Received comments from Thomas Fox, Ryan McIntosh, Ron Yingling, Thomas McKay, Diana Sheen, Sarah Welch, Duane Sceper, Debbie Lono and Tom Bolenko. Motion by Supervisor Fenley to direct staff to start working: 1. with the Planning Commission on a commercial grow land use ordinance; 2. on permitting authority and fee structure for commercial grows; and 3. with the Planning Commission to review our current land use ordinance as it pertains to personal grows for personal use, failed due to lack of a second. Directed staff to place on the November 3, 2015 agenda and item to discuss: 1. a commercial grows land use ordinance; and 2. permitting and fee structure; and on the November 17, 2015 agenda and item to discuss the personal grows for personal use land use ordinance. Consent Agriculture/Solid Waste 1.01 Approved an agreement with the California Department of Food and Agriculture (15-0444-SF) to provide funding to manually treat broom species on private properties from July 1, 2015 to June 30, 2017. General Services 1.06 Approved a budget adjustment in the Vehicle Abatement Department (Dept. 2950) increasing Services and Supplies by $1,200. Solid Waste 1.07 Adopted Resolution No. 2015-112 which approves revisions to the Solid Waste Service Agreement and authorizes Solid Waste staff to implement and administer the new service terms. Transportation Commission RECESSED AS THE BOARD OF SUPERVISORS AND CONVENED AS THE TRANSPORTATION COMMISSION In-Home Support Services Authority 3.01 Adopted Resolution No. 2015-114 recognizing Service Employees International Union (SEIU) Local 2015 as the successor organization and exclusive bargaining representative for IHSS independent providers and authorizing the County Administrative Officer to sign the recognition agreement. Received comments from Assistant County Counsel David Prentice and County Administrative Officer Wendy Tyler. Health & Human Services 4.01 Pursuant to Government Code Section 21221(h) authorized hiring retired annuitant Beatrice Shafer as a Project Specialist III at Range P753 Step A in the Health and Human Services Department, effective November 4, 2015 and found that this position requires specialized skills. Received comments from Interim Director of Health and Human Services Letty Garza, Health and Human Services Program Manager Jennifer Addison, and County Administrative Officer Wendy Tyler. Motion: Fisher Second: Fenley Carried Vote: 5-0 Closed Session In-Home Support Services Authority 5.01 RECESSED AS THE BOARD OF SUPERVISORS AND RECONVENED AS THE IN-HOME SUPPORT SERVICES AUTHORITY Government Code section 54954.5(f) - Labor Negotiations County's Designated Representatives: Monica Stygar and David Prentice Employee Organizations: In-Home Supportive Services Direction was given to the negotiators. Addendum Board of Supervisors A Authorized the Chairman to sign a letter of support for the Watershed Research and Training Center to serve as a designee of Trinity County in response to the North Coast Resource Partnership s specific solicitation for assistance in preparing a regional assessment and strategy for advancing biomass energy. Received comments from the Watershed Research and Training Center Executive Director Nick Goulette and Duane Sceper. Motion: Fenley Second: Fisher Carried Vote: 5-0 B Discussed desired changes to the Land Use Ordinance as it pertains to commercial medical marijuana grows to be forwarded to the Planning Commission for review. Received comments from Planning Director Rick Tippett, County Counsel Margaret Long, County Administrative Officer Wendy Tyler, Duane Sceper, Duncan McIntosh, Terry Mines, Liz McIntosh, Adrian Kyes, John Bower, Bobbi Chadwick, Piper McDaniel, Tom Bolenko, Kay Graves, and Tom. Directed staff to bring to the Planning Commission an item to work on a land use ordinance pertaining to commercial medical marijuana grows and their locations, zoning requirements, water issues, number of grows allowed Countywide, etc. Motion: Burton Second: Fisher Carried Vote: 5-0 C Discussed potential permitting and fee structure for medical marijuana cultivation. Received comments from County Administrative Officer Wendy Tyler, County Counsel Margaret Long, Planning Director Rick Tippett, Duane Sceper, Kay Graves, Duncan McIntosh, Terry Mines, John Hall, Bonnie Chadwick, Chris Schafer, Liz McIntosh, Tom Bolenko and Rob Oakley. Directed staff to create a draft permitting/licensing structure with a tiered fee component; Further directs staff to develop a provisional licensing structure pending completion of the land use ordinance. Departments to assist in creating plans are Administration, County Counsel, Agricultural Commissioner, Planning and Public Health. Focus to be given to a structure that provides for ease in verifying compliance. Motion: Fenley Second: Groves Carried Vote: 5-0 Directed the County Administrative Officer to bring back information on a commercial medical marijuana cultivation tax (i.e. timelines, examples, what are other counties doing) on the December 15, 2015 agenda.
