REGULAR TERM REGULAR SESSION JUNE 14, 2010 On this the 14 th day of June, 2010, A.D., at 9:00 a.m. the Commissioners Court of Jackson County, Texas convened in a Regular Term, Regular Session, thereof, at the Courthouse of Edna, Texas, with the following members of the Court present, to-wit: Harrison Stafford, II County Judge Wayne Hunt Comm. Citizens Comments There were none. Minutes Approved The Minutes of May 24, 2010, were presented. A motion was made by Comm. Belicek, seconded by Comm. Bubela to approve the Minutes. Budget Amendments Budget amendments #434 through # 440 were presented. A motion was made by Comm. Bubela, seconded by Comm. Belicek to approve the budget amendments. Budget Amendments as follows: June 14, 2010 846

Consider New Tire Disposal Rates at Transfer Station, and Take any Discussion was had concerning new rates for tire disposal at the Transfer Station. The new rates will become effective on June 22, 2010 and are as follows: Passenger $2.00, Truck-Light $3.00, Truck-Large $9.00, Tractor $40.00, Remove Tires from Rims $5.00, Mixed Tires & Rubber Debris Collected.10 per pound. A motion was made by Comm. Bubela, seconded by Comm. Deyton to approve the new rates listed above effective June 22, 2010. It was noted the prices may be revised in August. Accept Budget $40,000 Amendment from Edward Brien CJD Grant A motion was made by Comm. Bubela, seconded by Comm. Belicek to accept the $40,000 CJD Grant to budget later. Consider Bids on Leveling Museum Building, and Take any Discussion was had concerning the bid from Texas Best Foundation for leveling the Museum building. A motion was made by Comm. Consider Consolidating Voting Precinct Boxes for the November General Election 2010, and Take any Cherie Robinson, Deputy County Clerk, spoke to the Court concerning consolidating precinct boxes for the November 2010 General Election. She submitted a cost comparison to the Court. A motion was made by Comm. Deyton, seconded by Judge Stafford to consolidate Francitas into La Ward for the November 2010 General Election. Rd. 402 with Cordele Exploration, and Take any A motion was made by Comm. Bubela, seconded by Comm. Belicek to accept the Road Use Agreement with Cordele Exploration and authorize Comm. Consider PTS Maintenance Agreements with Sheriff and District Clerk Offices, and Take any A motion was made by Comm. Bubela, seconded by Comm. Bubela to approve the bid from Dierlam Air Conditioning & Heating for $2,035.00. Receive SECO Contact The State Energy Conservation Office Energy Efficiency and Conservation Block Grant was received. Consider Bids from Sheriff s office to Purchase a Ranger Polaris ATV, and Take any A motion was made by Comm. Belicek, seconded by Comm. Hunt to approve the bid from El Campo Cycle Center for $8,091.24 for a Polaris Ranger 400 for the Sheriff s office to be paid with CJD Grant funds. Consider Payment of County and Precinct Bills and Court Orders Judge Stafford noted the bill from Helping Hands for Christmas gifts included gifts for kids out of Jackson County and the agreement was $200 per child for in-county children. A motion was made by Judge Stafford, seconded by Comm. Hunt to approve the payment of County and precinct bills noting only paying the portion of the Helping Hands bill that is for in- June 14, 2010 848

county children and one court order for $500 down payment to Custom Signs for Pct #1 Barn sign. Payroll Changes There were none. Various County Reports The Treasurer s Monthly report was received. The Extension report was received. Judge Stafford noted L&S Administrative Consultants will no longer be available for Juvenile Probation Title IVE reimbursement requests. Comm. Deyton noted there will not be a safety meeting in July. Court recessed at 9:45 a.m. Court reconvened with full Court present at 10:05 a.m. Judge Stafford noted there will be a Juneteenth Parade and encouraged the Commissioners to get involved. Judge Stafford noted TCEQ and EPA have decided to enforce the Storm Water policies at the Airport. Judge Stafford noted that Unemployment Insurance had a minor increase from.0005 to.0006. Consider Interim Funding for Texana Groundwater Conservation District and Take any Judge Stafford noted that the Court is allowed to fund elections but cannot fund operating and maintenance expenses. A motion was made by Comm. Bubela, seconded by Comm. Belicek to return the unused portion of the original $5,000 election funding which is $762.40. Consider Additional Merchant Category Codes for JP Morgan Chase MasterCard and Take any A motion was made by Comm. Belicek, seconded by Comm. Deyton to add two merchant codes: 4722-Travel Agency Code and 5551-Boat Dealer. Consider Purchase of Cover One Binding Machine for the Voter Registrar and Take any Donna Atzenhoffer, Tax Assessor, spoke to the Court concerning purchasing a binding machine. She noted that Chapter 19 funds will be used for the purchase, but the Court will have to pay for it and get reimbursed. A motion was made by Comm. Bubela, seconded by Comm. Hunt to purchase the Cover One binding machine for $1,195. Clerk s note: A copy of the bid on file among the exhibits of Comm. Court. Consider Increase in Transfer Station & Recycling Center s change fund to $100 and Take any Michelle Darilek noted the Transfer Station s change fund is currently $75.00 and requested to increase the fund to $100. She also requested the Court place a sign at the Transfer Station saying No Bills Over $50.00. A motion was made by Comm. Deyton, seconded by Comm. Bubela to increase the fund to $100 and to put up the sign. Consider Acceptance of FY 2010 EMPG Grant in the Amount of $7,523 and Take any A motion was made by Comm. Deyton, seconded by Comm. Bubela to accept the FY 2010 EMPG Grant in the amount of $7,523 and approve Judge Stafford signature. Clerk s note: A copy of the acceptance on file among the exhibits of Comm. Court. Consider Road Easement Contract with Francitas Ranch Joint Venture and Take any A motion was made by Comm. Deyton, seconded by Comm. Belicek to enter into the contract with Francitas Ranch Joint Venture and authorize Judge Stafford to sign the contract. Clerk s note: A copy of the contract on file among the exhibits of Comm. Court. Consider Purchase of Computer for District Attorney and Take any A motion was made by Comm. Bubela, seconded by Comm. Belicek to approve the purchase of a computer for the District Attorney s office for $1,205. Consider Adoption of Storm Water Pollution Prevention Plan for Airport and Take any A motion was made by Judge Stafford, seconded by Comm. Consider Request to Use the County Fairgrounds for TCEQ Agricultural Collection Event on October 26, 2010 and Take any Mike Hiller spoke to the Court concerning TCEQ using the Fairgrounds for a Collection Event on October 26, 2010. The event will be hosted by TCEQ. A motion was made by Comm. Bubela, seconded by Comm. Hunt to allow TCEQ to hold a Collection Event at the Fairgrounds on October 26, 2010. Consider TxDot Resolution for Bridge Replacement at Venado Creek on CR 313 and Take any A motion was made by Comm. Belicek, seconded by Comm. Bubela to approve the resolution.
