Treff Director of Investments A public hearing will be conducted at 8 a.m. Friday, October 20, at the office of the Kansas State Board of Pharmacy, Room 560, Landon State Office Building, 900 S.W. Jackson, Topeka, to consider the proposed adoption of K.A.R. 68-16-1 K.A.R. 68-16-9 as permanent regulations of the Board of Pharmacy. Members of the board may appear at the public hearing via telephone conference. This 60-day notice of the public hearing shall constitute a public comment period for the purpose of receiving written public comments on the proposed adoption of K.A.R. 68-16-1 K.A.R. 68-16-9. All parties may submit written comments prior to the hearing to Debra Billingsley, executive director of the Board of Pharmacy, Room 506, Landon State Office Building, 900 S.W. Jackson, Topeka, 66612-1231. All interested parties will be given reasonable opportunity to present their views orally on the adoption of the regulations during the hearing. In order to give all parties an opportunity to present their views, it may be necessary to request that each participant limit any oral presentation to five minutes. K.A.R. 68-16-1 K.A.R. 68-16-9 are proposed for permanent adoption. A summary of each proposed regulation follows: K.A.R. 68-16-1. Definitions. This regulation identifies the terms that apply to the cancer drug repository program. K.A.R. 68-16-2. Requirements for participation by physicians, pharmacies, hospitals, and nonprofit clinics. This regulation specifies the written notification requirements that shall be satisfied by each physician, pharmacy, hospital and nonprofit clinic that elects to participate in the cancer drug repository program. K.A.R. 68-16-3. Donation of cancer drugs. This regulation identifies the conditions under which a cancer drug may be accepted, where each cancer drug repository shall receive donated drugs and how each donated cancer drug shall be stored. K.A.R. 68-16-4. Dispensing requirements. This regulation identifies the conditions under which any donated cancer drug shall be dispensed. K.A.R. 68-16-5. Handling fees. This regulation specifies the handling fee a cancer drug repository may charge the recipient for each cancer drug dispensed. K.A.R. 68-16-6. Distribution of donated cancer drugs. This regulation outlines the requirements that shall be satisfied when any cancer drug repository distributes a donated drug to another participating cancer drug repository. K.A.R. 68-16-7. Sale of donated drugs. This regulation prohibits the sale of donated drugs and specifies the penalties that may be imposed for the sale of donated drugs. K.A.R. 68-16-8. Recordkeeping requirements. This regulation specifies the length of time all cancer drug repository donor forms and cancer drug repository receipt forms shall be maintained and the written record that shall be created and maintained when a cancer drug repository destroys any donated cancer drug. K.A.R. 68-16-9. Forms. This regulation identifies the information that each cancer drug repository receipt form and each cancer drug repository donor form shall contain. Notice/Hearing 1121 (Published in the August 17, 2006.) City of Lenexa, Kansas Notice to Bidders Sealed bids for Rebid of Coon Creek Trail will be accepted by the city of Lenexa, Kansas, at the Planning Department, Lenexa City Hall, 12350 W. 87th St. Parkway, Lenexa, 66215, until 9:30 a.m. August 25, at which time bids will be publicly opened and read aloud at the Lenexa City Hall. Any bid received after the designated closing time will not be considered and will be returned unopened. All bids shall be submitted to the Planning Department customer service staff (main level of City Hall) in sealed envelopes addressed to the City of Lenexa, Kansas, Attention: City Clerk, and marked Bid for: Rebid of Coon Creek Trail. Copies of plans, specifications, bidding documents and other contract documents are on file at the Public Works Department (lower level), Lenexa City Hall. Bidders desiring contract documents for use in preparing bids may obtain a set of such documents at the address above upon payment of $150, which amount is nonrefundable. In lieu of picking up plans and specifications at Lenexa City Hall, bidders may download plans and specs free of charge from the city of Lenexa s Web site at http://www. ci.lenexa.ks.us/publicworks/index.html. Contractors should read and be fully familiar with all contract documents including addenda before submitting a bid. In submitting a bid, the bidder warrants that it has read the contract documents and is fully familiar therewith and that it has visited the site of the work to fully inform itself as to all existing conditions and limitations, and shall include in its bid a sum to cover the cost of all items of the work as specified in the contract documents. No oral telegraphic, telephonic proposals or alterations will be considered. Facsimile transmissions will not be accepted. The following items must be included in the sealed envelope with the bid: a. Bid Form; b. 5% Bid Security Bid Bond, Cashier s Check or Certified Check (see below). Each bidder shall file with its bid a bid bond, a cashier s check or a certified check drawn on an acceptable bank, made payable to the city of Lenexa, Kansas, in an amount equal to 5 percent of the total bid, which shall be retained by the city of Lenexa, Kansas, until a contract for the project has been executed. Bid bonds will be returned to the bidders, with the exception of the best and lowest and second best and second lowest responsible bidders, within 21 days after their bids are rejected. The bid deposit of the lowest and the second lowest responsible bidders will be returned when the performance bond, maintenance bond and statutory bond, each in an amount equal to 100 percent of the contract amount, required insurance certificates and other required documents shall have been furnished and the contract documents have been executed by the successful bidder. In the event the low bidder is unable to execute the contract, for whatever reason, within the time provided in the notice of award, the city may annul the notice of award and the bid deposit may be forfeited, and the city shall exercise its legal prerogatives, including, but not limited to, enforcement of its rights as to the bid security or specific performance. The city reserves the right to accept or reject any and all bids and to waive any technicalities or irregularities therein. Bids may be modified or withdrawn by written request of the bidder received in the office of the city clerk prior to the time and date for bid opening. All bidders agree that rejection shall create no liability on the part of the city because of such rejection, and the filing of any bid in response to this notice shall constitute an agreement of the bidder to these conditions. A pre-bid conference will be held at 10 a.m. August 17 in the Public Works conference room, lower level, Lenexa City Hall. Doc. Harrison, Topeka, to consider the adoption of amendments to an existing rule and regulation on a permanent basis effective January 1, 2007. Telephone conference is not available. This 60-day notice of the public hearing shall constitute a public comment period for the proposed regulation as stated in K.S.A. 2005 Supp. 77-421(a)(3). All interested parties may submit written comments prior to the hearing to Hope Burns, Office of the Secretary for SRS, Room 603-N, Docking State Office Building, 915 S.W. Harrison, Topeka, 66612. All interested parties will be given a reasonable opportunity to present their views, but it may be necessary to request each participant to limit any oral presentation to five minutes. A summary of the proposed regulation and the economic impact follows: Article 4. PUBLIC ASSISTANCE PROGRAM 30-4-64. Work program requirements. This regulation is being amended to make several changes. First, a clarification is included for the exemption of a parent or other caretaker providing care for a child under age one to note that this exemption may be claimed only for a total of 12 months. Second, the definitions for work program components have been modified to reflect that such activities must be supervised. Lastly, the provisions regarding ineligibility for benefits for failure to cooperate have been changed to include cooperation with the work assessment process and allow for a penalty to continue until the person cooperates. Other technical changes also have been made to this regulation. Federal Mandate: Changes in this regulation are a result of the Deficit Reduction Act of 2006, which reauthorized the federal Temporary Assistance for Needy Families (TANF) program.
