8 9 0 8 9 0 8 9 AN ACT appropriating $,990,9 from constitutionally dedicated corporation business tax revenues for the purpose of providing grants, as awarded by the New Jersey Historic Trust, for certain historic preservation projects. BE IT ENACTED by the Senate and General Assembly of the State of New Jersey:. a. There is appropriated to the New Jersey Historic Trust the following sums for the purpose of providing capital preservation grants as listed in subsection b. of this section and historic site management grants as listed in subsection c. of this section as awarded by the New Jersey Historic Trust, for historic preservation projects approved as eligible for such funding: () $,0,9 from dedicated corporation business tax revenues pursuant to Article VIII, Section II, paragraph of the State Constitution in the Preserve New Jersey Historic Preservation Fund, established pursuant to section 9 of the Preserve New Jersey Act, P.L.0, c. (C.:8C-); and () $,9,000 from the unexpended balances of dedicated corporation business tax revenues pursuant to Article VIII, Section II, paragraph of the State Constitution in the Diesel Risk Mitigation Fund - Constitutional Dedication account made available for this purpose pursuant to the provisions of P.L.0, c.99. b. Any transfer of any funds, or change in project sponsor, site, or type, listed in subsection b. or c. of this section shall require the approval of the Joint Budget Oversight Committee or its successor. e. To the extent that moneys remain available after the projects listed in subsection b. or c. of this section are offered funding pursuant thereto, any project of a local government unit or

8 9 0 8 9 0 8 9 0 8 9 0 8 qualifying tax exempt nonprofit organization that previously received funding for historic preservation purposes appropriated or reappropriated from any Green Acres bond act, any annual appropriations act, or the Garden State Historic Preservation Trust Fund established pursuant to section of P.L.999, c. (C.:8C- ), or that receives funding pursuant to this act, shall be eligible to receive additional funding, as determined by the New Jersey Historic Trust, subject to the approval of the Joint Budget Oversight Committee or its successor. For the purposes of this subsection, "Green Acres bond act" means P.L.009, c., P.L.00, c.9, P.L.99, c.0, P.L.99, c.88, and P.L.98, c.. f. The expenditure of moneys appropriated pursuant to this section is subject to the provisions of the Preserve New Jersey Act, P.L.0, c. (C.:8C- et seq.).. There is appropriated from the General Fund to the Preserve New Jersey Historic Preservation Fund, established pursuant to section 9 of the Preserve New Jersey Act, P.L.0, c. (C.:8C-), the sum of $,0,9 to implement the provisions of this act.. This act shall take effect immediately. STATEMENT The bill appropriates $,990,9 to the New Jersey Historic Trust for the purpose of providing grants, as awarded by the New Jersey Historic Trust, for certain historic preservation projects contained in this bill. The funding in this bill is provided from constitutionally dedicated corporation business tax (CBT) revenues pursuant to Article VIII, Section II, paragraph of the State Constitution, approved by the voters of the State in November 0, including the unexpended balances in the Diesel Risk Mitigation Fund Constitutional Dedication account made available for these purposes pursuant to P.L.0, c.99 (i.e., the FY08 annual appropriations act). The Preserve New Jersey Act implements for State fiscal years 0 through 09, the constitutional dedication of CBT revenues for open space, farmland, and historic preservation. Specifically, of the funding provided in this bill, $,0,9 is from constitutionally dedicated CBT revenues in the Preserve New Jersey Historic Preservation Fund, and $,9,000 is from the unexpended balances in the Diesel Risk Mitigation Fund Constitutional Dedication account. The Preserve New Jersey Historic Preservation Fund was established by section 9 of the Preserve New Jersey Act.

8 9 0 8 9 0 The funding contained in this bill will be used to provide capital preservation grants for projects, totaling $,98,, and historic site management grants for 8 projects, totaling $9,9. Capital preservation grants fund the restoration, preservation, repair, and rehabilitation of historic sites for new or continued use by nonprofit organizations or county and municipal governments. The properties must be listed or eligible for listing in the State or National Register of Historic Places. There are two levels of capital preservation grants: Level I grants of $,000 to $0,000, and Level II grants of $0,00 to $0,000. Historic site management grants support non-construction activities such as long-term planning of operations and programs including building assessments, accessibility, landscape plans, and creating educational campaigns to increase public awareness. The projects listed in this bill have been approved by the New Jersey Historic Trust and the Garden State Preservation Trust. The bill also provides that any transfer of any funds to another project, or change in project sponsor, site, or type, listed in the bill would require the approval of the Joint Budget Oversight Committee. The bill further provides that to the extent there are funds remaining after those projects listed in this bill are offered funding, the New Jersey Historic Trust, with the approval of the Joint Budget Oversight Committee, may use those funds to provide additional funding for historic preservation projects of local government units or qualifying tax-exempt nonprofit organizations previously approved for funding pursuant to various other laws or approved for funding pursuant to this bill.
