That a certificate of election shall be issued to HECTOR SABIDO as Council Member District II of the City Council of the City of Waco in the same manner and at the same time as other candidates that are elected on May 4, 2019. Section 5. That a certificate of election shall be issued to DILLON MEEK as Council Member District IV of the City Council of the City of Waco in the same manner and at the same time as other candidates that are elected on May 4, 2019. Section 6. That a certificate of election shall be issued to JIM HOLMES as Council Member District V of the City Council of the City of Waco in the same manner and at the same time as other candidates that are elected on May 4, 2019. Section 6. That the City Secretary shall post a copy of this ordinance on Election Day, May 4, 2019, at the polling places used or that would have been used in the election. Section 7. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 8. That the terms and provisions of this ordinance shall be deemed to be severable and that if any section, subsection, sentence, clause, or phrase of this ordinance shall be declared to be invalid or unconstitutional, the same shall not affect the validity of any other section, subsection, sentence, clause, or phrase of this ordinance and the remainder of such ordinance shall continue in full force and effect the same as if such invalid or unconstitutional provision had never been a part hereof. Section 9. That it is hereby officially found and determined that the meeting at which this ordinance is passed is open to the public and that public notice of the time, place, and purpose of said meeting was given as required by law.

Section 10. That the ordinance is necessary to preserve the essential operations of the City of Waco and to protect the public health, safety and welfare which creates an urgent and imperative public necessity that requires that the rule requiring the reading of ordinances on two several days be suspended, and such rule is suspended and this ordinance shall take effect upon its passage as provided by the City Charter of the City of Waco, Texas.
