MINUTES OF THE PUBLIC HEARING OF THE NORVELL TOWNSHIP BOARD HELD IN THE NORVELL TOWNSHIP HALL, 106 E COMMERCIAL ST, NORVELL MI 49263 PRESENT: Supervisor Johnson, Treasurer Sauers, Clerk Hagadorn, Trustee Smith and Trustee Johnson. The Supervisor called the meeting to order at 6:30 p.m. Notice of the public hearing was published in the Exponent. All property owners in the special assessment district were sent a notice by mail of the hearing. The purpose of this hearing is to hear objections to creating a special assessment district to the petition, the project, cost, determination of district boundary lines, term of existence and provide for periodic re-determination of cost and dates for the Wamplers Lake Weed District A sign in sheet was passed around for the people to sign. There was lots of discussion as to who should be in the district. Total of properties in the district is 230. Public Comment none Hagadorn moved, Trustee Johnson supported, to close the special meeting and open the public hearing. Roll call: Sauers, yes, Smith, yes, Trustee Johnson, yes, Hagadorn, yes, Supervisor Johnson, yes. Motion Carried. 6:45 p.m. NEW BUSINESS A. Presentation from Water Resources Due to bad weather Jennifer Jermalowicz-Jones, Water Resources Director; Restorative Lake Sciences was unable to attend the meeting. We will try to reschedule. B. Presentation from Property Owners

The WLPO Association is willing to pay $2,000.00 towards the cost of having a lake manager. A property owner asked why the Association would pay directly to the management company and not pay to the township. Discussion was held about putting the back lotters in even though they did not get a chance to participate in the hearing. Public Comment None Hagadorn moved, Trustee Johnson supported, to close the public hearing and reconvene the special meeting. Roll call: Sauers, yes, Smith, yes, Trustee Johnson, yes, Hagadorn, yes, Supervisor Johnson, yes. Motion Carried. The public hearing was closed at 7:44 P.M. Supervisor Johnson read Resolution 14-07. A resolution confirming the special assessment roll; lien; payment and collection of special assessment. Sauers moved, Smith supported to adopt Resolution 14-07 as presented. TOWNSHIP OF NORVELL COUNTY OF JACKSON, MICHIGAN Minutes of a Public Hearing meeting of the Township Board of the Township of Norvell, Jackson County, Michigan, held at the Norvell Township Hall, in said Township, on the 17 th day of November, 2014 at 6:30 p.m. PRESENT: Members: ABSENT: Members: The following resolution was offered by Member and supported by Member #14-7 CONFIRMATION OF SPECIAL ASSESSMENT ROLL; LIEN: PAYMENT AND COLLECTION OF SPECIAL ASSESSMENT WHEREAS, the Township Board, pursuant to Act 188 of the Public Acts of Michigan of 1954, as amended ("Act 188") has resolved its intent to make public improvements consisting of the eradication and control of aquatic weeds in Wamplers Lake in the Township("Improvements"); and WHEREAS, after notice duly given by publication and by first class mail pursuant to Act 188, the Township Board held a public hearing to consider a proposed special assessment roll for the Wamplers Lake Weed Control Special Assessment District("the District") and objections thereto for said Improvements, on November 12, 2014, and WHEREAS, after hearing all persons interested therein, giving due consideration to all written objections to said special assessment roll filed with the Township Clerk and after reviewing said special assessment roll, as amended, to be fair, just and equitable, and that each of the assessments contained therein is relative to the benefits to be derived by the parcel of land assessed. NOW, THEREFORE, BE IT HEREBY RESOLVED AS FOLLOWS:

1. The special assessment roll prepared by the Township Supervisor and reported to the Township Board, in the amount of $112,750 for the five-year term of the District, is hereby confirmed and shall be known and designated for the District as Special Assessment Roll No. 1(the "Roll"). 2. The Township clerk shall endorse on the Roll the date of this meeting as the date of Confirmation of said Roll. 3. The Roll shall be divided into annual installments, the first due in 2014 by the regular due date designated for the collection of taxes and assessments on the Winter Tax Bill for that year and for each year thereafter for each respective Winter Tax Bill through 2018. 4. Interest, relating to each due date, shall not be paid on the balance of unpaid installments. However, if the Township issues bonds in anticipation, or in response to, unpaid installments of the special assessments, the Township Board shall adjust for this by establishing an interest rate not to exceed one percent(1%) above the average rate of interest borne by said bonds. 5. Future due installments of an assessment against any parcel of land may be paid to the Township Treasurer at any time in full. 6. If an installment of a special assessment is not paid when due, then it is considered to be delinquent. 7. All special assessments contained in the Roll, including any part thereof deferred as to Payment, shall from the date of confirmation of the Roll, pursuant to Act 188, constitute a lien upon the respective parcels of land assessed. 8. The special assessments made in the Roll are hereby ordered and directed to be collected and the Township Clerk shall deliver the Roll to the Township Treasurer with the Clerk's warrant attached thereto, which warrant shall command the Township Treasurer to collect the special assessments in the Roll in accordance with the direction of the Township Board in respect thereto and which warrant shall further require the Township Treasurer to include as a delinquent tax any unpaid special assessment which is delinquent by its due date, and the delinquent taxes returned to the County Treasurer the next day pursuant to Section 55 of the General Property Tax Act, MCL 211.55. The form of said warrant is attached hereto as Exhibit A. 9. Upon receiving the Roll and warrant, the Township Treasurer shall proceed to collect the several amounts assessed therein as the same shall become due. 10. Each year, commencing in 2015 on or before June 30, the Township Board shall redetermine the amount of the special assessment to be assessed against the parcels within the District based upon the estimate of cost for the Improvements to be undertaken in the next year and any funds remaining on hand from the prior collections. 11. All actions heretofore taken by Township officials, employees, and agents with respect to the Improvements and proceedings under Act 188 are hereby ratified and confirmed.

12. All resolutions or parts of resolutions in conflict herewith shall be and the same are hereby rescinded. YEAS: Members: NAYS: Members: RESOLUTION DECLARED ADOPTED. Anne M.
